Statement of Work Trash Removal / Garbage Collection Service (Sector-wide)

1. INTRODUCTION

U.S. Customs and Border Protection (CBP) – Office of Border Patrol (OBP) conducts daily operations at a variety of locations across the San Diego Sector. As a result of these sustained operations, CBP has a requirement for trash removal / garbage collection service to be procured from a commercially available source.

2. SCOPE

The Contractor shall provide all management, supervision, labor, transportation, supplies, and equipment (except as otherwise provided), and shall plan, schedule, coordinate and assure a clean, neat and professional appearance for employees servicing CBP locations.

The Contractor shall provide trash removal / garbage collection service in accordance with the requirements at Sections 3 and 4 of this SOW. Material changes in scope (i.e., additions/deletions of locations, bins, or frequencies) may be implemented by mutual agreement between the parties and through formal modification of the contract requirements.

3. GENERAL REQUIREMENTS

3.1 Trash removal / garbage collection shall be performed on/at U.S. Customs and Border Protection (CBP) properties, by location, as identified within Attachment B, Waste Removal Task and Frequency Chart.

3.2 Contractor agrees that Attachment B, Waste Removal Task and Frequency Chart, will act as the minimum performance requirements for trash removal / garbage collection with regards to frequency and days for which service will be rendered.

3.3 All trash/garbage, natural vegetation, and recyclables shall be removed from the locations to a disposal facility (i.e., incinerator, landfill, etc.) approved by EPA as being in conformance with existing Federal, State and Local Regulations.

3.4 The Contactor shall identify all vehicles used in the performance of the service with the name/logo of the company for vehicle identification of the vehicle.

3.5 Contractor shall place the requested disposal bins/dumpsters, of the agreed upon size, at agreed upon location for each CBP Facility outlined in Attachment B, Waste Removal Task and Frequency Chart.

3.6 Typical trash removal / garbage collection work will be performed within a 5 to 7 day week observed by the building occupants, unless changes are specifically approved by the Contracting Officer’s Representative (COR) or other Government Authorized Representative (GAR).

3.7 No work shall be performed when the government has no work force on duty and available for the inspection of the Contractor's work unless prior approval of the COR or other GAR is obtained.

3.8 Changes to scheduled service (due to Federal holiday or otherwise) shall be coordinated with the COR or GARs for the affected location(s). Contractor will reschedule pick-ups for the next available working day between 7:00 a.m. and 9:00 a.m., Monday through Friday (with the exception of Government holidays).

3.9 Names/numbers of CBP on-site POCs are located in Attachment B, Waste Removal Task and Frequency Chart.

3.10 Contractor shall be held accountable for any repairs to Government furnished property caused by negligence on the part of Contractor’s employee.

3.11 Contractor personnel shall be capable employees, trained and qualified in trash removal/ garbage collection service. Employee training shall include all applicable Occupational Safety and Health Act (OSHA) and other related standards.

3.12 No background checks are required for Contractor’s drivers to perform in accordance with the requirements of this document. Contractor is required to establish and maintain an active status in the System for Award Management (www.sam.gov) so as to remain eligible for follow-on requirements.

4. DESCRIPTION OF TASKS AND DELIVERABLES

Contract Service Guidelines for the Contractor are given below, including quality standards, but may be subject to change through mutual agreement of both parties. Any questions regarding these requirements should be directed to the COR or other GARs.

4.1 Trash Removal / Garbage Collection Procedures

4.1.1 Dates and times of servicing shall be coordinated between the Contractor and the GAR for each location. The Contractor will insure that pick-up services are performed so as to have little or no impact on the daily activities at the CBP facilities.

4.1.2 Contractor employees shall become familiar with and obey all location regulations, including fire, traffic, and security regulations.

4.1.3 Contractor personnel shall keep within the limits of the contract requirements and shall not enter any restricted areas unless required to do so and are cleared for such entry. The government reserves the right for security reasons to prohibit certain Contractor employees from entering onto CBP locations.

4.1.4 Contractor employees must have a valid picture ID when working at/on CBP locations and will be escorted at all times by Government personnel.

