Justification for Other than Full and Open Competition Under 10 U.S.C. 2304 (c) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

HSCG38-16-Q-900054

Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

(1) Agency and Contracting Activity. The United States Coast Guard (USCG), Aviation Logistics Center (ALC), Elizabeth City, NC hereby proposes to enter into a contract on a basis of other than full and open competition.

(2) Nature and/or description of the action being approved. Approval is requested to renew on a sole source basis the license for the use of the Ingres Database Management software from Actian Corporation. ALC desires to continue contracting with Actian Corporation, 500 Arguello Street, Redwood City, CA 94063 for continued support of software licensing and maintenance. The contract order will be issued on a firm fixed-price basis. .

(3) Description of Supplies/Services. This action is to renew the Actian Database Management software licenses used for Asset Logistics Management Information System (ALMIS) and to receive maintenance and technical support for its use.

(4) Identification of Statutory Authority Permitting Other Than Full and Open Competition The statutory authority permitting other than full and open competition is 10 USC 2304(c)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 (a)(2)(ii)(A) entitled “only one responsible source, and no other type of supplies or services will satisfy agency requirements.”

(5) Demonstration That the Nature of the Acquisition Require Use of the Authority Cited. The USCG currently utilizes ALMIS to maintain its aviation and surface supply inventories, accounting/fiscal data, and the Electronic Asset Logbook (EAL). ALMIS was created using Ingres Database Management software. The license to use Ingres must be renewed on an annual basis. Actian Corporation is the proprietary owner of Ingres and is the only provider of the licenses and related maintenance. If the Ingres licenses are not renewed, ALMIS would not be legally allowed to operate. Actian Corporation may elect to pursue legal action against the USCG if operation is continued without the proper licenses. There are other database management software applications available, but using any of those other database management software applications would be a duplication of an existing system and would create a break in service. Current software capabilities took over 19 years to produce and perfect and there is a planned commercial off the shelf (COTS) replacement under development. It would not be feasible to replace the core database component prior to the deployment of the COTS product Coast Guard-Logistics Information Management System (CG-LIMS), which will be configured and customized by ALC developers. Changing to a similar database would involve an estimated 10 developers for a 2 year period with a rough cost estimate of $2.7 million in addition to the cost of software licensing.

(6) Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. A Notice of Intent will be posted on the Federal Business Opportunities with the statement that all responsible sources may submit a capability statement which shall be considered by the Agency.

(7) Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. The Contracting Officer determines the anticipated prices will be fair and reasonable based on historical pricing previously determined fair and reasonable and comparison to similar items.

(8) Description of Market Research. Actian Corporation controls the development of Ingres and makes certified binaries available for download, as well as providing worldwide support. Additional inquiries were performed on Internet search engines and there are no other vendors who support the Ingres database other than Actian Corporation. Actian Corporation has provided confirmation that they are the only source of supply for operational support of the Ingres Database Management software.

(9) Any Other Facts Supporting the Use of Other Than Full and Open Competition. There are no other distributors for this requirement as stated by the software developer.

(10) A Listing of the Sources, if Any, That Expressed, in Writing, an Interest in the Acquisition. None: If the FBO posting reveals any potential sources they will be considered.

(11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for required supplies or services. In support of competition, ALC conducts market research annually as this requirement is identified to ensure we are using the software that is in the best interests of the U.S. Coast Guard. This is accomplished by attending various trade/IT shows, monitoring market trends and research on the internet.

(12) Contracting Officer’s Certification Statement: I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.

Mr. Gary WoolardDate
Contracting Officer

(13) Technical/Requirements Personnel Certification: I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.

Ms. Angela Mizelle-Griffin Date Technical Representative

(14) Legal Service Command Review: I have reviewed this justification and deemed it legally sufficient.
