TERMS AND CONDITIONS

HSCG38-16-Q-200115

Federal Acquisition Regulation (FAR) and Homeland Security Acquisition Regulation (HSAR) Clauses and Provisions The clauses and provisions contained herein are applicable to any order awarded as a result of this solicitation. The terms and conditions set forth herein supersede all other terms and conditions. Acceptance of the order in accordance with FAR 13.004 constitutes acceptance of all terms and conditions contained herein.

The following clauses and provisions are included:

52.212-1 Instructions to Offerors - Commercial Items Oct 2015

Service Contract Labor Standards The Service Contract Labor Standards will apply to any contracts awarded through this solicitation unless the contractor certifies that all elements found in Federal Acquisition Regulation (FAR) 52.222-52 will be met. The Contracting Officer has determined one possible places of performance and has included a Wage Determination as an attachment to this solicitation. Wage determinations for additional possible places of performance will be provided if asked to do so in writing at isaac.l.brothers@uscg.mil. Offerors must request additional wage determinations no later than 2 days before solicitation closes. Offerors who intend to perform in a place or area of performance for which a wage determination has not been attached or requested may nevertheless submit quotations. However, a wage determination shall be requested and incorporated in the resultant contract retroactive to the date of contract award, and there shall be no adjustment in the contract price.

Evaluation Criteria The provision at Federal Acquisition Regulation (FAR) 52.212-2 Evaluation of Commercial Items is not applicable to this solicitation. In lieu of this provision, quotes will be evaluated in accordance with Federal Acquisition Regulation (FAR) 13.106-2 based on the criteria listed below. Award will be made to the lowest priced, technically acceptable offeror with acceptable or neutral past performance representing the best value to the Government.

Technical Acceptability: Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. This will be determined by evaluating the ability of the offeror to provide a sound, compliant approach that meets all requirements listed in the Statement of Work (SOW) and demonstrates a thorough knowledge and understanding of the requirements. It is the contractor’s responsibility to ensure that their quotation clearly demonstrates their ability to perform these requirements.

All offerors must provide the following minimum information and documentation with their quotations:

· Ability of the offeror to meet the delivery requirements listed in the SOW.

· Detailed explanation of any requirement listed in the SOW that cannot be successfully accomplished by the offeror.

· FAA 145 Repair Station Certificate European Aviation Safety Agency (EASA), Department of Defense (DOD), Original Equipment Manufacturer (OEM), Industry Standard Certification (i.e., National Aerospace and Defense Contractors Accreditation Program (NADCAP)) and/or United States Coast Guard (USCG) certifications in accordance with (IAW) the SOW. Offerors that have completed work for the USCG in the past need only provide this information if it has changed or been updated since the last time work was performed.

· If the offeror is an OEM authorized repair facility, they must provide proof with their quote (such as a letter from the OEM) stating that the offeror is approved to complete the repairs. If the offeror does not have proof, then they must provide the additional information listed below.

Offerors, other than the OEM or a proven OEM-authorized repair facility, must also provide the following additional documentation. Failure to provide all of the documentation with the quotation may result in the quotation being eliminated from evaluation.

· Detailed explanation of the offeror’s ability to repair the Actuators. A simple statement of capabilities will not suffice. The offeror must address how they will accomplish the requirements of the SOW.

· Traceability to the OEM or OEM authorized distributers showing that the offeror will be able to obtain the parts necessary to repair components is required. The Offeror shall submit proof showing that they will be able to obtain all required consumable or replacement parts from either the OEM or OEM authorized distributor.

Price: The contractor shall provide pricing as requested in the attached spreadsheet titled “HSCG38-16-Q-200115 - Requirements”. Any quantity price discounts and discounts for prompt payment should be included in this section. The offeror’s quotation will be evaluated using one or more of the techniques defined in FAR 13.106-3, in order to determine if it is fair and reasonable.

Past Performance: Past Performance will be evaluated to assess the Government’s confidence in the offeror’s ability to fulfill the solicitation requirements. The evaluation will consider the offeror’s demonstrated record of performance in performing the required services and will consider areas of quality, meeting delivery schedules, compliance with contractual requirements and customer satisfaction. Relevant is defined as performing repair and overhauls on the same equipment as stated in this solicitation.

References are not required. The Government may use information available from the Past Performance Information Retrieval System (PPIRS) and the Contractor Performance Assessment Reporting System (CPARS), previous contracts/purchase orders with the USCG and any information found using Federal as well as state and local Government sources. An offeror must receive an Acceptable Confidence Rating to be considered for award. Offeror’s will be given the opportunity to address/comment on adverse past performance information that may result in an Unacceptable Confidence Rating.

Evaluation Method:

Only the lowest priced offer will be evaluated for Technical Acceptability. Should the lowest priced offer not receive an acceptable technical or past performance rating, the process will continue in order of lowest priced offer until the lowest priced, technically acceptable offer with acceptable or neutral past performance is identified.
