Justification for Exception to Fair Opportunity Process for

DMEA#l9-05

Advanced Technology Support Program IV (ATSP4)

Indefinite Delivery / Indefinite Quantity (ID/IQ) Task Order Contract

1. Agency and Contracting Activity:

2. Nature and/or Description of the Action Being Approved:

This is a new task order award being made to Northrup Grumman under the basic IDIQ contract, HQ0727-16-D-0004; CET 19-914 dated 26-October-2018, for Initial Maneuver-Short Range Air Defense Capability (IM-SHORAD)

3. Description of the Supplies/Services Required To Meet the Agency's Needs (including the total estimated value, including options, if any):

The proposed action is for a new task order under the basic IDIQ contract, HQ0727-16-D-0004 (Northrup Grumman) to upgrade the Maneuver-Short Range Air Defense Capability (M-SHORAD) and procure a limited number of advanced technology Air and Missile Defense Planning and Control System (AMDPCS) based microelectronic solutions needed to resolve obsolescence issues, improve performance, reliability, maintainability and improve the availability of the microelectronics-based (AMDPCS) capabilities to support this emerging requirement of an Initial Maneuver-Short Range Air Defense Capability (IM-SHORAD). Cost Plus Fixed Fee (CPFF) will be used for the development and the Low Rate Initial Production (LRIP) effort. The estimated program value is which will be funded using FYl 8 2035 APPN. These funds are available until completely expended.

The purpose of the basic ATSP4 contract is to develop solutions for the reliability, maintainability, obsolescence, availability, supportability, manufacturability, capability, and performance needs or deficiencies of items that range in complexity from discrete electronics through integrated circuits, circuit boards, modules, assemblies, subsystems, systems, and systems of systems. ATSP4 engineering approaches included advanced technology engineering and advanced hardware and software engineering.

4. Identification of the Exception to Fair Opportunity (Authority Cited):

FAR 16.505(b )(1 )(i) requires the Contracting Officer to provide each awardee under a multiple award contract, a fair opportunity to be considered for each order exceeding $3,500 unless one of the following statutory exceptions apply. The specific exception that precludes the fair opportunity process for this acquisition is:

FAR 16.505(b)(2)(i)(C), The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

DMEA #19-05

Rationale for authority cited:

The AMDPCS Shipsets described herein are scalable to fit four different US Army Combat Configurations 1) ,2)

, 3) and 4) .

These configurations provide Stryker and Armor Brigade Cornbat Teams with maneuverable automated command and control system that integrate air and missile defense planning and operations.

AMDPCS uses a correlated, real-time joint and coalition air picture to provide Soldiers with the ability to track aircraft outside their operational area, identiff friend or foe platforms, reduce fratricide and assist in integrating defense of the air battlespace. Air Defense Airspace Management (ADAM) provides maneuver units with collaboration and staff planning capabilities through the use of a correlated air picture, integrated and overlapping radar coverages, external tactical data links needed for the conduct of airspace coordination/airspace management below , and indirect fires deconfliction.

CET 19-914 is a logical follow-on to CET 18-898 which developed the basic designs for this project.

Northrup Grumman has more than a decade experience developing and fielding AMDPCS solutions for the US Army and was the contractor for CET 18-898 which developed the framework for CET I9-9I4. CET 18-898 was competed and awarded to Northrup Grumman.

CET 19-914 continues the development of these various AMDPCS configurations and produces sufficient LRIP systems required to meet the US Army IM-SHORAD upgrade ldtial Operational Capability (IOC) in . This effort include3 the design, development and procurement of equipment and material needed to fabricate AMDPCS systems required for IOC, to include: AMDPCS-B Configured Shipset for the

, Battery Command Post Command Post Configured Shipsets for , Sensor C2

Configured and ADAM Cell Configured Shipsets for the for a total of shipsets which when cornbined with CET 18-898 provides the US Army shipsets needed to meet IOC.

Contractors other than Northrup Grumman would require many additional months (perhaps years) in order to catch up to Northrup's AMDPCS technical baseline, potantially adversely impacting cost and schedule (and potentially performance).

Additional Facts Supporting this Justification:

None

Actions to Remove or Overcome Any Barriers that Led to this Exception to Fair Opportunity

DMEA will endeavor to ensure the appropriate data rights are negotiated (favorable for the Government) so that future US Army AMDPCS solutions managed by DMEA will be competed.
