Procurement of Enhanced Digital Electronic Control Units Solicitation Number: HSCG38-17-Q-J00166
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:
(1) Agency and Contracting Activity.
The Department of Homeland Security (DHS), U.S. Coast Guard (USCG), Aviation Logistics Center (ALC), Medium Range Recovery (MRR) Product Line Division (MH-60T), Elizabeth City, NC, proposes to enter into a purchase order on a basis of Other Than Full and Open Competition.
(2) Nature and/or description of the action being approved.
As the Aviation Inventory Control Point, ALC is required to provide effective supply support for all USCG Aviation Units and for Program Depot Maintenance (PDM) support. The Justification for Other Than Full and Open Competition seeks approval to issue a firm-fixed price purchase order on a sole source basis to Triumph Engine Control System (Triumph), the Original Equipment Manufacturer (OEM) for the procurement of the Enhanced Digital Electronic Control Units (EDECUs) that is installed on the MH-60T aircraft T700 engines. The total estimated value for this requirement is . The proposed contractor is:

(4) Identification of the justification and the rationale.
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1) as implemented by FAR 6.302-1 entitled “Only One Responsible Source and No Other Supplies Will Satisfy Agency Requirements.”
(5) Demonstration that the nature of the acquisition requires use of the authority cited.
The specifications, manufacturing drawings, data, test equipment, and tooling required for the manufacture of the EDECUs are proprietary to the OEM, Triumph. The USCG did not purchase rights to

No other part numbers can be utilized. No acceptable alternate vendors have been identified.
(6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable.
A FedBizOps post will be publicized, as required by FAR 5.2, the intent is to issue a combine synopsis/solicitation through the FBO website, www.fbo.gov, upon approval of this document. However, market research reveals that only Triumph the OEM owns all proprietary rights.
(7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable.
The Contracting Officer anticipates prices ultimately negotiated for this requirement will be fair and reasonable based on a price analysis comparison with historical prices paid, IGCE, and the current market price.
(8) Description of market research.
The EDECUs were manufacture as a joint venture with General Electric and Goodrich Pump and Engine Control Systems, Inc. (which is now known as Triumph) to replace the former Digital Electronic Control Unit (DECU) on the USCG MH-60T aircraft engine. The EDECUs offer enhanced safety and performance over the old DECU.
Market research has been conducted in accordance with FAR Part 10. Based upon the proprietary nature of the manufacturing data, it has been determined that Triumph is the OEM and is the only certified source that can supply the EDECUs used on the MH-60T aircraft, T700 engine.
(9) Any other facts supporting the use of other than full and open competition.
The MH-60T aircraft including its engines were procured and provisioned by USCG Headquarters;
however, this procurement did not include the technical data packages, specifications, and documentation necessary to enable full and open competition, therefore, it would be difficult to take steps to foster competition as the manufacturing performance and acceptance data are proprietary and the USCG does not have adequate technical data to provide to potential offerors.
(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
Triumph is the only approved NAVSUP WSS approved source.
(11) A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for required supplies or services.
Every effort will be made to overcome the barriers to competition. If alternate sources are approved, future requirements will be competed among all approved sources.
