NOTICE FOR FILING AGENCY PROTESTS
It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the Coast Guard as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.
Informal forum with the Ombudsman. Interested parties who believe that a Coast Guard procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the Coast Guard Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103(d)(2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). GENERAL INSTRUCTIONS TO OFFERORS
Each Offeror shall submit their proposal, as outlined in this Phase One Solicitation, Section 4, "Proposal Content and Format Instructions". Proposals may be mailed or hand carried to the address noted below.
Offers must be delivered to the Contracting Officer, at the designated location, no later than the date and time specified in the Solicitation. All Proposals shall be submitted in original; no facsimile Proposals will be accepted.
The complete Federal Acquisition Regulation is available through the U.S. Government Printing Office or via Internet access at or http://www.arnet.gov/far/.
The USCG Point of Contact for inquiries and clarifications is Anita Repanich, Contracting Officer. Each Offeror must designate one point of contact for all communications between the Offeror and USCG. No other communications regarding this Solicitation or project are allowed. Communications that occur between any other individual on an Offeror’s team, including consultants and subcontractors, and any other USCG staff member may be grounds for disqualification of the Offeror’s Proposal.

The U.S. Coast Guard (USCG) intends to award a firm-fixed-price Design-Build Contract for the design and construction a new office building at USCG Cleveland Harbor Moorings in Cleveland, Ohio. This solicitation is issued pursuant to the Federal Acquisition Regulation (FAR) Two-Phase Design-Build Selection Procedures (FAR Subpart 36.300). For this contract award process, USCG will issue two Solicitations in sequence: 1) Phase One, and 2) Phase Two. The Phase One procedure is to determine which Offerors demonstrate the highest qualifications to successfully deliver the facility. All responsible sources may submit a Phase One Proposal; a maximum of five (5) design-build entities (hereafter referred to as “Offerors”) who are found to demonstrate the highest qualifications will be selected to participate in Phase Two. The USCG is hereby requesting Phase One Qualification Proposals. This Phase One Solicitation provides Offerors with instructions regarding the submission of their complete Proposals and the evaluation thereof. Utilizing the format prescribed within, Offerors are to provide the requested information and demonstrate their capabilities. Responses shall be as complete and accurate as possible and present data relative to the specific project under consideration. Offerors shall make every effort to present information clearly and concisely in accordance with the formats described herein.
1. Background Information and Project Description The purpose of this Phase One Solicitation is to solicit Proposals from Offerors for evaluation by the USCG to determine which Offerors demonstrate the highest qualifications to successfully deliver the project. The contractor will be responsible for completing the final architectural-engineering design of the buildings and associated interior furnishings and exterior site work. See the attached Summary of Work for the full project description. In accordance with FAR 36.204, the estimated price range of this project is between $10,000,000 and $25,000,000. Interested Offerors must be a firm or joint venture with experience, individually or as a member of a team, successfully and satisfactorily completing a project of similar size and scope (not necessarily design-build experience). The design of the architectural and engineering features of the project shall be accomplished or signed and stamped by architects and engineers registered to practice in their particular field within the State of Ohio. Offerors, individually or as a team, must have the capacity to obtain performance and payment bonding for 100% (per each bond) of the firm-fixed-price Design-Build Contract. An Offeror's proposed Phase One team, or firms and key personnel proposed in response to this Phase One Solicitation, must remain fixed for the duration of the Contract and Warranty Period unless a change is submitted in writing to the Contracting Officer (KO), whom, at his or her sole discretion, provides written authorization of the change. Unauthorized changes to the Offeror's team at anytime during the two-phase selection process can result in the elimination of the Offeror from further consideration. During Phase Two, an Offeror may add consultants, subcontractors and/or key personnel to supplement design and/or construction resources that the Offeror feels are necessary to meet the needs of the project and the terms and conditions of the contract. Participation by small-disadvantaged, HUBZone, small woman-owned, small veteran-owned, and small service-disabled veteran-owned businesses is also encouraged. All responsible sources that submit a correct, complete, and responsive proposal will be considered.

Award of the Contract for this project is anticipated to take place in September 2010. Construction completion and final acceptance is expected to occur within 24 months after Award.
3. Evaluation Factors Proposals submitted, in accordance with this Solicitation, will be evaluated using the four (4) Phase One evaluation factors listed below in descending order of importance:

4. Proposal Content and Format Instructions
1. Utilizing the format prescribed below, Offerors are to provide the requested information in a brief and succinct manner making every effort to present information clearly and concisely. Offerors should address the requirements of the project consistent with the evaluation criteria described in this Solicitation. Lengthy narratives containing extraneous information are discouraged. All information shall be submitted in English. Proposals that do not follow the format below, or otherwise include documentation that is difficult to read may be rejected, may result in Phase One disqualification or a lower Phase One evaluation rating. Proposals shall be submitted in the following format. Pages shall be 8-1/2 x 11 inch white paper. Single sided pages shall be used. Proposal text shall be in a standard font, a minimum of ten (10) points or a maximum of twelve (12) points in height, single-spaced. The entire Proposal including the enclosed Past Performance Questionnaires must be submitted on white paper. Proposal submissions must include one (1) original that is bound and four (4) copies that are bound. The external cover of each Proposal (original and copies) shall clearly identify the Offeror’s name, clearly be labeled “Proposal for Phase One Solicitation, HSCG50-10-R-PFDCH2,” and clearly state the time and date for the receipt of Proposals. Each copy shall be identified on its cover as “Copy __ of 4 Copies.” The information provided in the Proposal shall be easily reproducible by normal black and white photocopying machines. All signatures on all documents, originals and copies, must be original signatures in ink and in a color other than black. Completion of the Past Performance Questionnaires must be in accordance with the instructions provided below in the Past Performance Section II of the proposal. You may submit your past performance on the questionnaire provided OR you may submit previous questionnaires from other Government agencies if they adequately address the questions contained on the questionnaire included with this RFP.
Information must be current and accurate for the firm or joint venture including all proposed key consultants/associates and subcontractors for the specific office(s) identified which will have responsibility for performing the work. All Phase One Proposal development costs shall be borne by the Offerors without reimbursement from the USCG.
Phase One Proposals shall be submitted in the following format:
a. Section I - Cover Letter: Provide a one-page letter on the Offeror’s letterhead identifying a single point of contact, address, phone and fax numbers, and e-mail addresses (if any) where USCG inquiries or notices should be directed. An authorized representative of the Offeror organization shall sign the letter. If the Offeror is not yet a legal entity or is a joint venture, all major participants or joint venture members shall sign the letter. Provide a statement declaring the Offeror’s intent, if selected to participate in Phase Two, to enter into a Contract with USCG to deliver the project in the event the Offeror is ultimately selected for award. (limit 1 page)
b. Section II – Technical Factors: Provide four simple lettered/numbered (tabbed) dividers for each factor. (limit 20 pages total for tabs 2,3 and 4) Tab 1. Past Performance
Past Performance Information: Offerors are to submit a complete list of their currently in progress and most recent contracts (within the past seven years) which are of similar size and complexity and representative of the Offerors’ capability and indicative of the Offerors’ ability to successfully perform this project. Offerors are directed to the Attachment(s) where they will find a referenced Past Performance Questionnaire and cover instructions. The Offeror shall send the Past Performance Questionnaire and cover instructions to at least five references from the list and ask them to provide the Contracting Officer a completed questionnaire before the date and time for receipt of proposals. Provide the following information regarding each Owner/Project for which a Questionnaire and cover instructions were forwarded:
| (a) | Name of Owner/Agent; |
| (b) | Point of contact including name, title, and current address, telephone number, fax number, and e-mail (if available); |
| (c) | The date and method(s) of transmittal of the Questionnaire and cover instructions (and the information in (b) above if it was sent to a person other than the point of contact above); and |
| (d) | Any other additional information that would assist USCG in making contact with the Owner/Agent. |
The listing of projects shall include the following information in the following order:
i. Project Name, description and location;
ii. A description of the project scope of work and the firm’s responsibilities;
iii. An identification of the other significant entities (subcontractors, teaming partners, etc.) working with the firm including a description of their services and their portion of the overall contract value;
iv. Owner’s address, phone number and fax number;
v. Owner project manager’s name, address, phone number, fax number, & email address (if available);
vi. Point of contact (if different from (b) or v. above), name, address, phone number, fax number, & email address (if available);
vii. Project dates (award date, notice to proceed date, start of design (if applicable), start of construction, scheduled completion and actual completion dates for both design and construction);
viii. Awarded contract price and final contract price; and
ix. An explanation regarding the circumstances and causes of all significant modifications, changes, delays or controversies encountered on the project;
x. The Offeror is also encouraged to provide any other information that is relevant to the evaluation of the Offeror’s past performance.
It is the responsibility of the respective Offerors to arrange for submission to the Contracting Officer of the completed Past Performance Questionnaires. They may be faxed or mailed separately or may be provided with your proposal. As part of the evaluation process, USCG reserves the right to contact the designated point of contact or other personnel relative to the designated projects. USCG may also elect to obtain additional information relative to the Offerors’ past performance (including, but not limited to, the past performance of team members, predecessor organizations, subcontractors and key personnel) for the referenced projects and/or for projects in addition to those identified in the Proposal. Past performance will be evaluated pursuant to the approach set out in this section.
The purpose of the Past Performance evaluation is to qualitatively assess the Offerors’ ability to perform the contract successfully. In evaluating Past Performance, the USCG shall consider the currency and relevance of the information as well as the source. USCG shall also consider the context of the data and the general trends in the contractor’s performance. Offerors who have no relevant experience will receive a neutral rating for past performance. USCG will give due consideration to: the completed Questionnaires; USCG’s communications with designated points of contact; the Offeror’s information provided in the Offeror’s Proposal relative to past performance; records generated and provided (if any) pursuant to FAR 42.15; and any other relevant past performance information that may be available to USCG. The Source Selection Authority shall determine the relevance of all similar past performance information.
As permitted in FAR Section 15.305(a)(2)(iii), Offerors can provide past performance information relative to predecessor companies, key personnel (who, for example, may have relevant experience via their former employment, etc.) and for subcontractors who will play a major or critical role. In the event an Offeror provides this type of information in lieu of projects that the Offeror company (or its team members performed) performed, the Offeror should comply (to the extent possible) with the instructions above.

Capability to Perform Size and capability of the Offeror and proposed team including consultants and subcontractors, as may be illustrated by: actual or proposed organization; available key personnel by discipline; design/construction production systems; financial stability and capability; specialized equipment available for this work; special approaches or concepts developed by the team relevant to this type of project; and, design-build, design and construction volume over the past five (5) years as well as current workload.
TAB 3. Specialized Experience and Technical Competence
(1) Offeror’s firm and other firm team member’s relevant experience, including proposed consulting firms and subcontracting firms. Specialized experience, technical competence and professional qualifications as may be illustrated by: experience with design-build projects of comparable size and complexity; previous experience as a team; any awards or recognition received by a firm for similar work; demonstrated knowledge of the general project locality, of applicable code and permitting requirements, and of local construction market conditions and trade practices; and, a clear description of the role and responsibilities of each for the project and experience listed. Describe at least 3 design-build projects of comparable size and complexity that the team members have worked on in the last 7 years.
(2) Individuals’ relevant experience, including proposed key personnel of the Offeror, consultants and subcontractors. Specialized experience, technical competence and professional qualifications as may be illustrated by: experience with design-build projects of comparable size and complexity; history of employment with participant; previous experience with other proposed key personnel; any awards or recognition received by individuals for similar work; demonstrated knowledge of the project locality including applicable code and permitting requirements, construction market conditions, and trade practices; and, a clear description of the role and responsibilities of each key personnel for the project and experience listed.

Technical Approach Offeror’s general approach for dealing with projects of this size, complexity and schedule, including the roles and responsibilities of proposed team members and their key personnel as may be illustrated by: general project management systems including consultant/subcontractor administration; estimating and scheduling systems; cost, schedule and quality control for both design and construction activities; general methodologies for avoiding delays and minimizing claims; and the use of technology for any of the above.
c. Section III - Other Data: Any other information the Offeror feels may be beneficial to presenting its qualifications. Any company brochures provided shall be included as Section III. Section III, however, shall not exceed 15 pages.
5. Proposal Due Date For consideration on this project, Offerors must respond to the Phase One Solicitation by submitting their Proposal by June 14, 2010 2:00pm Seattle local time. Proposals must be MAILED or DELIVERED to Anita Repanich, Contracting Officer, U.S. Coast Guard, FD&CC DET, 915 Second Ave., Room 2664, Seattle, WA 98174-1000. Offerors are responsible for effecting delivery. The Point of contact for inquiries and clarifications is the Contracting Officer, who can be reached at (206) 220-7426 and fax (206) 220-7390. To the extent prospective Offerors have questions regarding this Solicitation, they are to be submitted in writing to the Contracting Officer on or before June 4, 2010, 4:00pm Seattle local time. At USCG’s discretion, USCG may provide written responses to the questions as appropriate. Any such responses will be provided via an Amendment to the Phase One Solicitation which will be issued solely via the FedBizOpps website. Prospective Offerors are responsible for checking FedBizOpps for amendments up to the date and time for receipt of offers.
6. Information regarding Site Visit/Preproposal Conference:
A site visit has been scheduled for 10:00 am (EST) on 25 May 2010. Please fax or email names of attendees to the Contracting Officer no later than 21 May 2010. The location of the visit is USCG Cleveland Moorings, 1055 E. 9th Street, Cleveland OH 44114. Attendees must bring a valid ID to be presented to the gate guard. Inform the gate guard you will be attending the “USCG New Building Meeting”. Further directions will be provided by the guard at that time. Parking on the base can be limited depending on base activities. If spaces are filled, there are several city lots within less than 5 minute walking distance to the USCG Base. Plan on approximately 1 hour for the conference.
7. Notification of Phase One Qualification and Selection Upon completion of the Phase One evaluation and selection process, a maximum of five (5) Offerors deemed to be most highly qualified shall be invited to submit Proposals in response to the Phase Two Solicitation. However, USCG reserves its right to select less than five (5) Offerors for Phase Two. Those Offerors selected to participate in Phase Two will receive a Phase Two Solicitation after their selection. Unsuccessful Phase One Offerors will receive notice of their non-selection at the same time. Phase Two Proposals will not be accepted from Offerors that are not invited to submit a Proposal.
8. Summary of the Phase Two Solicitation Process The five (5) most highly qualified Offerors selected in Phase One will be provided the opportunity to submit competitive technical and price Proposals as detailed in the Phase Two Solicitation. All Phase Two Proposal development costs shall be borne by the Offerors without reimbursement from the USCG. Phase Two shall be conducted in accordance with FAR Part 15 (Contracting by Negotiation); one Contract will be awarded using competitive negotiation. The Evaluation Factors to be used in Phase Two are listed below. All non-price evaluation factors when combined, are approximately equal to price. The evaluation factors are as follows:

5. Quality Assurance and Quality Control 6 Price
The basis for award for Phase Two shall be, consistent with the evaluation factors above, the selection of the Offeror whose overall proposal is deemed to be the most advantageous to the Government. As Proposals become more equal in their technical merit (the non-price evaluation factors), the evaluated cost or price becomes more important and may become the determining factor for Award. In order to be eligible for award, Offeror organizations must legally exist prior to Contract Award.
