About this file

This document is a justification for a sole source bridge contract award notice. The Washington Headquarters Services Acquisition Directorate issued a sole source bridge contract to Ironclad Technology Services LLC for $979,349.79 on May 29, 2020. The contract is to continue providing Information Technology Network Support Services to the Office of Military Commissions while a competitively awarded contract is being procured. Ironclad Technology Services LLC is the incumbent provider, and a new contract award could result in unnecessary delays, interruptions to critical services, and increased costs. The justification cites only one responsible source being able to meet the agency's requirements on the required timeline.

ACQUISITION DIRECTORATE

services will satisfy agency requirements”

5. REASON FOR AUTHORITY CITED: Federal Acquisition Regulation (FAR) 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements”. OMC is responsible for the court proceedings for the detainees held in GTMO. This requires Information Technology Network Support Services to assist with the capability to reach back to the existing OSD network in the NCR to access file shares, email and other services. OMC users will be able to use their same email account whether in the NCR or GTMO

Failure to issue a sole source bridge contract to the incumbent, Ironclad Technology Services LLC will create an unacceptable lapse in service of providing Information Technology Network Support Services.

Ironclad Technology Services LLC is currently providing Information Technology Network Support Services to the OMC. Implementing a new vendor to provide these services could result in unnecessary delays, interruptions in services, increased costs, and unnecessary hardship for OMC and their mission to provide support to the OMC personnel rotating between the NCR and GTMO who are responsible for the trial of detainees held at GTMO. Therefore, a bridge contract to Ironclad Technology Services LLC is required to ensure continuity of support for these essential services while the Government is working a competitive acquisition.

6. EFFORTS TO OBTAIN COMPETITION: On May 20, 2020, Washington Headquarters Services (WHS)

Acquisition Directorate (AD) issued a “Notice of Intent to Sole Source” this requirement to Ironclad Technology Services LLC on beta.sam.gov. The Notice of Intent was posted for two days and closed on May 22, 2020. No vendors responded to the notice to challenge the bridge contract to Ironclad Technology Services LLC.

A competitive acquisition to procure Network Redesign Support Services on a long term basis is currently ongoing.

7. FAIR AND REASONABLE COST DETERMINATION: The Government will make a determination of fair and reasonable pricing, using the procedures in FAR 15.404-1- Proposal Analysis Techniques; specifically, FAR 15.404-1(b)(2)(ii) “Comparison of proposed prices with independent Government cost estimates.” Since this requirement will be solicited to the incumbent vendor, historical prices paid from the current contract were used to develop the Government estimate and will be utilized to determine fair and reasonable pricing.

8. MARKET RESEARCH: Market research has been limited to the pre-solicitation notice described under efforts to obtain competition, which was posted for two days on beta.sam.gov. No vendors challenged this bridge effort.

WHS/AD will solicit this effort as a follow-on bridge contract in order to maintain continuity of support to the Office of Military Commissions. The bridge contract will be issued as the most logical and cost effective strategy and solution to the Government which will avoid unacceptable delays in fulfilling the agency’s requirement and a potential gap in performance of critical services while a competitive acquisition is being procured.

9. ANY OTHER FACTS SUPPORTING THE USE OF SOLE SOURCE: There are no additional facts. A sole source contract to Ironclad Technology Services LLC is required to ensure continuity of support for

Information Technology Network Support Services while the Government is working a competitive acquisition.

10. INTERESTED SOURCES: To date, no other sources have expressed an interest in writing.

11. ACTIONS TO INCREASE COMPETITION: The requirement for IT Network Support Services is currently being competed in a consolidated effort with an anticipated award date by the end of the 3rd quarter of fiscal year 2020.
