STATEMENT OF WORK

Statement of Work for

ISO/IEC 17025 Accreditation of the CBRNE Laboratory and Threat Agent Testing Laboratory Accreditation Program

1.0 BACKGROUND

1.1 The Pentagon Force Protection Agency’s (PFPA) Chemical, Biological, Radiological, Nuclear and Explosives Laboratory (CBRNE Lab) provides analytical services to its customers for the detection of biological threat agents and pathogens. To ensure the confidence and accuracy of all records and data generated by CBRNE Lab, a comprehensive Quality Assurance (QA) program has been established. The CBRNE Lab QA program adheres to the requirements of the International Standardization Organization (ISO)/International Electro-technical Cooperation (IEC) 17025 standard, General requirements for the competence of testing and calibration laboratories. Re-accreditation to the ISO/IEC 17025 standard is being requested to validate the CBRNE Lab QA program. Due to specific challenges that are unique to a threat agent laboratory such as the subsequent actions that are triggered by laboratory results and the necessity to strictly adhere to our laboratory processes, the CBRNE also seeks an additional accreditation under a Threat Agent Testing Laboratory Accreditation Program.

1.2 To maintain accreditation, the contractor must perform an audit(s). A basic description of the audit would be an examination of policies, procedures, records and personnel to determine adherence to a particular standard (in this case, ISO/IEC 17025). The length of the audit would be determined by its scope and size and may be subject to change based on the auditor’s findings during the inspection process.

2.0 SCOPE OF WORK

2.1 The contractor shall provide an assessment of CBRNE Laboratory Quality Management System documents for compliance with the ISO/IEC 17025 standard.

2.2 The contractor shall provide an assessment of CBRNE Laboratory Quality Management System documents for compliance with the Threat Agent Testing Laboratory Accreditation Program Requirements.

2.3 The contractor shall provide a site assessment of the CBRNE Laboratory Quality Management System records and personnel to determine operational compliance with the ISO/IEC 17025 standard.

2.4 The contractor shall provide a site assessment of CBRNE Laboratory Quality Management System records and personnel to determine compliance with the Threat Agent Testing Laboratory Accreditation Program Requirements.

2.5 The contractor shall provide an Audit Summary Report including deficiencies against the ISO/IEC 17025 standard, as well as processes and/or timelines to correct such deficiencies.

2.6 Upon providing the corrective action(s) for audit deficiencies, the contractor shall issue the ISO/IEC 17025 accreditation and certificate to CBRNE Lab with any updates to expiration date of the certificate, scope of accreditation and organizational information (as applicable).

2.7 The contractor shall provide follow-up assessments for the purposes of changes to the scope of accreditation, renewal of accreditation, assessments for changes to the ISO 17025 standard or, if required, for proof of satisfactory correction of audit deficiencies. These follow-up assessments will include the processes defined in Sections 1.2, 2.1, 2.2, 2.3 and 2.4.

2.8 The contractor shall provide the CBRNE Lab with information to successfully complete the accreditation process.

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that--

(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and

(2) It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months.

(End of provision)

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

This acquisition will utilize the Lowest Priced Technically Acceptable (LPTA) procedure to make a best value award. A decision on the technical acceptability of each offeror’s quotations will be made. For those offerors that are determined to be technically acceptable, award will be made to that vendor with the lowest overall price.

While the Government will strive for maximum objectivity, the technical go/no go process, by its nature, is subjective; therefore, professional judgment is implicit throughout the evaluation process. The Government intends to make an award based on the initial quotations. If further questions are required, the contracting officer may contact the offeror or offerors. Award will be made to the responsible offeror whose quotation conforms to all solicitation requirements, such as terms and conditions, representations and certifications, technical requirements, and also provides the best value to the Government based on the results of the evaluation described in the paragraph below.

The LPTA evaluation process will be accomplished as follows:

(1) Acceptability:

The Government will review quotations to ensure that the quotation complies with the terms of the solicitation.

The Government will review the quotation to ensure the following:

i. All requested pricing information is submitted as requested.

(2) Technical Approach Acceptability:

Each offeror’s technical approach quotations will be evaluated to determine if the offeror provides a sound, compliant approach that meets the requirements within the Statement of Work (SOW) and demonstrates a thorough knowledge and understanding of those requirements.

An evaluation rating of Technically Acceptable / Non-Acceptable will be assigned upon completion of the technical quotations evaluation. If an Offeror receives a technical rating of “Non-Acceptable,” then they will not be considered for award.

(3) Price:

For evaluation purposes only, the total evaluated price is the sum of the total prices submitted for (a) the base period of twelve (12) months, (b) four (4) option years of twelve (12) months authorized by FAR clause 52.217- 9, and (c) the six-month extension authorized by FAR clause 52.217-8. For purposes of determining the evaluated price for the six-month 52.217-8 extension, the total price is calculated as one-half of the total price of the base year. Evaluation of option(s) will not obligate the government to exercise the option(s).

Price will be evaluated for reasonableness.

i. Reasonableness will be evaluated in accordance with FAR 13.106-3 procedures.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JAN 2017)

ALTERNATE I (OCT 2014)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal .
