JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

In accordance with 10 U.S.C. 2304(c)(l)

Solicitation No. HSCG82-1 96 Pier Electrical Distribution at U.S. Coast Guard CST Paris Landing, TN

CEIJMIA Project Number — 5705746

Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

I. Agency and Contracting Activity - U.S. Coast Guard, Shore Infrastructure Logistics Center -

Construction, Civil Engineering Unit Miami, proposes to use a brand name description within a competitive construction acquisition.

2. Nature and/or description of the action being approved - The USCG has CSTO (Configuration Standard Technical Order) requirements for a Brand Name description to provide and install electrical power supply receptacles and telecommunications copper and fiber receptacles at the ships-service shore tie cabinets.

• Configuration Standard Technical Order Electrical Shore Ties SILC-CSTO-36

• Configuration Standard Technical Order C4&IT Shore Tie 64-CSTO-M2000.3D

This justification is covering only the portion of the acquisition which is Brand —Name or peculiar to one manufacture, and the approval level requirements will then only apply to that portion.

3. Description of Supplies/Services - The supply /parts to be provided are as follows:

ltem-l: Pin & Sleeve Telephone Receptacle: Part “A”: Multi-Circuit Receptacle SKWR12XG (Russelistoll). Part “B”: 45 degree angle adapter 3678a (Russellstoll), Reference drawing M172l- D sheet E-l7.

Item-2: 200A 480V three-phase safety interlocked receptacle with DS24O4FR000 (Russelistoll) receptacle. Reference drawing M2057-DF sheets E-l and E-5.

4. Identification of Statutory Authority Permitting Other Than Full and Open Competition - The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”.

5. Demonstration That the Nature of the Acquisition Require Use of the Authority Cited -

A Single standardized connection for telecommunication shore ties is required for all Coast Guard vessels such that any CG vessel that ties up to any CG pier can have telecommunications connectivity. Otherwise these vessels could not have telecommunications connectivity in ports other than their own. Unlike telecommunications outlets and jacks rated for indoor use. there is no IEEEE.

TIA. EIA. ANSI. or MIL-SPEC that specifies requirement for interconnect ability among

Page 1 of3 manufactures for outdoor rated connections. Therefore, in order to provide consistency between CG ports and vessels, one manufacture has to he used. CSTO C4IT specifies the RusseliStoll SKVRl2XG shore tie receptacle for fiber optic connections. Using other configurations from other manufactures would impact the Coast Guard operations by restricting where and how vessels connect to port services.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. A notice for the main construction contract will be publicized on FedBizOpps. along with the solicitation.

7. Detennination by the Contracting Officer that the Anticipated Cost to the Government will he Fair and Reasonable. - The contracting officer determines that the anticipated price(s) will be fair and reasonable based on the competition of the main contract.

8. Description of Market Research. Market Research is required by FAR Part 10. The internet was searched for a list of manufactures that could provide the equipment or compatible parts that would work with the existing telecommunication shore ties. The market research showed that oniy Russellstofl and Delphi could provide the required pails and supply and there are no other distributors hut the manufacturer.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition - Use of the Brand Name description in the portion of this acquisition is essential to the Government’s requirement, thereby precluding consideration of a product manufactured by company.

10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the Acquisition —

Interest on the main construction contract was received from contractors as response to the Pre Solicitation

11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required - The USCG is replacing telecommunications system consisting of ship-service. Only Russelistoll and Delphi can provide the supply and parts. The Coast Guard is reviewing the requirement of the vessels as a whole.

12. Contracting Officer’s Certification. I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
