JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Monaco Fire Alarm Transmitter Part of PROJECT P/N 4300990 Pursuant to the requirements of FAR PART 6, this justification for other than full and open competition is supported by the following facts and rationale in the format described at FAR 6.303-2:
(1) Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”
The United States Coast Guard Civil Engineering Unit (CEU), Cleveland, OH, hereby provides the Justification for Other than Full and Open Competition (JOTFOC) for review and approval. Commanding Officer, 1240 East 9th Street, Room 2179, Cleveland, OH 44199-2006 is the contracting activity. Justification for Other Than Full and Open Competition, pursuant to FAR 6.302-1.
(2) Nature and/or description of the action being approved.
This Justification for Other Than Full and Open Competition has a need for a brand name item acquisition, for a firm-fixed price contract for the acquisition of a Monaco fire alarm/mass notification transmitter.
(3) A description of the supplies required to meet the agency’s needs (include the estimated value) This Justification for Other Than Full and Open Competition is to procure a Monaco fire alarm/mass notification transmitter. This requirement is part of the overall maintenance and repair of the US Coast Guard Air Station Detroit Maintenance Hangar. The new fire alarm components must be compatible with the Monaco receiving station already installed at Selfridge Air National Guard Base (ANGB).
(4) Statutory Authority.
Statutory authority is pursuant to 10 USC 2304 (c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements".
(5) Demonstration that the nature of the Acquisition requires use of the authority cited.
There is reasonable basis to conclude that the government’s needs, can only be satisfied by the unique supply available from only one source with unique capabilities. At this time only one vendor, Monaco, can supply the required components as a single source for the fire alarm transmitter to maintain proper system functionality. Components must be compatible with the existing Monaco fire alarm receiving station at Selfridge ANGB.
(6) Efforts made to ensure that offers are solicited from as many potential sources as is practicable.
Other sources that supply fire alarm systems components are available but can‘t provide the same proprietary equipment compatibility associated with Monaco equipment. Based on research Monaco has proprietary patents/copyrights developed by Monaco and licensed directly to the end user. Monaco retains exclusive ownership of these components and does not license third parties to alter or add to the software or equipment. System design has been performed by a Monaco design engineer to ensure seamless integration with the existing Monaco receiving station. This assumption is a result of extensive market research and the discovery that these parts are under a US Patent and not sold commercially except through limited sources.
(7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Award shall be based on an agreement by both the contractor and the Government of a fair and reasonable price for this project.
(8) Description of the Market Research The Monaco BT-XM transmitter was selected because they it is compatible with the existing ANGB signal receiving station. A review was conducted of other manufacturer’s product literature, which did not indicate compatibility with the Monaco receiving station.
(9) Any other fact supporting the use of other than full and open competition, i.e., proprietary data packages, etc.
The installation of a different or incompatible system would impact the following areas as described:
This fire alarm system is designed with known components that will function together as a system. Other manufactures products at this time have not proven that their products will function as a system with the existing fire alarm receiving station. The base system (receiver) at Selfridge ANG is a Monaco system. The Monaco system is a proprietary system and no other system is compatible with it. Installation of non-compatible components could cause potential loss of life and/or property due to undetected fires.
(10) A listing of the sources, if any, that expressed in writing, an interest in the acquisition.

(11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
