NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests.

Under this informal process the agency is not required to suspend contract award performance.

Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program.

Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. Services Required/Place of Performance/Schedule:

1. The contractor shall provide AIR TRAFFIC CONTROLLER TOWER SERVICES at the U.S.

Performance Work Statement (PWS) for Air Traffic Controller Tower Services at

U.S. Coast Guard Air Station Elizabeth City, NC

1.0 INTRODUCTION

The Coast Guard Shore Infrastructure logistics Center (SILC) is procuring Air Traffic Control Tower Services for the U.S. Coast Guard Air Station / Regional Airport Elizabeth City, NC. The Performance Work Statement (PWS) is in coherence with the direction in which the Coast Guard is procuring contracts to ensure consistent performance and be result-oriented. The contractor shall provide these services as set forth in the PWS. The PWS establishes the administrative requirements, standard procedures for handling specific situations, and other specific requirements for the performance of duties. The government reserves the right to modify the PWS periodically to reflect changes in the Government’s air traffic control tower services, policies and procedures.

2.0 BACKGROUND

2.1 Mission: The mission of the Coast Guard Air Station Elizabeth City is to provide a safe, orderly, and expeditious movement of air traffic within the region of Elizabeth City. The CG Air Station is seeking a contractor to manage, operate, staff and provide other items or services (except as stated herein) necessary to perform air traffic control tower services. To accomplish this mission, it is essential that the air station have qualified air traffic control tower services as required.

2.2. Hours of Operation: Services shall be provided daily from 0700 hours through 2200 hours, seven days per week, Sunday through Saturday, unless specifically stated otherwise in the PWS. The Air Station is manned 24/7, therefore, site access is available 24 hours a day / 7 days a week. Average movements per month are 6000. Traffic patterns are 1500 feet for fixed-wing aircraft at mean sea level and 1000 feet for rotor aircraft.

This includes staffing an additional air traffic controller during peak training hours, Monday- Friday 0900-1700, excluding federal holidays and holiday periods such as Thanksgiving weekend and the period between Christmas Day and New Years Day.

2.3. The Coast Guard Air Station Elizabeth City, NC currently has five (5) HC-130J airplanes and four (4) HH-60T helicopters assigned to the station which utilize the Air Traffic Control Tower (ATCT) on a daily basis. The ATCT also provides services to the general aviation public located along with the Coast Guard at the airport. Being a military air field, ATCT also provides transient services for a number of different military aircraft for practice approaches and touch and go pattern work.

3.0 SCOPE

3.1. Requirements Summary:

The Contractor shall provide all personnel, supervision, labor, materials, required equipment, supplies, services and other items as described herein. The service requirements and performance objectives relate directly to mission essential items as identified in the PWS, the Contractor’s Quality Control Plan (QCP) and the Government Monitoring Functions providing for the highest level of service delivery performance critical to mission success. The contractor shall use the PWS, as well as the approved QCP to accomplish the functions/tasks generated for this effort as identified in Paragraph 5, Technical Requirements, of the PWS.

3.2. After-hour Services. The Contractor shall provide after hours ATCT services to accommodate special/emergency operations. The services for these special/emergency operations will be obtained by negotiations with the issuance of a modification. Examples of some but not all situations that may require after-hour services would be in support of hurricane operations or major search and rescue cases.

4.0 APPLICABLE DOCUMENTS

4.1. The Contractor shall comply with all applicable federal, state, local and municipal laws, regulations and requirements; all industry standards/references; and, all Government and Coast Guard Regulations, attachments and exhibits listed in the table below applicable to the performance of the contract and to contractor personnel. The contractor shall instruct and guide its employees regarding any directives provided by the Coast Guard.

4.2. The Government will provide all publications listed upon request. Supplements or amendments to listed publications may be issued during the life of the contract. The Contractor shall immediately implement those changes, which result in a decrease, or no change in the contract price. Upon completion of the contract, the Contractor shall return to the Government all issued publications and any unused forms.

5.0 TECHNICAL REQUIREMENTS

5.1. The Contractor shall ensure the safe, orderly, and expeditious movement of air traffic in compliance with all procedures outlined in the documents, directives, and regulations listed in Section 4.0.

