5. Statutory Authority Permitting Other than Full and Open Competition.
The statutory authority permitting this sole source acquisition is 41 U.S.C. 1901. Procedures in FAR Subpart 13.5 were used.
6. Demonstration of Contractor’s Unique Qualifications or the Nature of the Acquisition Requires use of the Authority Cited.
The WASS is a commercial system being utilized at Poland the Aegis Ashore Site, and is a tactical mobile platform designed to be deployable as required to sites with similar mission sets, i.e. Aegis Ashore Romania and future sites. The WASS at Poland includes additional units purchased for this mission, and units received previously utilized in Romania. All units utilized must be compatible. More importantly, additional commercial units must be compatible with existing Command & Control Operating System as the mission may require mobilization within the region, which will require plug and play capabilities.
USSTRATCOM Instruction (SI) 538-02 requires that Integrated Electronic Security Systems
(IESS) utilized for the protection of BMDS assets be selected from the Air Force Approval list.
The Air Force Approval list is established after extensive testing, which is conducted by the Air
Force Life Cycle Management Center (AFLMC) and the Air Force Operational Test and
Evaluation Center.
FLIR’s commercial system is currently on the Air Force Approval List as an Assessment
Subsystem. This system was previously utilized as an urgent need in the Aegis Ashore Romania deployment because of its use at the Fort Greely, Alaska missile defense site and completion of
AFLMC testing. FLIR Detection Systems is the only source capable of providing compatibility with the existing Command and Control Operating System.
This sole source acquisition allows MDA/EIR to avoid mission failure by ensuring that equipment, services, and training are compatible at current and future sites.
7. Description of Market Research Conducted.
Initial Market Research was conducted by searching vendors with NAICS code 334511 and PSC
Codes: 5585, 5810, and R425. Market research has been ongoing by monitoring what is available in the market place. Between the dates of January 5, 2017 and January 18, 2017, market research was conducted using reports from the FPDS-NG database (location is www.fpds.gov), internet, phone interviews, an analysis of scope, magnitude of effort, and complexity was conducted to determine viable vendors. The only vendors that met scope, magnitude of effort and complexity were Northrop Grumman (TASS system) and FLIR.
However, only FLIR is capable of meeting the mission date of March 2017, as well as, providing compatibility with existing C2 systems being utilized at Aegis Ashore Romania. Northrop
Grumman indicated that they would need a six (6) month lead time, in order to fulfill a contract of this nature.
Market research was revalidated on 05 September 2019. An updated report from the FPDS-NG database using NAICS code 334511 and PSC codes: 5855, 5810, and R425. Northrup Grumman was not found to be on this list.
Market research also revealed that the WASS system is a commercial item that has been sold, leased, or licensed to the general public in accordance with FAR 2.101.
MDA will electronically post this justification to FedBizOpps within 14 days after its approval.
8. Determination of Fair and Reasonable Cost.
The contracting officer shall determine that the anticipated prices will be fair and reasonable based on price analysis of the proposed prices for the services equipment, and warranties. This analysis may include a comparison of currently offered prices to previously paid prices, a comparison of the proposed prices with the Independent Government Cost Estimates (IGCEs), a comparison of proposed prices with prices obtained through market research for the same or similar items and an analysis of the pricing information provided by the offeror.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition.
The WASS C2 system must be compatible with MDA-owned WASS equipment commercially provided by FLIR. The FLIR C2 TRaCS is proprietary to FLIR. FLIR has already demonstrated its ability to meet those needs in Romania and is replicating that ability in Poland.
The AFLMC Force Protection Branch is the Air Force executive agent for testing exterior sensors for the Department of Defense (DoD). AFLMC, in concert with other similarly chartered DoD agencies, perform tests and evaluations to qualify Electronic Security Equipment (ESE) resources for use in specific applications prior to wide scale procurement and deployment.
After the installation of the WASS at Fort Greely, the AFLCM was contracted to test the same system, which was tested and evaluated 30 July – 6 August 2013. The Force Protection test team from the AFLMC was asked to verify that all systems performed in accordance with the applicable requirements/standards, i.e., SI 538-02 and the Ground Base Radar (GBR) operational requirements as defined in the GBR section of Integrated Base Defense Security System (IBDSS) Capability Development Document (CDD). The Command, Control, Display Equipment (CCDE), Ground Surveillance Radar (GSR) and assessment equipment met the criteria and were determined to be effective and suitable for operational use.
10. Actions Taken to Remove Barriers to Competition.
It is not anticipated that any additional support for WASS will be required in Poland once construction is complete and final acceptance takes place.
11. Technical/Requirements Official Certification. “I certify that this sole source justification is made in good faith and that the supporting data and information are accurate and complete to the best of my knowledge and belief. I further certify that this request is not the result of a lack of advance planning.”
12. Contracting Officer. “I have determined that the anticipated price to the Government will be fair and reasonable and certify that the justification is accurate and complete to the best of my knowledge and ability.”