4.1.5 Security checks will be initiated each time contactor employees enter secured areas. It usually takes around 5 to 10 minutes per check depending on the traffic at the gates. Contractor employees may be required to log-in and log-out of some locations.

4.1.6 Contractor employees are expected to quickly perform duties when servicing trash bins/dumpsters and exit CBP location(s) without delay.

4.1.7 Contractor employees shall not separate and/or segregate trash at/on CBP locations.

4.1.8 Government-owned containers shall not be removed from the premises.

4.1.9 Contractor employees shall dispose of any overflow trash, debris, and litter that may become scattered as a result of emptying bins/dumpsters or as part of the transportation process.

4.1.10 Contractor shall clean and sanitize disposal bins/ dumpsters, at least one time per month, to ensure odors emitted from the units are minimized.

4.1.11 Contractor personnel will clean up fuel/hydraulic fluid leaks and/or spills caused by Contractor equipment while on Government property. All clean-up activities shall be in compliance with Federal EPA, state and local regulations.

4.2 Reporting Requirements

4.2.1 Contractor shall prepare and submit a Monthly Status Report concurrently with each invoice presented for payment (both the COR and the Contract Administrator copy).

4.2.2 The report shall cover the term for which the invoice is submitted and shall list by site, any significant events that occurred during the reporting period with respect to the accomplishment of the tasks, a summary of what work was accomplished, problems and resolutions (address problem areas, results obtained relating to previously identified problem areas, and recommendations involving impact on technical, price and scheduling).

6. CONTRACTOR FURNISHED ITEMS & EQUIPMENT

6.1 Permits and Licenses

6.1.1 Contractor shall obtain and maintain in effect all necessary equipment, permits, insurance, personnel, and supervision required by Federal, State or Local government, or subdivisions t hereof, or of any other duty constituted

6.1.2 Contractor and Contractor personnel shall obey and abide by all applicable laws and ordinances pertaining to this service.

6.1.3 Contractor shall show appropriate valid Motor Vehicle Operator licenses to the Contracting Officer’s Representative (COR) for all operators prior to the award of the contract.

6.1.4 Contractor shall be responsible for maintaining his/her equipment in working order and shall not be relieved of performance requirements in the case of breakdowns. Any costs for correcting damaged caused by the Contractor shall be borne by the Contractor.

6.2 Quality Control

6.2.1 The Contractor shall create a Quality Control Plan that ensures that the functions defined in this Statement of Work are carried out with the highest quality possible. A copy of the Contractor’s Quality Control Plant shall be submitted with the proposal.

An updated copy must be provided to the Contracting officer on the contact start date and as changes occur. The plan shall include, at a minimum, the following elements:

6.2.1.1 Description of the inspection system utilized in this contract. The description shall include specifics as to the areas to be inspected on the scheduled or unscheduled bases, frequency of inspections, and the title and organizational placement of the inspector(s).

6.2.1.2 Description of the methods to be used to identify and prevent defects in the quality of service to be performed.

6.2.1.3 Safety procedures to be utilized by the Contractor in the performance of his daily duties.

6.2.1.4 Description of the records that the Contractor will keep to document inspections and corrective or preventive actions taken.

6.2.2 Contractor shall maintain and make available to the Contracting Officer, upon request, the records of inspections throughout the contract period and for the period after contract completion until final settlement of all claims under this contract.

6.2.3 A proposed Quality Control Plan shall be submitted within 15 calendar days of award. If the Contractor chooses to make any changes to the plan during the contract performance period, such changes shall not be effective until they are submitted in writing to the Contracting Officer, and the Contractor receives written acceptance by the Government of such changes.

6.2.4 The Government shall conduct a Quality Assurance Program to verify and

6.3 Quality Assurance

6.3.1 Quality Assurance Procedures

6.3.1.1 In order to have an effective contract administrative program that ensures a successful business relationship between the Government and the Contractor, all parties involved in the service delivery process must work as a team and foster open and honest communication at all times. Close coordination and active cooperation on a continuous basis between the Contractor, CO, COR, and GARs is necessary to ensure smooth performance of the contract.

6.3.1.2 Contractor performance will be documented by means of written inspections, customer surveys, and records, which will be retained as part of the official contract file.