5.2. Weather Services. The Contractor shall provide weather observations and reports from 0700 hours through 2200 hours, seven days a week in a manner consistent with the applicable facility designation, presently Limited Aviation Weather Reporting Stations (LAWRS). All Controllers working in the tower shall be LAWRS certified. The Contractor shall maintain historical weather observation forms as required by the National Weather Service (NWS).

5.3. Other Services. The Contractor shall perform activities, such as visual check of runway lights to prepare the Coast Guard Control Tower for opening and closing on each day of operation. These preparatory and closing activities are considered integral to the required ATCT services and take 15-30 minutes to perform.

5.3.1. Site Specific Responsibilities. The Contractor shall provide services for the Coast Guard Air Station Elizabeth City as follows:

a. Report known airport/facility deficiencies to the Contracting Officer’s Representative (COR) or the Airfield Manager in the absence of the COR or Contracting Officer.

b. Maintain an appropriate stock of FAA/NWS/Locally developed forms.

c. Maintain an appropriate stock of weather observation equipment/charts/supplies.

d. Maintain a current airport diagram.

e. Maintain a current local obstruction information library.

f. Manage noise abatement procedures by notifying/reminding aircraft of noise sensitive areas.

g. Fully support all special military operations. Special military operations are short periods of higher than normal intensity of air traffic. Tower involvement includes normal controller support of air operations.

h. Receive, coordinate, and disseminate tethered balloon operation information.

i. Receive and report information related to Navigational Aid failure to the FAA.

j. Issue, receive, and disseminate NOTAMS as required for safety or as specifically directed by the COR or Airfield Manager. Computer access will be made available to controllers and managers pending the results of federal contractor background investigations. The Coast Guard Operations Duty Officer (ODO) will be available 24/7 and will be able to assist the controller in the event that they cannot access a computer.

k. Coordinate the use of pyrotechnic practice areas so as not to interfere with air traffic.

Practice areas are used approximately five times a year.

l. Conduct tower familiarization tours. Tours are coordinated by the Air Station Public Affairs Officer. There are 1-2 tours per month for approximately 10 minutes each. Groups are as large as 60 school children rotating five at a time through the tower.

m. Report watercraft emergencies on the Pasquotank River to the Air Station Operations Duty Officer.

n. Comply with the Air Station’s Emergency Plans including Field Crash Plan.

o. Ensure tower is adequately staffed to the standards set forth in FAA order 1380.55.

5.4. Accident/Incident Reporting. The Contractor shall report accidents/incidents and collect applicable data in accordance with FAA Order 8020.16, Aircraft Accident and Incident Notification, Investigation, and Reporting. The Contractor shall provide a copy of all reports to the COR and Airfield Manager.

5.5. Operational Data. The Contractor shall document operational data and maintenance of records, such as daily/monthly traffic count data and operational position sign-on/off information in compliance with the provisions of the appropriate FAA directives in Section 4.0 of the PWS.

5.6. Agreements. The Contractor is authorized to enter into Letters of Agreement (LOA), Letters of Procedure (LOP), etc, with FAA facilities and/or National Airspace System (NAS) users in accordance with FAA directives in Section 4. The Contractor shall ensure that the COR and the Airfield Manager has a current copy of all internal directives regarding the provision of ATC services and all external documents to which the Coast Guard ATCT is a signatory, such as LOA’s and contingency plans.

5.7. Training. The Contractor shall provide training for all equipment provided by them. After initial phase-in, the Contractor shall provide any new contract personnel with training on government provided equipment. The training shall be conducted by facility-rated contract personnel.

5.8. Inspection Scheduling. The Contractor shall schedule facility rating certifications, Control Tower Operator (CTO) testing; in conjunction with the FAA, and facility re-designation inspections and observer certifications through the National Weather Service Office (NWS), located in Wakefield, Virginia. The Contractor shall have testing and certification completed before start of contract award.

5.9. Corrective Action. The Contractor will be immediately notified, upon inspection or evaluation by the FAA or CG, if the ATCT is found to be operating in a manner which does not ensure the safe, orderly, and expeditious movement of air traffic in the Class D airspace under its jurisdiction. The Contractor shall take immediate action to correct any condition which has an adverse effect on the provision of ATCT services.

