Solicitation HSCG38-11-R-H00003
NOTICE FOR FILING AGENCY PROTESTS
It is the policy of the Coast Guard to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accounting Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the Coast Guard as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.
Informal forum with the Ombudsman. Interested parties who believe that a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth at FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

Explanation of Contract Line Item Pricing Fixed price Contract Line Item Numbers (CLINs) *The CLIN numbers are shown as listed in the Base period and each Option period, respectively.
CLINs 1001, 2001, 3001, 4001 and 5001 for Logistic Support Services.
The Government anticipates a fixed monthly rate for performance of Logistic Support Services described in this PWS.
Base year and option period one’s pricing must take into account the current warranty provided by the vendor when calculating the Fixed Monthly Rate and not priced separately. All shipping costs for items going to and from the Contractor's designated depot facilities shall be borne by the Contractor. Shipping costs for items going to USCG facilities from USCG facilities will be paid by the Government. Pricing for the fixed monthly rate must include all USCG owned assets identified in Attachment C.
The USCG anticipates the issuance of one (1) yearly Task Order that will provide funding for logistic support services at the fixed monthly rate and the associated Incentive Fee. The contractor may invoice on a monthly basis for logistic support services rendered or for administrative convenience may invoice quarterly in conjunction with the incentive fee payment schedule in arrears.
CLINs 1002, 2002, 3002, 4002 and 5002 Incentive Fee.
Incentive Fee Payments will be made in accordance with the payment schedule set forth in this PWS. Earned Incentive Payments will be payable quarterly in arrears.
The following are Time and Material and/or Labor Hour CLINs in which the contractor must propose fully burdened fixed hourly labor rates. CLINs with set monetary ceilings may not be exceeded. The intent is to establish mutually agreed to hourly rates which will be used to issue task orders as needs arise. The aggregate value of task orders issued under time and material and/or labor hour CLINs may not exceed the CLINs ceiling amount(s).
CLINs 1003, 2003, 3003, 4003 and 5003 for full time on site Technical Representative.
This is a Labor Hour CLIN for a full time Technical Representative to be located on site at the Long Range Surveillance Product Line, Elizabeth City NC. 1.0 SCOPE
1.1 Logistic Support Services. The Logistic Support Services provided through this contract shall be designed to increase the availability of the Seaspray 7500E Radar for the U.S. Coast Guard (USCG) H-130H aircraft fleet. The contractor shall provide the full range of Logistic Support Services to support the Selex Seaspray 7500E Radar System. The contractor shall provide all facilities, tools, test benches, supervision of contractor personnel, and shall submit all data requirements specified herein. Logistic Support Services include inventory management of USCG owned assets, filling requisitions submitted by the USCG field units in Attachment A, performing repairs and/or modification to equipment, and providing technical and engineering support. The contractor shall maintain configuration control of all listed components. The contractor shall continually review the reliability of each component managed through this contract with the goal of reducing current Mean Time Between Failures (MTBF).
1.2 Performance Objective and Incentive Payments. The Top Level Performance Objective is to have Fully Mission Capable Seaspray 7500E Radar Systems. A fully mission capable radar system is directly tied to the system’s component availability. Component availability is directly tied to the availability of spares within the supply pipe line. If the spares are not available, it creates a void in the aircraft thus leading to down time of that radar system.
This requirement is for the contractor to provide the full range of Logistic Support Services to keep all Selex Seaspray 7500E Sea Search Radar Systems fully mission capable for all USCG mission aircraft. The USCG currently operates twenty-three (23) aircraft equipped with the Seaspray 7500E Sea Search Radar. Of the twenty-three (23) aircraft, the USCG anticipates flying nineteen operational aircraft during the base period and potentially reducing the fleet size to sixteen (16) operational aircraft during Option Period Three through Four. This is an estimate only and is subject to change based on the needs of the USCG. The USCG anticipates using between 15,200 flight hours per year based on nineteen (19) operational aircraft and 12,800 flight hours per year based on sixteen (16) operational aircraft flying over the life of the contract. Each operational aircraft is expected to fly 800 hours per year. Of the twenty-three (23) aircraft ,between four (4) and five (5) aircraft will be in programmed depot maintenance (PDM) at any given time.
