A. Section 12.1.2.1 of the Statement of Work is hereby deleted in its entirety and replaced with the following:
Exhibit 1 to the Statement of Work specifies which posts require provision of a relief PSO if the assigned PSO is taking a break or meal period to ensure continuous/uninterrupted coverage. The Contractor must provide a replacement PSO for each employee on an authorized break. Patrol (rover) PSOs shall not be used to provide breaks/relief. Supervisors shall not provide relief while working in a supervisory capacity (i.e. a supervisor shall not perform supervisory and productive PSO services simultaneously). In order to provide breaks and/or relief, a supervisor must sign-off as a supervisor, remove any supervisory insignia, and sign-in as a productive PSO. PSOs working a minimum 8 hour shift shall be provided a paid 15 minute break for each 4 hours of work. This break should normally be scheduled in the middle of each 4 hour period. A 30 minute unpaid lunch break shall also be provided to those individuals. All PSOs working a 6 hour shift shall be provided a paid 15 minute break and an unpaid 30 minute lunch break. PSOs working a minimum of 4 hours shall be provided a paid 15 minute break.
B. Section 15.3.7 is hereby added to the Statement of Work as follows:
The contractor shall provide a monthly report to the Contracting Officer and COTR no later than the 15th calendar day following the month that the report is due (i.e. the April report would be due May 15th). At a minimum, this monthly report shall contain all the information found at Exhibit 11.
C. Exhibit 11 is hereby added to Attachment II, Exhibits (see attached).
D. The following clause is hereby incorporated by reference:
FAR 52.211-11 Liquidated Damages-Supplies, Services, or Research and Development (SEPT 2000)
E. The following provisions are hereby incorporated by reference:
FAR 52.216-31 Time-and-Materials/Labor-Hour Proposal Requirements-Commercial Item Acquisition (FEB 2007) (only applicable to Line items for Temporary Additional Services CLINs 0003, 0004, 0103, and 0104)
FAR 52.225-25 Prohibition on Engaging in Sanctioned Activities Relating to Iran-Certification
(SEPT 2010)
FAR 52.223-1 Biobased Product Certification (DEC 2007)
The following information is provided for informational purposes only:
F. Before asking any questions, please read the solicitation completely and carefully.
G. The seniority list for the current Nebraska Avenue Complex contract is attached. Paragon is the incumbent contractor.
H. An excel version of Attachment 6 – Price Element Breakdown is attached. The Government does not guarantee that the formulas within the spreadsheet are correct. If contractors choose to use the spreadsheet, they should check all calculations for accuracy.
I. An excel version of Exhibit 1A – Onsite Supervisory Post Exhibit is attached.
J. A word version of Attachment 3 – Past Project Form and Attachment 4 – Past Performance
Questionnaire are attached. Please note the previous version of Attachment 4 included the incorrect solicitation number.
K. With regard to questions concerning the CBA, the Government will not interpret provisions of this document for potential offerors (e.g. supervisory positions etc.). Please refer to the applicable Federal Acquisition Regulations and Code of Federal Regulations as they relate to the Service Contract Act. Service Contract Act price adjustments pursuant to FAR 52.222-43 will be conducted on the anniversary date of the contract (i.e. October 1, 2012, October 1, 2013 etc.).
L. With regard to questions concerning the training of incumbent PSOs, all PSOs are trained in accordance with most of the requirements of the solicitation; however, any incumbent PSOs will have to qualify on the FPS (ICE) course of fire before they could stand post under the contract resulting from this solicitation as incumbent officers currently qualify on another course of fire (FLETC). In addition, they will have to qualify with their individually assigned weapon semi-annually. Further, the current contract does not contain the training in exhibits 4H and 4I. All contract PSO personnel must meet all the requirements of the solicitation before they can work under the new awarded contract. The current contract requires the .40 handgun.
M. With regard to questions concerning medical standards, note that the instant solicitation’s requirements differ from the requirements in the current contract. All contract PSO personnel must meet all the requirements of the solicitation before they can work under the new awarded contract.
N. With regard to questions concerning implementation of FPS/PTS and assignment of the associated personnel identification numbers (PINs), the following applies: PTS is not currently operational. Information regarding PTS and assignment of PINs shall be provided post award and upon full implementation of the PTS. DHS Form 139 will be utilized prior to PTS implementation, and then only when PTS is not operational.
O. With regard to questions concerning the incumbent PSO training records, the current contract is not an FPS contract and therefore the Government can not guarantee which records will be available to the successor contractor. PSO’s shall have all training records in relation to the contract’s requirements in order to stand post under this effort.
P. With regard to questions concerning a potential site visit, a site visit will not be provided to potential offerors.
Q. With regard to questions concerning GSA Schedules, the following applies: This RFP is not for a GSA Schedule acquisition conducted in accordance with FAR 8.4; therefore, offerors are not required to have a GSA Contract and the Industrial Funding Fee (IFF) does not apply.
R. With regard to questions concerning body armor, OC Spray, and batons, PSOs on the current contract do possess body armor, OC Spray, and batons.
S. With regard to questions related to current levels of supervision, this is not considered relevant to the present requirement as the Government is looking for an offeror’s approach to supervision at this facility/complex.
T. With regard to questions concerning weapon storage, there is an area designated for weapon storage as well as a PSO break room.
U. With regard to questions concerning “roll-call” briefings (see section 9.3.4 of the SOW), the start and end times in the post exhibit (Exhibit 1) do not include “roll-call” time. There will be a Government furnished space for “roll-call” briefings.
