Limited Sources Justification FAR 8.405-6 For orders or BPAs exceeding the Simplified Acquisition Threshold

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Agency and Contracting Activity. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited-Sources Justification.”

The Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA) Office of Chief Procurement Operations (OCPO) proposes to award an order pursuant to FAR 8.405-6(a), Limiting-Sources.

2. Nature and/or description of the action being approved. Describe the action being approved, and include the name and address of the proposed contractor(s).

As part of its Grants Management Modernization: Business Systems Integration and Governance and Management Assessment (B-SIGMA) program, FEMA seeks a fixed-price Task Order with the following contractor to provide innovative approaches to Organizational and Business Transformation across the FEMA Grants Domain including a rapid approach to delivering technology that dramatically improves the customer experience and organization efficiencies.

Pivotal Lab via Federal Supply Schedules:

GSA Schedule # GS-35F-0119Y, FSC IT70

CARAHSOFT TECHNOLOGY CORPORATION

1860 Michael Faraday Drive ,Suite 100

RESTON ,VA 20190

3. Description of Supplies/Services. Describe the supplies or services to be acquired. Provide the estimated total value (including options, if any).

A multiple disciplinary taskforce, leveraging current/historical efforts, will rapidly conduct a Business Systems Integration and Governance and Management Assessment (B-SIGMA) using user-centered, business-driven approach (e.g. value streaming, visual engineering, lean six sigma, pairing, and agile) to Organizational and Business Transformation.

This effort will provide a framework including metrics, value streams, business processes, and automation goals for the FEMA Grants Domain, including disaster and non-disaster activities, to conduct a more efficient and effective way of doing business. This effort will also support the FEMA Enterprise Technology Program Management Office (PMO) and the Grants Management http://uscode.house.gov/

LSJ - B-SIGMA - 2 -

Modernization (GMM) PMO with the strategic, operational, and technical design of the target platform.

To maximize reusability and minimize cost, the effort must use automated tools and platforms, in compliance with DHS/FEMA policies and requirements, to assess the FEMA Grants Domain ecosystem and re-design the target platform. The technical approach should also address transition planning and prioritization of the necessary key project across FEMA Headquarters and Regional/Field Offices.

The estimated total cost estimated including the base and Option Period is $9,500,000.00

4. Authority and supporting rationale. Cite authority, supporting rationale, and demonstrate the proposed contractor’s unique qualifications to provide the required supply, including the particular brand name, product, or feature essential to meeting the Government’s requirements, and document the results of market research which indicates other companies’ similar product or products lack the particular feature, do not meet, or cannot be modified to meet the agency’s needs.

FEMA intends to procure through the Multiple Award Schedule Program under the authority of 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies. The procurement is limited to one source. Only one source is capable of providing the services required at the level of quality required because the services are unique and highly specialized (FAR 8.405-6(a)(1)(i)(B)) to accomplish complex organization and business transformation linking to rapid iterative delivery of capabilities using technology. FEMA’s diverse grants business and performance architecture requires a specialized and government proven rapid iterative approach with heavy focus on automation and efficiencies that the Pivotal Lab services provides. The use of other services or multiple vendors would not be able to blend the rapid iterative approach to assessment and transformation in cost effective way. The results of the market research clearly indicate that the methodology, approach, and past performance from Pivotal Lab has several unique features and functions not presently available in the marketplace in a single service.

This service is an item peculiar to one firm, Pivotal Lab, and will allow FEMA to use an innovative approach to organization and business transformation including how technology is delivered. The Pivotal methodology and approach to transformation and design allows rapid assessment and delivery of capabilities not provided in traditional services. This approach will allow FEMA to improve the business processes across the FEMA grants domain using a rapid iterative approach. The contractor Carahsoft is the only re-seller of Pivotal Lab services on the Federal Supply Schedules.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

http://uscode.house.gov/

LSJ - B-SIGMA - 3 -

Services offered on the schedule are priced either at hourly rates, or at a fixed price for performance of a specific task. GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. The Contracting Officer will evaluate the quote considering the level of effort and the mix of labor proposed to determine that the total price is reasonable and represents the best value to be consistent with FAR 8.404(d).

Contracting Officer will seek additional discounts before placing an order

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

FEMA conducted market research on conducting traditional business process reengineering services, which has indicated that similar services lack the particular feature(s) required and do not meet, or cannot be modified to meet, the needs of FEMA to provide organizational and business transformation using rapid iterative approach.

7. Any other facts supporting the justification. Additional facts may be stated in this section. If there are no additional facts, you must state that here.

N/A

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made.

Procuring an alternate product based on salient characteristics other than those of Pivotal Lab could cause increased costs by having to select multiple vendors to cover the capabilities of one company.

9. DHS/FEMA intends to post this justification on FedBizOpps pursuant to FAR 8.405- 6(a)(2)(i).

10. Technical/Requirements Personnel Certification.

Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.

Technical Representative/COR Date
