The due date for receipt of proposals is extended to April 12, 2012.
INSTRUCTIONS TO OFFERORS, Page 1, para 3 and Page 4, para 1
If one projectile is going to be submitted for both the Standard Duty (SD) and Enhanced Performance (EP) offering does the DHS require 12,000 rounds of sample ammunition?

Separate test samples (6,000 rounds) must be submitted for testing of each ammunition type.

INSTRUCTIONS TO OFFERORS, Page 6 and Attachment 1, Page 12
On page 6 the Volume III heading states that this section applies to DHS Mentor-Protégé participants only while on page 7 the table at the bottom of the page indicates an SDB plan will be accepted for Volume III in lieu of an approved DHS Mentor-Protégé program. FAR 52.219-9 is also incorporated into this solicitation on page 12 of 18 and paragraph (g) of 52.219-9 notes that “A commercial plan is the preferred type of subcontracting plan for contractors supplying commercial items”. We respectfully request that a Government approved Commercial Subcontracting Plan be allowed for use in Volume III per paragraph (g) and (h) of FAR 52.219-9.
This section is to encourage participation in the DHS Mentor-Protégé program. A SDB plan will be accepted; however, it is not in lieu of an approved DHS Mentor-Protégé program. A commercial plan is acceptable; however, DHS goals will be used to measure a company’s SBD participation for this criteria.
STATEMENT OF WORK (EP and SD), Page 9, para 4.12.1
Will all weapons that this product is fired out of have a 1:7 twist rate?

The rifling twist on the Colt M4 and M4 CQBR is 1-7”. The rifling twist of the M4E is 1-8”.

STATEMENT OF WORK, Page 5, para 3.5.2
Item “h” references accuracy data should be supplied for both test barrel and firearms. There is no firearm accuracy requirement in the specification. Is this an error?

Only accuracy data for the test barrel is required to be submitted with the solicitation and FAT documentation.

STATEMENT OF WORK, Page 6, para 3.7.2
Must the bid submission samples exhibit a head stamp as required by 3.7.2 or is a commercial headstamp acceptable on the samples provided that product delivered on the first article sample going forward through the life of the contract does meet the requirement?

The requirement for the head stamp as specified by 3.7.2 will be waived for the solicitation test samples only. The offeror must submit a drawing detailing the design of the head stamp which would be incorporated into the product specification. Additionally, a written guarantee shall be submitted that the FAT sample submission will be head stamped in accordance with the design and must conform to the requirements specified by 3.7.2.

PRICE SCHEDULE

Attachment pages 1 - 5 There is a column for “Total Amount” but no estimated quantities shown to calculate a “total amount”. How should we calculate an amount to list in this column?

The estimated rounds identified in this solicitation under “Requirement” as well as the Statement of Work (SOW) should be used as the basis for calculating a total amount.

INSTRUCTIONS TO OFFERORS, Page 2 and 4
Please clarify how many copies of the Technical Proposal are required. The Combined Synopsis Solicitation Document, paragraph General Proposal Preparation Instructions, page 2 of 8 states “an original of Volumes I-IV and an electronic copy (CD) of the proposal shall be included with the qualification samples”. Paragraph Technical Performance Acceptability of the same Document, page 4 of 8 states “Offerors shall include a hard copy of their Volume I-Technical Proposal with the samples”. Do you require the original (and CD version) and well as an additional hard copy of the Technical Proposal with the samples?

One hard copy and one CD copy of the Technical Proposal are required with ammunition sample submission.

INSTRUCTIONS TO OFFERORS, Page 1 & Ordering Guide Page 2
The Combined Synopsis Solicitation Document, paragraph Minimum and Maximum Thresholds, page 1 of 8 states “in the event of multiple awards of both requirements are made, the contract maximum will be evenly divided amongst the awardees based on the type of ammunition provided”. However, Document Attachment 1, paragraph 7, Delivery Order Procedures, page 2 of 18 states “In the event that the Government makes multiple awards, delivery orders will be competed”. These two statements seem to be in conflict since competing each Delivery Order may not result in an evenly divided situation. What is DHS’s intent for the multiple awards scenario?

The language on page 1 of 8 under “Minimum and Maximum Thresholds” has been clarified as follows: “….The guaranteed minimum of any contract awarded is 10,000 rounds for each type of ammunition and is applicable to the base year only. The maximum threshold throughout the 5-year duration of the contract will be 165,000,000 rounds for SD and 10,000,000 rounds for EP.

Additionally, the language under Attachment 1 (Ordering Guide), page 2 of 18 has been clarified as follows: “In the event that the Government makes multiple awards, the Contracting Officer provide a fair opportunity to be considered issuing individual delivery orders exceeding $3,000 in accordance with FAR 16.505(b)

Would request an economic price adjustment clause included in the DHS ICE Solicitation Number: HSCEMS-12-R-00002. This being a 12 month review basis, due too extreme price swings on brass, primer and bullet prices. (Example www.lme.com brass extreme price swings) This would require from the vendor documented evidence of current component level costs, if the clause were requested by the vendor.

The government does not believe that offerors are unable to reasonably predict the stability in market prices for brass over the life of the contract to include FAR clause 52.216-4. The expectation is that offerors will make allowances in their bid submissions to account for the fluctuation in market prices. As such, economic price adjustments will not be allowed.

INSTRUCTIONS TO OFFERORS page 5
In the INSTRUCTIONS TO OFFERORS, “Evaluation Factors for Technical” Page 5 of 8 and STATEMENT OF WORK for both Enhanced Performance and Standard Duty Section 3.0 – Could the DHS please note what technical sub factors are “weighted more heavily than others” as well as how the weighting is applied and what evaluation factors are scored only on a pass/fail basis. Additionally, in the INSTRUCTIONS TO OFFERORS could the DHS define how points are awarded per the table on page 5 of 8 to each of the technical requirements in section 3.0 of the STATEMENT OF WORK for both the Enhanced Performance and the Standard Duty.
Offerors will be evaluated in the following areas: basic compliance, major requirements (velocity, accuracy, terminal ballistics, function), and minor requirements (visible muzzle plume, luminous ejecta). An overall rating will be assigned based on test results and basic requirement compliance as outlined in Table I of the SOW.