Due to the complexity of the system and the limited number of spares, this contracts approach must be to measure the requisition fill time or backorder time to provide an incentive to perform. This approach ensures that the contractor takes every possible means to ensure that the components of the radar system are available to the customer, thus increasing component availability and ultimately ensure the system is fully mission capable.
The definition of an “operational aircraft” is an aircraft fully equipped with the Seaspray 7500E “A” Kit and “B” Kit components. Due to the limited number of “B” Kit spares, not all USCG HC-130H aircraft are capable of being equipped with the “B” Kit components. In every case, aircraft in the PDM cycle will have its “B” Kit components removed and placed back into the supply pipe line. This will increase the “B” Kit sparing levels and ensure that all operational aircraft are fully equipped with both “A” and “B” Kit components.
The number of “A” Kit components is considered adequate for the PWS’s objective, but due to the limited number of “B” kit sparing, the “B” kit will be used to establish the incentive payments.
The measurement (metrics) to be used to assess the Performance Objective is Requisition Fill Time for B Kit Material. Requisition Fill Time is the period of time from the initial demand on a B Kit Item ( the requisition being placed in AMMIS), to the time the demand is satisfied by the material being received at the Coast Guard Unit.
The requisition fill time requirement to include shipping is seventy-two (72) hours.
1.2.1 INCENTIVE: If the contractor fills every requisition for B Kit Material for that quarter within the required fill time, the contractor will receive 100% of the incentive. For each event that a requisition is not filled, the clock will start seventy-two (72) hours after receipt of a requisition. Once the order is filled, the clock will stop and that event will be closed. All events captured during the quarter will be cumulative and used to determine the final incentive payment. (See paragraph 1.3 titled Incentive Payments for the Quarterly Incentive Fee Payment Schedule).
As long as there is “B” Kit material available on the shelf, time being accumulated on repairs must not be included in the incentive calculations. Only requisition fill time for “B” Kit material is calculated.
1.2.2 “A” KIT MATERIAL. The following table identifies the “A” Kit material.

The Contractor must report the Requisition Fill Time(s) that have been captured and report this information to the COTR in the Monthly Report. Once a quarter, the contractor shall provide a compilation of the reports to the COTR and the cumulative requisition fill time hours must be reported to determine the incentive payment.
1.2.4 Requisition Fill Time. Requisition Fill Time will be used to determine contract performance incentive payments. The contractor must issue material based on the AMMIS requisition submitted from the operational USCG unit. The RFI asset is expected to be shipped no later than twenty-four (24) hours after receipt of an AMMIS requisition. The shipping method is at the discretion of the contractor. The requisition fill time will start accruing seventy-two (72) hours after the requisition is placed.
The shipping method used to satisfy requisition fill time items is at the discretion of the contractor; however shipping time is included in the total requisition fill time. The determination of requisition fill time status and total requisition fill time will be verified via the shipper’s tracking information.
Each requisition fill time must be tracked by the contractor for compliance with the shipping response times identified in Paragraph 6.6. The total cumulated requisition fill times must be tracked and provided to the USCG on a monthly basis and reported to USCG in the monthly report. Once a quarter, a compilation of the reports will be provided to the USCG and the cumulative requisition fill time hours must be reported to determine the incentive payment.
1.3 Incentive Payments. An incentive payment of $25,000.00 per quarter or $100,000.00 per year can be earned if 100% of deliveries are achieved within the seventy-two (72) hour response times. Requisition fill time(s) will be cumulative and the incentive paid quarterly based on Table 1.
Only requisition fill time for “B” Kit material is calculated.