5.10. Provision of Information. The Contractor shall provide information responses to requests from the CG and FAA, such as data for aeronautical studies, operational statistics, etc.

5.11. Contingency Plan. The Contractor shall develop and maintain a detailed operational contingency plan to deal with FAA/NFCT emergency operations, and procedures for coping with the effects of a national emergency or major disaster.

5.12. Transition Plan. The incoming contractor shall develop a transition plan, which thoroughly outlines the transition from the out-going contractor. The plan shall, at a minimum include time requirements, overlap of contractor employees, accomplishment of Government provided on-the-job training, and a transition plan for use during any subsequent transition.

5.13. Document Review and Approval. The Contractor shall submit to the Contracting Officer for approval any contractor-initiated changes to the contractor’s operational directives, contingency plan, facility training program, quality assurance program, transition plan, drug testing program, and alcohol misuse prevention program.

5.14. Notification of Interruption of ATCT Services. The Contractor shall immediately notify the Contracting Officer, the COR, and the Airfield Manager, when ATCT services will be interrupted for any reason. The Contractor shall provide notification as soon as a potential interruption is

The contractor shall coordinate directly with the Air Station operations center if the Contracting Officer, COR or the Airfield Manager are not immediately available or when circumstances preclude notification; e.g., emergencies, physical or equipment problems, etc.

This notification in no way relieves the contractor from the requirement to provide ATCT services.

5.15. Government Furnished Property and Services:

5.15.1. General: The Government will provide a designated area, without cost to the contractor, space suitable for the provision of Air Traffic Controller services, administration, and storage of operational supplies, equipment and records. The contractor will be responsible for the maintaining of this area to be kept in a clean and organized manner.

5.15.2. Responsibility for Facilities. The Contractor shall assume responsibility for the facility and take adequate precautions to prevent fire hazards. At contract completion all facilities shall be returned to the Government in the same condition as received, subject to fair wear and tear.

The contractor shall repair at its own cost any damage caused by employee negligence or abuse. The contractor shall perform housekeeping duties to keep all work areas clean and neat, including tower windows.

5.15.3. Equipment. The Government will make available to the contractor the use of all equipment located at the ATCT. Not later than five days prior to the contract start date, the contractor and the COR shall conduct a joint survey and verify the working order and condition of the equipment. The government will repair or replace missing or inoperable items. The Coast Guard will provide, one time, on-the-job training for new, different, or modified equipment made available to the Contractor.

5.15.4. Maintenance. The Contractor shall initiate a trouble call, via the COR, when problems develop with government equipment. The Contractor shall provide the necessary coordination and assistance to Coast Guard personnel to accomplish routine and corrective maintenance during hours of operation. The Contractor shall not modify any government equipment without prior approval of the COR.

5.15.5. Digital Voice Logger (DVL). The Contractor will be required to change the CD-Rom in the DVL throughout the contract. The DVL will be maintained by the Air Station’s Electronic Support Detachment (ESD).

5.15.6. Operational Documents. The COR will provide a copy of the Elizabeth City Organizational Manual and other local Coast Guard directives upon award. Changes will be provided as necessary.

5.15.7. Evaluations. The FAA will conduct full-facility, follow-up, and in-flight/preflight evaluations at the ATCT in accordance with FAA Order 7010.1.

5.16. Government-Furnished Property:

5.16.1. General: Except for those items specifically stated as Government-furnished property, the contractor shall furnish everything else required for the performance of this contract including, but not limited to, the following:

a. All office equipment, including photo copier, as necessary to complete all assigned tasks.

b. Maintain a minimum of one commercial, public access telephone line.

c. Administrative and operational supplies such as forms, publications, charts, expendable weather observation materials, paper, writing implements, photo copying materials, and rest room supplies.

5.17. Contractor Occupied Spaces. The Contractor is responsible for the security of all facilities, materials and equipment made available by the Government. The Contractor shall admit government security and fire protection personnel, and medical personnel if appropriate, for purposes of security, fire safety or sanitary inspections. The Contractor shall correct any security, fire, safety or sanitary hazards at no cost to the government unless caused by the Government with no contractor fault.

5.17.1. The employees on duty in the tower are prohibited from the installation or use of personal equipment such as: televisions, radios, portable electronic devices, cellular telephones, etc. Use of such equipment is deemed to jeopardize the safety of operations at the Air Station and may be grounds to require removal of employee from operating in the CG tower.

