MEMORANDUM FORPatricia E. Solberg
Chief, Specialized Services Branch (SSB)
Through:Sherrie D. Walters
Contracting Officer

Procurement Division

FROM: John David Flood Chief, Applications, Databases, and Web Branch (ADW) Operations and Support Division

Subject: Justification and Approval for Other than Full and Open Competition

Reference: FAR 6.302-1, Only One Source is Available (pursuant to 41 U.S.C. 253(c) (1)

Pursuant to the requirements of the Competition in Contracting Act (CICA), as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

(1) Agency and Contracting Activity. The Department of Homeland Security (DHS), Federal Law Enforcement Training Center (FLETC), Procurement Division proposes to execute a one month extension modification to the bridge contract HSFLGL-13-J-00191 to the incumbent contractor, Visionary Integration Professionals, LLC, 80 Iron Point Circle, Suite 100, Folsom CA 95630, for Integrated Development And Support Services (IDASS). The extension to bridge contract (HSFLGL-13-J-00191) is necessary to bridge the gap from the expiration of the first bridge contract period that expires on April 30, 2013, and award of the follow-on IDASS contract currently being solicited under HSFLGL-13-Q-00060. The period of performance for the one month extension of the bridge contract is May 1, 2013 through May 31, 2013.

(2) Nature and/or description of the action being approved. FLETC proposes to execute a contract modification to extend the Integrated Development and Support Services (IDASS) support for a month by means of other than full and open competition. This contract extension is necessary to continue to bridge the gap between the previous contract (HSFLGL-11-J-00008), and award of the follow-on contract currently being solicited under HSFLGL-13-Q-00060. The scope of the contract includes the same services currently being provided under the existing bridge contract without deviation.

(3) Description of Supplies/Services. The Contractor shall furnish all personnel, supervision, management, office equipment, materials, transportation and supplies required to provide Integrated Development and Support Services (IDASS) at FLETC, Glynco GA. Integrated Development and Support Services include development, maintenance, monitoring and revision of application and database developed solutions, as well as, the Operations and Maintenance (O&M) support for applications (i.e., FLETC Internet Systems [FIS – Web Development], FLETC Collaboration System (FCS)/Microsoft SharePoint Server Services (MOSS), SQL Server and Oracle Databases, Microsoft Access, FoxPro and other associated underlying technologies. The contract modification is estimated in the amount of 81,905.60.

(4) Identification of Statutory Authority Permitting Other than Full and Open Competition. The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements”.

(5) Demonstration that the Nature of the Acquisition Requires use of the Authority Cited.

The current contract, HSFLGL-11-J-00008, was awarded as a Firm-Fixed Price (FFP) for a base and one option year, with an option to extend services a maximum of six additional months under FAR Clause 52.217-8, Option to Extend Services. To date, the maximum thirty (30) months allowable under the option to extend services have been exercised. A one month contract was executed to complete the acquisition process, but it has been determined that additional time is required to complete the acquisition and the additional month is necessary to bridge the gap between the bridge contract and execution of the follow on contract. This is necessary to ensure the continuity of support services for critical FLETC information technology systems, which are essential to the support of the FLETC law enforcement training mission. Failure to maintain the continuity of services at the same quality and technical skill level currently being provided may result in serious injury, financial, or other, to the Government. Training activities, which are necessary to properly train the law enforcement officers utilizing these information technology support services, will come to a virtual standstill should this action not be approved. Examples of the supported systems include: FLETC Accounting and Budgeting System (FABS), FLETC Collaboration System (FCS), FLETC Internet System (FIS). The incumbent contractor possesses the expertise and management capabilities necessary to provide the critical support services in order to handle the daily contract requirements.

(6) Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential Sources as is Practicable. It has been determined by the Contracting Officer that it would be in the Government’s best interest and most practical to procure this action through the incumbent contractor, as Visionary Integration Professionals, LLC has the requisite staffing and corporate knowledge within its ranks to mitigate the concerns effectively and efficiently without a break in these critical support services.

(7) Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. The Contracting Officer has reviewed the current pricing schedule, which was competitively established by DHS EAGLE IDIQ and determined to be fair and reasonable, and will utilize the historical information contained therein as a benchmark for price analysis of this action. The Contractor has confirmed to hold the current pricing structure for the duration of the modification.

(8) Description of the Market Research. Market research was not conducted.

(9) Any Other Facts supporting the use of other than Full and Open Competition. No other facts available.

(10) A Listing of the Sources, if Any, That Expressed, in Writing, an Interest in the Acquisition. None.

(11) A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required. The Government is in the process of completing a competitive action and does not anticipate continuing services longer the additional one month extension.

(12) Contracting Officer’s Certification. I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
