DMEA # 19-17
Justification for Exception to Fair Opportunity Process f,or
Advanced Technology Support Program IV (ATSP4) Indefinite Delivery / Indefinite Quantity (ID/IQ) Task Order Contract
1. Agency and Contracting Activity:
Defense Microelectronics Activity (DMEA) Contracting Division/MEEB Attn: Samantha Plank, Contracting Officer samantha.plank@dmea.osd.mil 4234 54h Street McClellan, CA95652
2. Nature and/or Description of the Action Being Approved:
This is a new task order award being made to Raytheon under the basic IDIQ contract, HQ0721-16- D-0006; CET # 19-936 dated l1 March 2019, for Upgraded Early Warning Radar (UEWR) Beam
Steering Unit (BSU) Cabinets Analysis and Integration. The purpose of this task is to fabricate BSU cabinets, verif,r, validate, integrate, and install the cabinets into an operational environment at four
UEWRs to increase reliability, availability, and maintainability. This deployment resolves obsolescence and meets the Government need date in October 2021"
3. Description of the Supplies/Services Required To Meet the Agency's Needs (including the total estimated value, including options, if any):
The legacy BSU cabinets are all 40 years old greatly exceeding their planned 15-year life.
Obsolescence is now impacting the operational readiness of the UEWRs and their mission to provide early missile warning and missile defense data to US Combatant Commanders and to the President.
Supportability Analysis Reports demonstrate a need to replace all five BSU cabinets at the four remaining UEWR radar sites to guarantee operational readiness starting in early FY2021
This effort will: (1) Update site-specific build, test, verifl, validate, integrate, install, and deploy F3I technology for five (5) upgraded BSU cabinets; (2) Update software required to install, test, and deploy the new BSUs; (3) Deliver Level III Technical Data Package (TDP) updates, Technical Order (TO) updates, and training; (4) Deploy upgraded BSU cabinets into four site-unique UEWR BMEWS/PAVE PAWS sites (two cabinets at Fylingdales); (5) Dispose of the legacy cabinets; and
(6) Provide materials for initial BSU cabinet sustainment. The estimated value of this one capable source effort is $19M, funded by 3021Procurement Appropriations.
4. Identification of the Exception to Fair Opportunity (Authority Cited):
FAR 16.505(bX1)(i) requires the Contracting Officer to provide each awardee under a multiple award contract, a fair opportunity to be considered for each order exceeding $3,500 unless one ofthe following statutory exceptions apply. The specific exception that precludes the fair opportunity process for this acquisition is:
611112018 Page 1 of5
FAR 16.505ft)(2)(ix_B), Only one awardee is capable of providing the supplies or services required at the level ofquality required because the supplies or services ordered are unique or highly specialized.
5. Identification of requirement for the procurement of items peculiar to one manufacturer: (if not applicable delete)
Per FAR 16.505(aXa)(ii), requirements for use of items peculiar to one manufacture shall be justified and approved using the format and requirements from paragraphs 16.505(bX2)(ii)(A-C)" The proper title of the justification document is "Brand-Name Justification".
6" Rationale for authority cited:
Ralheon is the performer on the currently-executing FY16 BSU Cabinet Replacement ATSP3 IDIQ Contract H94003-04-D-0006, Task Order 0381 (CET # 16-644). This FY16 task was posted for ATSP3 fair opportunity and will deploy two qualified Form Fit Function and Interface (F3I) replacement BSU cabinets. One will be integrated and installed into the operational UEWR at Beale AFB, CA" The second replacement BSU cabinet willbe installed at the CISF SPA located at
Peterson AFB, CO. This task was awarded on 28 July 2016 with a value of $8,573,782 and a period of performance through 31 July 2019.