5.17.2. It is the responsibility of the contractor to ensure the tower facility and equipment is clean, neat and sanitary. The Government will not provide janitorial services or supplies for the tower facility; however, the contractor may use Government dumpsters.

5.18. Specific Security Requirements. The Contractor shall:

a. Maintain an access control roster of designated personnel assigned to the tower,

b. Maintain positive control of the tower cab,

c. Escort all visitors,

d. Limit visitor access to normal daylight operational hours,

e. Maintain a visitor’s log,

f. Restrict tower access during hours of darkness to employees, airport authorities, and Federal, State, and local government personnel on official business, RFP# HSCG84-12-R-AA5414 13 of 64

g. Secure the facility by locking all entry and exit points when unattended.

h. Maintain key control and accountability.

i. Maintain an up to date inventory of all items provided by the Government for review during security inspections.

j. For each contractor employee shall carry an identification card furnished by the USCG.

5.19. Security Inspections. All ATCT physical security safeguards, operating procedures, access, and visitor control shall be subject to security inspection by CG personnel and FAA Special Agents. Written notification of such inspections shall be coordinated by the COR.

However, unannounced inspections may be conducted at the discretion of the CG or FAA when determined to be in the best interests of the CG. Presentation of official FAA or CG Special Agent credentials shall be considered authority for entry, agent identification, and authorization to conduct inspections under provisions of this contract, GAA orders, or in the interest of national security. All security deficiencies noted during inspections shall be corrected by the contractor within 45 days of an inspection. A letter outlining corrective actions shall be submitted to the CG and the servicing Security Element of the FAA.

5.20. Installation Security Requirements. The Contractor shall provide such physical security at the ATCT as is necessary to preclude unauthorized access, intrusion, and loss of or damage to Government property, operations capability or reduction of required service.

5.21. Fire, Police and Emergency Contact Numbers: The COR will provide the numbers for the base rescue services to the contractor upon award.

5.22. Facility Training Program. The Contractor shall establish, document and implement a facility training program for operational controllers. On-the-job instruction shall be conducted by facility rated contract personnel. The training program shall be administered in a uniform and standardized manner, reviewed and updated at least annually, and is subject to FAA and CG evaluations in accordance with FAA Order 7010.1. Elizabeth City Coast Guard Control Tower initial facility rating process is approximately 30 days. This rating process may be slightly quicker or longer, depending on the amount of traffic available at the site and the experience level of the controller.

5.22.1. Training Program Requirements. The facility training program shall incorporate the following elements:

a. Federal Aviation Regulations, Part 91, General Operating and Flight Rules, and Part 93, Special Air Traffic Rules and Airport Traffic Patterns.

b. FAA Order 7220.1, Certification and Rating Procedures Handbook.

c. Applicable paragraphs of FAA Terminal Instruction Program Guide (IPG), TP-12-0-1.

d. FAA Order 3120.4, Air Traffic Control Training, including refresher, proficiency, and remedial training. The program shall include: FAA National Air Traffic Training Program Terminal Proficiency/Refresher Units, such as operations, runway incursion avoidance, anticipated and departure separation; all required briefing items of national and regional concern (including GENOT, RENOT, SIGMET, etc.); and other required ATCT items as determined by regional Air Traffic division personnel.

e. The Contractor shall maintain an FAA Form 3120-1, Training and Proficiency Record, for all operational controllers.

f. The Contractor shall require managers or controllers decertified due to an operational error and to be re-certified in accordance with FAA Order 7210.56, Air Traffic Quality Assurance.

g. Controllers suspended from performing ATC duties for other than decertification due to an operational error shall be re-certified in accordance with FAA Order 3120.4.

h. The Contractor shall provide training for contractor furnished equipment. The Contractor shall provide contract personnel with training on equipment made available by the government following initial FAA Training.

5.22.2. Drug Testing Program. The Contractor shall establish and maintain a drug free workplace and drug testing program in accordance with policies and directives stated in the FAA’s ―Anti-drug Program for Personnel Engaged in specified Aviation Activities‖ in 14 CFR Part 121, Appendix I and all amendments thereto.

