PROFESSIONAL, TECHNICAL, AND MANAGEMENT SUPPORT SERVICES FOR THE U.S. COAST GUARD OFFICE OF AUXILIARY AND BOATING SAFETY

STATEMENT OF WORK

1.0 GENERAL.

1.1 SCOPE.

The purpose of this contract is to obtain Contractor professional, technical, and management support. Examples of Contractor’s tasks include: services relating to the national survey development, nonprofit grants grading assessments, and other analysis as needed for the enhancement of the administration of the Boating Safety Program.

1.2 BACKGROUND.

The Office of Auxiliary and Boating Safety’s Boating Safety Division (CG-BSX-2) of the U.S. Coast Guard’s (USCG) Assistant Commandant for Prevention Policy (CG-5P) and its Inspections & Compliance Directorate (CG-5PC) requires Contractors assistance in the development of studies, reports and regulations, as necessary, to help achieve the goals listed in the CG-5P business plan.

The State Recreational Boating Safety grant program was first established by The Federal Boat Safety Act of 1971(FBSA). The State Recreational Boating Safety (RBS) Grant Program provides federal funding to assist the states in providing their essential boating safety services to the public. The RBS grant program was established to “encourage greater State participation and uniformity in boating safety efforts, and particularly to permit the States to assume the greater share of boating safety education, assistance, and enforcement activities” (46 USC§131). Funds for the Recreational Boating Safety program are derived from the fuel taxes boaters pay.

Each year a portion of the trust fund is allocated to support recreational boating safety activities throughout the United States, the District of Columbia and Territories from the Sport Fish Restoration and Boating Trust Fund (SFRBTF) under the Sport Fishing and Recreational Boating Safety Act of 2005 (Subtitle A, Title X, Public Law 109-59), to fund the National RBS Program. Each year the Program may allocate not more than 5% of the amounts available for allocation and distribution for national boating safety activities of national nonprofit public service organizations.

The Project Manager and all designated alternates shall be able to read, write, speak and understand English.

Removal does not relieve the Contractor of the responsibility to continue providing the services required under any contract awarded. The Contracting Officer will provide the Contractor with a written explanation to support any request to remove an employee.

1.3.6 Non-Personal Services

It is a matter of policy within the United States Government to rely on the private sector for needed commercial services. However, using Contractor support must be done in a way that does not interfere with the Government’s ability to effectively create Government policy, monitor Contractor performance, or maintain a competent and highly-skilled workforce. Information provided herein sets forth guidance stating the Government’s limitation on Contractors performing personal services and its’ restriction of Contractors performing inherently Governmental activities for Government requirements.

In accordance with Federal procurement policies and regulations, no personal services or inherently Governmental activities shall be performed under this Statement of Work (SOW). No Contractor employee will be directly supervised by a Government employee. All individual Contractor employee assignments, and daily work direction, shall be given by the applicable employee supervisor. If the Contractor believes any Government action or communication has been given that would create a personal services relationship and/or result in a Contractor performing inherently Governmental activities between the Government and any Contractor employee, the Contractor shall promptly notify the Contracting Officer of this communication, direction or action.

1.3.7 Conflict of Interest

The Contractor shall not employ any person who is an employee of the United States Government if that employment would, or would appear to cause a conflict of interest.