6.3.2 Effectiveness of Quality Control

6.3.2.1 The quality and timeliness of the Contractor’s performance of the required trash removal and disposal service will be used to access the overall delivery.

6.3.2.2 The Contractor will document requests for service and responses. This record will be available for inspection by the COR at all times.

6.3.3.3 The COR will make tours and inspections of the areas covered by the contact with the contactor’s representative whenever possible, to ascertain the level of service being performed. The Contractor will be informed of less than satisfactory performance within 1 day after inspection.

7. SAFETY STANDARDS

7.1. Work Environment

7.1.1 Contractor shall safeguard the public and Government personnel, property, materials, supplies, and equipment exposed to Contractor operations and activities.

7.1.2 Contractor shall avoid interruption of Government operations in the performance of this contract.

7.2 Corrective Actions

7.2.1 Whenever the Contracting officer becomes aware of any noncompliance with these requirements or any condition that poses a serious or imminent danger to the health or safety of the public or Government personnel, the Contracting Officer shall notify the Contractor orally, with written confirmation, and request immediate initiation of corrective action. This notice, when delivered to the Contractor or the

Contractor’s representative at the work site, shall be deemed sufficient notice of the noncompliance and that corrective action is required.

7.2.2 After receiving the notice, the Contractor shall immediately take corrective action. If the Contractor fails or refuses to promptly take correction action, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. The Contractor shall not be entitled to any equitable adjustment of the contract price or extension of the performance schedule on any stop work order issued under this clause

8. INDEMNIFICATION

8.1 Responsibility for Government Property

8.1.1 The Contractor assumes full responsibility for and shall indemnify the Government against any and all losses or damage of whatsoever kind and nature to any and all Government property, including any equipment, supplies, accessories, or parts furnished, while in his custody and service to be performed under the terms of this contract, resulting in whole or in part from the negligent acts or omissions of the Contractor, any subcontractor, or any employee, agent or representative of the Contractor or subcontractor.

8.1.2 If due to the fault, negligent acts (whether of commission or omission) and/or dishonesty of the Contractor or its employees, any Government-owned or controlled property is lost or damaged as a result of the Contractor’s performance of this contact, the Contractor shall be responsible to the Government for such loss or damage, and the Government, at its option, may in lieu of payment thereof, require the Contractor to replace at his own expense, all property lost or damaged.

8.2 Hold Harmless And Indemnification Agreement

8.2.1 The Contractor shall save and hold harmless and indemnify the Government against any and all liability claims, and cost of whatsoever kind and nature for injury to or death of any person or persons and for loss or damage to any Contractor property or property owned by a third party occurring in connection with or in any way incident to raising out of the occupancy, use, service, operation, or performance of work under the terms of this contract, resulting in whole or in part from the acts or omissions of the Contractor, any subcontractor, or any employee, agent, or representative of the Contractor or subcontractor.

8.3 Government’s Right of Recovery

8.3.1 Nothing in the above paragraphs shall be considered to preclude the Government from receiving the benefits of any insurance the Contractor may carry which provides for the indemnification of any loss or destruction of, or damages to property in the custody and care of the Contractor where such loss, destruction or damage is to Government property. The Contractor shall do nothing to prejudice the Government’s

HSBP1017Q0063 Statement of Work – OBP-San Diego Sector (3/14/2017) Page 7 of 8 right to recover against third parties for any loss, destruction of, or damage to Government property, and upon the request of the Contracting Officer shall, at the Government’s expense, furnish to the Government all reasonable assistance and cooperation (including assistance in the prosecution of suit and the execution of instruments of assignment in favor of the Government) in obtaining recovery.

8.4 Government Liability

8.4.1 The Government shall not be liable for any injury to the Contractor’s personnel or damage to the Contractor’s property unless such injury or damage is due to negligence on the part of the Government and is recoverable under the Federal Torts Claims Act, or pursuant to other Federal statutory authority.

9. CHANGES TO THE SOW

No changes to this SOW or cost increases shall be incurred without written prior approval of the Contracting Officer (CO). Any changes or cost increases will not take effect until the CO executes a written modification. The CO is the only individual with authority to amend a contract.