5.22.3. Alcohol Misuse Prevention Program. The Contactor shall establish and maintain a program in accordance with the FAA’s ―Alcohol Misuse Prevention Program‖ published in 14 CFR Part 121, Appendix J and all amendments thereto.

7.0 PERSONNEL REQUIREMENTS/QUALIFICATIONS

7.1. General

The contractor shall manage the total work effort associated with the services required to assure fully adequate and timely completion of these services. Such management includes, but is not limited to, planning, scheduling, training, report preparation, establishing and maintaining records and quality control. The contractor shall provide staff with the necessary management expertise to assure the performance of the required work; and, trained and experienced personnel who meet established standards to effectively perform the services required and who exhibit capability to perform with minimum supervision. The contractor shall submit copies of the employee’s certifications proposed to operate the air traffic control tower and any other necessary personnel documentation, staffing lists and schedules. Removal or dismissal of employees, who are not fully able to perform the normally assigned duties or violate any security or health requirement, does not relieve the contractor of the requirement to provide sufficient personnel to adequately perform services required. The contractor shall provide contingencies for employees who are absent during their regular work hours; and, shall have in place a suitable replacement for the absentee employee within two hours of initial notification by the COR. Any stoppage of service can be detrimental to the safety of terminal aircraft and may delay a launch to rescue a life at sea.

7.2. Personnel Requirements

7.2.1. Management. The Contractor shall provide a Resume for the Tower Manager and Alternate Tower Manager. The Tower Manager must have a solid understanding for FAA rules and regulations and the skills to train others to those standards. The Tower Manager must have, at a minimum, ten years experience as an Aviation/Air Operations Manager demonstrating administrative and supervisory duties where he/she possessed excellent prioritization, people and coordination skills in a fast-paced environment with continuous change. The Tower Manager must possess a college associates degree, or equivalent.

The Alternate tower manager shall possess the same qualifications as the tower manager, except the required experience is five years, and the required education is a high school diploma.

The Tower Manager shall be responsible for the performance of all tower Air Traffic Controllers and shall have the full authority to act for the contractor on all contractual matters relating to the daily operation of the Air Traffic Control Tower. The Alternate Tower Manager is the acting manager when the Tower Manager is absent, and therefore, not performing ATC duties during this time. The name of the Tower Manager and Alternate Tower Manager shall be designated in writing to the Contracting Officer with copies to the COR.

The Tower Manager position is a fulltime on-site position. The Tower Manager shall work a standard work week of Monday-Friday, 0800-1600, excluding Federal Holidays. These work hours may be altered on a case-by-case basis. Changes to the work schedule must be approved by the Coast Guard and are usually granted to facilitate "after hours" airfield management meetings. During the standard workday, the Tower Manager shall not act as a solo Air Traffic Controller. The Tower Manager will be responsible for ensuring that the tower is in full compliance with the requirements set forth in this PWS, particularly all requirements under section 5.3.1. As the FAA subject matter expert, the Tower Manager must be available to address all contract and FAA related issues such as, but not limited to, coordination of airfield operations, maintenance operations, rescheduling operations, regulations and procedures, with the Airfield Manager or COR at all times. All ATC personnel issues will be handled by the Tower Manager. This includes, but is not limited to, scheduling, training, resolving personnel conflicts.

7.2.2. Air Traffic Controller (ATC) Qualifications. All ATC’s (Also referred to as Controllers) and Managers shall be Federal Aviation Administration (FAA) certified (i.e. CTO/Medical certificate, etc.) and meet the current qualifications stipulated in Federal Aviation Regulations, Part 65 Subpart B (excluding paragraph 65.46).

7.3. Security: The Contractor shall comply with all facility security requirements, security regulations and directives as identified herein and other security requirements cited elsewhere in the contract. Contractor vehicles or Personally Owned Vehicles (POV) require valid registration and inspection certificates, motor vehicle operator license and insurance documentation for access to USCG Base Support Unit; and, shall be subject to such checks as may be deemed necessary to insure that no violations occur. All contractor personnel shall follow any instructions given by the COR, Base Command Duty Officer (BCDO) and security personnel in case of fire, hurricane or any other emergencies.

