JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
UNDER 10 U.S.C. 2304(c)(2)
Unusual and Compelling Urgency
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.302-2, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
1. Agency and Contracting Activity.
The United States Coast Guard, Surface Force Logistics Center (SFLC), Icebreaker, Buoy and Construction Tender Product Line (IBCTPL), proposes to enter into a contract on the basis of other than full and open competition.
2. Nature and/or description of the action being approved:
This requirement is for the unplanned dockside of the USCGC JUNIPER to repair the cutter back to operational status. Solicitation and award of a Firm Fixed Price contract, using other than full and open competitive procedures, for the contractor to provide a portable hydraulic power unit with at least a 3 micron filtration unit to perform a flush of the hydraulic system and all deck equipment on JUNIPER. During a recent equipment discrepancy, it was discovered that the Forward HPU hydraulic oil is contaminated with water. The inoperability of the Forward HPU greatly hinders the ability to perform operations. The Forward HPU must be repaired in order to allow CGC JUNIPER to meet her operational commitments.
3. Description of Supplies or Services:
Contractor shall provide all necessary labor, material, services, equipment, supplies, power, accessories, and such other things as are necessary, except as otherwise specified to perform this unplanned dockside availability. The contractor is required to provide a portable hydraulic power unit with at least a 3 micron filtration unit to perform a flush of the hydraulic system and all deck equipment on JUNIPER. Due to the complex nature of the Forward HPU, the services of a the portable hydraulic power unit is required to assist with proper repair methods, and ensure the contaminated hydraulic oil is removed from both PORT and STBD reservoirs and sub sequential deck equipment.

4. Identification of the Statutory Authority Permitting Other Than Full and Open Competition:
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(2) implemented by the Federal Acquisition Regulation (FAR) 6.302-2 entitled “Unusual and compelling urgency that the Government would be seriously injured unless agency is permited to limit the number of souces from which it solicits bids or proposals, full and open competition need not be provided for.”
5. Demonstration that the Nature of the Acquisition Requires Use of the Authority Cited:
CGC JUNIPER has sustained a class NON MISSION CAPABLE DISCREP. CGC JUNIPER is restricted from performing scheduled deployments. The CGC JUNIPER is at home moorage in

Newport, RI and is inoperable due to the inoperability of the Forward HPU. It has been determined that repair of the Forward HPU will restore JUNIPER to full mission capability.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable
Proposed Contract Action is being made under FAR 6.302-2 – Unusual and compelling urgency.
To ensure that as many potential sources as practicable under the circumstances are received, the requirement will be posted as a combined synopsis/solicitation on FBO.
7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable:
A price analysis will be performed to ensure a fair and reasonable price is negotiated in accordance with FAR 15.404. We will compare proposed prices with historical prices and with prices of similar repairs performed on other vessels that are most similar to the WLBs.
8. Description of market research:
Previous history for this type of work have been performed by drydock and dockside vendors as well as specialized hydraulic companies to include:

9. Any other facts supporting the use of other than full and open competition:
This requirement is of such an unusual and compelling urgency that it is paramount that is be solicited and awarded immediately. Currently there are no alternate cutters that can perform the mission of USCGC JUNIPER. Many of the cutters in this region, including USCGC ABBIE BURGESS, USCGC KATHERINE WALKER, USCGC IDA LEWIS, and USCGC WILLOW are currently scheduled for maintenance periods or have suffered from casualties. It is imperative to get the USCGC JUNIPER back to an operation status to ensure that support in the region of the East Coast will not go lacking. There is a cost to readiness that is not easily quantified. It is tracked by seeing the number of days the ship is not available for any operation.
10. Agency Actions to Remove or Overcome Competition Barriers on Subsequent Acquisition(s) for the Supplies or Services:
In order to remove or overcome competition barriers on subsequent acquisitions for this supply.
Service, it is recommended that the Government maintain a database of known vendors who are capable of performing this type of hydraulic repair.