Ral,theon applied unique and highly specialized skills to the FY16 BSU Cabinet Replacement task, and need to build upon these efforts to make the UEWR BSU Analysis and Integration task successful. No other acquisition strategy can economically build, test, integrate, and install the five F3I BSU cabinets into the remaining UEWRs using the design coming out of the FYl6 BSU Cabinet Replacement task. Market Research indicates that only Raytheon can meet the Government's timeline. This is because another vendor will have to complete their design, qualif,, the design at both the CISF SPA and at an operational site. Additionally, another vendor will have to set up and qualiff an assembly line. Another vendor would require more than two and a half years and an additional $5 million in costs to perform the work. This task award is expected to be in June 2019. This will allow Raytheon to order material and build the cabinets using their existing BSU assembly line before it is shut-down in November 2019; therefore saving the Government startup cost. Additionally, the most difficult portion of the task is the site-unique integration effort to get each BSU cabinet into the IIEWRs and the engineering required to install it as part of prime mission equipment. Raytheon has knowledge of this process based on the currently executing cabinet replacement task they are installing at Beale under CET # 16-644 and into the CISF SPA. Raytheon will seamlessly leverage the same team in a timely manner. Since the use of another vendor is untenable, as cost and schedule goals cannot be realistically met, only one capable source acquisition strategy is the appropriate contracting approach to meet the warfighter's need in the ever-evolving national security threat environment.
7. Additional Facts Supporting this Justification:
The Ballistic Missile Early Warning System (BMEWS) and the PAVE Phased Array Warning System (PAVE PAWS) were designed and developed by Raytheon Integrated Defense Systems in the late 1970s. They are the Original Equipment Manufacturer. Three of these radars were upgraded to UEWRs in the early 2000s by Raytheon. The final two sites will become UEWRs in the next few years to satisfu the growing missile defense mission. Nevertheless, the radar's front-end prime mission equipment such as the BSU cabinets have not been touched. Now, components are obsolete and are no longer available to repair and maintain the cabinets. The BSU's function is highly
611112018 specialized in computing the necessary transmit phase shifts. The phase shift commands are then sent to the solid state modules on the arcay face where the RF energy is transmitted out in the correct direction and at the correct time. Due to the BSU's unique functionality, a new contractor would not be able to perform the analysis, integration, and installation efforts in an economical and efficient manner"
The AFLCMC/I{BQR is in the process of upgrading the front-end of the UEWRs to maintain operational readiness to provide timely and accurate missile warning, missile defense, and space situation awareness to combatant commanders. The obsolete legacy BSU cabinets are no longer supportable in a timeframe of rapidly increasing missile threats to North America creating a window of vulnerability for sustainers. The base FY16 BSU Cabinet Replacement task was competed. It successfully reverse engineered the legacy design to build two completely new BSU cabinets which includes exterior cabinet shell, CCAs, card basket, back plane, power supplies, sub-amplifiers, switches, and wiring harnesses. Raytheon will then install these two cabinets into one of five UEWRs and into the CISF SPA. This base task produces a qualified design. Raytheon will use their qualified design to build, test, integrate, and install an additional five F3I cabinets into the remaining four UEWRs. Raytheon has a functioning, qualified BSU assembly line to leverage thus saving the Government significant cost. Raytheon maintains extensive design knowledge, subject matter expert engineering staff, and is currently the only provider capable of supporting the effort in a timely and economical manner.
Lastly, independent government analysis of the work to be performed under the FY16 task (CET # 16-644) determined that the use of vendors other than the incumbent would prove to be both cost and schedule prohibitive" A different vendor will have to complete their design, qualify their design, and will have to set up and qualifi, an assembly line to build their BSU cabinets. Raytheon has significant prerequisite knowledge of the BSU's function and design as the OEM and from their work performed under CET # 16-644. This analysis considers the use ofanother vendor untenable, as cost and schedule goals cannot be realistically met
8. Actions to Remove or Overcome Any Barriers that Led to this Exception to Fair Opportunity
As described in the market research discussed in Section 6 above, Raltheon is the only vendor that ean meet cost and schedule goals. Only one capable source acquisition strategy is the appropriate contracting approach. However, in the future, the Government will continue to evaluate the marketplace.