7.4. Identification/Uniform: The USCG shall provide all employees, including managers, with ID badges, with the full name of the employee. Badges are to be worn at all times while working on the Coast Guard Base. Clothing not to be worn: tube tops, tank tops, shorts, leotards, sandals, or other inappropriate clothing as determined by the Contracting Officer’s Representative (COR). The contractor shall ensure that each employee or representative of the Contractor shall present a clean and professional appearance.

7.5. Language Requirement: The contractor or qualified representative on site must be able to read, write, speak, and understand English. They must be able to fulfill, completely and clearly, the reporting requirements of the contract.

7.6. Conduct of Personnel: The contractor shall require their employees to comply with the instructions pertaining to conduct, safety and health regulations forming a part of this contract.

The contractor shall prohibit his/her employees from disturbing papers on desk, opening drawers, closets or cabinets, or using the telephone or equipment unless specifically authorized by the COR. Contractor personnel shall not smoke in the tower. Each contractor employee is

RFP# HSCG84-12-R-AA5414 18 of 64 expected to adhere to standards of conduct that reflect credit on themselves, their employer, the U.S. Coast Guard, and the Federal Government. The Government reserves the right to direct the contractor to remove an employee from the work site for failure to comply with the standards of conduct. To maintain continuity of services, the contractor shall initiate immediate action to replace such an employee, at no additional cost to the Government.

7.7. Employee Training / Operation of Equipment: The contractor shall ensure that each employee used in the performance of this contract is adequately trained and instructed to safely and competently perform the work. Training shall be scheduled within 10 days of each quarter.

7.8. Alcohol and Controlled Substances. Contract employees shall not possess, distribute, consume, use or cause to be used any controlled substance or alcohol on the job site within Government property. Any employee using a controlled substance prescribed by a physician shall get written permission from the Contracting Officer to continue performance of assigned duties for this contract. Any contractor or contractor employee found to be in violation of this section will be permanently prohibited from the Coast Guard property. Actions taken under this section shall not relieve the contractor of the requirement to provide sufficient personnel to perform adequate and timely service as required in this contract.

8.0 CONTRACTOR QUALITY CONTROL (QC) REQUIREMENTS

8.1. In this contract the quality control program is the driver for product quality. The contractor is required to develop a comprehensive program of inspections and monitoring actions. The first major step to ensuring a "self-correcting" contract is to ensure that the quality control program approved at the beginning of the contract provides the measures needed to lead the contractor to success. Once the quality control program is approved, careful application of the process and standards presented in the remainder of this document will ensure a robust quality assurance program.

8.2. Contractor QC Plan (QCP): The FAA Office of Air Traffic Service, Evaluations Division (AAT-100) is charged with evaluating the air traffic operational and administrative functions at all levels within the FAA, including contract towers. The Contractor shall maintain a QC Plan delineating the contractor’s QC program/inspection system to monitor and control their performance of services so that they meet the contract requirements (see Paragraph 6.0). The program/inspection system shall establish and explain in detail how the contractor shall sustain the quality of providing the services required. The QC Plan must assure that the requirements of the contract will be met. The COR will approve any changes to the QCP prior to the contractor implementing them. If the COR perceives such changes to be other than minor, approval by the Contracting Officer is necessary.

8.3. QC Program/Inspection System. The FAA Office of Air Traffic System Effectiveness and the COR will evaluate the operational and administrative functions of the ATCT. The Contractor shall provide a written response regarding corrective actions for any problems identified as a result of a full-facility, follow-up, or in-flight/pre-flight evaluation and implement procedures to

RFP# HSCG84-12-R-AA5414 19 of 64 identify, prevent, and ensure non-recurrence of defective services. FAA Order 7010.1 contains a dynamic checklist utilized for evaluating Airport Traffic Control Towers (ATCT) which is modified as changes are made to national directives and/or policies.

The QC system shall encompass all functions of the contract. It must specify areas to be inspected on either a scheduled basis or unscheduled basis and list the title(s) of the individual(s) conducting the inspection. The QC program/Inspection System shall be designed to keep the Contractor's management and the Coast Guard informed of all issues affecting quality to include timely and effective corrective actions. The QC records shall, in part, consist of checklists of inspections and shall indicate the nature, frequency and number of observations made the number and type of deficiencies found, and the nature of corrective action taken as appropriate.
