Questions & Answers
The provided responses to questions submitted by Offerors are for information only. If there are differences between the responses and the solicitation, the solicitation overrides the responses. The responses do NOT change the solicitation requirements as written.
1. Reference: Seniority List
Q: Will the Government provide a current seniority list for the incumbent guard force? Can the FPS please provide a name-redacted seniority list for the purpose of accurate computation of vacation entitlements? REF: Collective Bargaining Agreement and Applicable Wage Determination: Can the Government please provide a seniority list of incumbent employees? Will the Government please provide a seniority list for the PSOs (including county to which the employee is assigned) to accurately determine vacation benefits? Will the government provide a seniority list for the current contract?
A: The Seniority List will be provided after award to the awardee. Per FAR 22.1020, Seniority Lists, and FAR 52.222-41 (n), “At the commencement of the succeeding contract, the contracting officer shall provide a copy of the list to the successor contractor for determining employee eligibility for vacation or other fringe benefits which are based upon length of service, including service with predecessor contractors if such benefit is required by an applicable wage determination.”
2. Q: It appears from reading the Federal Wage Determination #2005-2059 and the CBA that any locations in Marin, San Francisco and San Mateo county are covered under the WD, and that all other locations are covered under the CBA; is this a correct interpretation?
A: Yes, that is correct.
3. The CBA states on page 14 that the Company agrees to pay 10 cents above the Federal Wage Determination (currently $3.50) that is in effect each July of the contract. The Wage Determination included in the RFP is dated July 2010; since performance is not scheduled to begin until October 2011, most likely a new wage determination will be issued prior to contract start. If such occurs, will the government incorporate the new wage determination into the contract and allow an adjustment to final price, or a base year REA? (Under the FAR, base year adjustments are not normally allowed, however, in this case, under “successor” contractor rules, a new contractor would be bound by this provision in the CBA and obligated to pay.)
A: The Wage Determination current on the date of award shall be incorporated into this contract. If determined to be appropriate, wage adjustments will be made in accordance with FAR 52.222-43.
4. Can the incumbent contractor be required to respond to the following question:
The CBA states on page 12 and 13 that employees receive a 30 minute lunch break and goes on to say they receive a 15 minute paid break each 4 hours. If goes further to state that employees must remain “on call” during breaks. Since California Labor law states that in order for a break to be unpaid, the employee must be entirely relieved of duty. Does this then make all breaks, e.g., lunch and rest “paid breaks”?
A: FPS can not require the incumbent contractor to answer any questions regarding the CBA nor is FPS a party to the CBA and; therefore, is not in a position to interpret it.
5. CA LABOR LAW:
Unless the employee is relieved of all duty during a 30 minute meal period, the meal period shall be considered an “on duty” meal period and counted as time worked. An “on duty” meal period shall be permitted only when the nature of the work prevents an employee from being relieved of all duty and when by written agreement between the parties an on-the-job paid meal period is agreed to. The written agreement shall state that the employee may, in writing, revoke the agreement at any time. California Code of Regulations, Title 8, §11040.
