1. AGENCY AND CONTRACTING ACTIVITY:

Agency:

Chadwick Brooks Pentagon Force Protection Agency (PFPA) 5741 General Washington Drive, Suite A Alexandria, VA 22312

Contracting Activity:

The Department of Defense, Washington Headquarters Services, Acquisition Directorate Enterprise Security and Services Division, 4800 Mark Center Drive, Suite 09F09, Alexandria, VA 22350-2900

2. DESCRIPTION OF ACTION:

The Pentagon force Protection Agency (PFPA) requires a purchase order to support its Ballistics Armor and Accessories Program. The law enforcement directorates of PFPA have reoccurring mission requirements of ballistic armor for the Law Enforcement Officers.

The increased and continuously changing threat levels require Law Enforcement Officers to have bodily protection from threats in their operating environments. Threat level protection higher than NIJ Standards are required for Special Agents OCONUS missions and high level threat CONUS investigations. After identifying the ballistic armor requirements for the LEO, and Special Agents, the Pentagon Force Protection Agency found a vendor that provided the equipment that met all of the required specifications. Velocity Systems is patented and has the proprietary specifications on the vest currently being used by the Special Agents.

This requirement will be for Velocity Systems ballistic armor vests, accessories and helmets to support officers currently serving in high risk operational capacities. The ballistics armor vests and helmets must meet Special Agents and Emergency Response Threat (ERT) division standards as outlined by the Pentagon Police and the Investigations and Threat Directorate (ITD) in coordination with all pertinent Directorates.

4. AUTHORITY CITED: This action is authorized under provisions of 10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1 only one responsible source and no other supplies or services will satisfy agency requirements. This is a Brand Name requirement IAW 6.302-1(c).

5. REASON FOR AUTHORITY CITED:

Velocity Systems is the vendor that supplies the Pentagon Force Protection Agency (PFPA) with law enforcement ballistic armor and accessories. The ballistic vests are currently in use and trained in when participating in OCONUS or CONUS missions. Velocity Systems’ accessories and vest carriers are compatible with the ballistic armor currently used by the agents. Velocity Systems armor has been tested by the FBI and is the primary ballistic armor used by their agents.

Velocity Systems’ ballistic vests meet several requirements for the PFPA Law Enforcement Officer program not offered by another vendor such as:

• The ballistic vests are capable of using NIJ Certified Level IIIA Dyneema ballistic soft armor inserts in a neoprene material to reduce weight. The Dyneema ultra low visibility undergarment Level IIIA vest has the ability to minimize “printing” or showing when worn in plain clothing.

• The ballistic vests can be worn with FBI tested multi-threat hard armor plates that stop penetration of green tip 5.56mm and 7.62mm armor-piercing ammunition. The vest also has the ability to insert magnetic plates for attachment of pouches to the outer clothing.

• The ballistic vests are capable of using steel hard plates as the threat level increases.

• The ultra-low visibility vest have multi-directional shoulder and waist attachment capabilities and accepts the same FBI tested multi-threat hard armor plates that can be worn in the exterior vest.

• The ballistic vests are able to stop multiple hits, withstand dropping and possible fracturing.

The exterior vests are highly adaptable using a proprietary Swift Clip attachment system and Zip-on back panels. There are no known vendors that have the Swift Clip attachment system and Zip-on back panels on the vest that the special agents require for successful missions.

6. EFFORTS TO OBTAIN COMPETITION:

In accordance with FAR 5.2, the solicitation will be synopsized on the Federal Business Opportunities (FBO). This Justification and Approval (J&A) will be made publicly available on the FBO.

7. FAIR AND REASONABLE COST DETERMINATION:

The Contracting Officer will ensure that the final negotiated price for all orders placed under this contract are fair and reasonable by using price analysis techniques found in FAR 15.404, to include a comparison with the respective Independent Government Estimate and historical pricing information.

8. MARKET RESEARCH:

After researching the different brands and types of ballistic armor (PointBlank, ABA, Safariland, Galls, etc.) and carrier systems in the market, based on price and specifications, Velocity Systems is the only vendor available to meet the FBI and USSOCOM ballistic armor requirements PFPA Law Enforcement Officer need to comply with.

The program manager researched on GSA, Google, and Velocity Systems website and emailed the distributors on Velocity Systems’ authorized distributors.

A sources sought was posted on FedBizOpps on 5 Jan 2018 and closed on 10 Jan 2018 to identify any potential vendors, that could provide the aforementioned requirement. No responses were received.

9. OTHER FACTS:

These vests provide a comprehensive solution due to their adaptability, which will support a wide variety of missions that Law Enforcement Officers are designated to perform. These vests allow PFPA to be consistent with industry standards and other law enforcement organizations. Currently, PFPA’s Law Enforcement Officer and the FBI are using Velocity Systems’ ballistic armor. Both groups work together with Special Agents and ballistic armor setups are expected to be the same.

Velocity Systems has the most unique features that allow PFPA to adapt to any working environment. PFPA’s market research also indicated that ballistic armor needs to be replaced every five (5) years, which is a standard set forth by NIJ policy; however, carrier and hard steel armor is rated for 15 years of service. Adaptability is crucial in the manner that we serve and it is imperative to the success of each and every mission. Suitable equipment must be utilized to ensure the safety of all personnel while conducting high risk physical protection assignments and or investigations. It is recommended that Velocity Systems be the company that is used to outfit Law Enforcement Officer with the required and updated ballistic vests and accessories.
