The Office of the Deputy Assistant Secretary of Defense (Environment, Safety & Occupational Health (ODASD ESOH)) has requirements for Support for the Development of Overseas Environmental Baseline Guidance Document (OEBGD).

III. Description of Services

The effort will provide the following services:

• Provide comprehensive support for the ODASD (ESOH) through analyses;

writing, meeting facilitation, and collaborative work with the Office of the Secretary of Defense and the DoD Components.

• Conduct a comprehensive assessment of generally accepted Federal environmental standards applicable to DoD installations, facilities, and actions in the United States and environmental international treaties having extraterritorial application to DoD.

• Update the Overseas Environmental Baseline Guidance Document to reflect the changes in the U.S. environmental law and regulation to establish standards for environmental compliance at DoD controlled properties at overseas enduring locations.

Estimated value: $149,000.00 (including Options)

Period of Performance: 12 month base period with a six (6) months option period.

IV. Statutory Authority and Rationale for Authority Cited: IAW FAR 13.106-1(b)(1)(i)

“Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.”

The services are currently being performed under Army contract W912HQ-10-D-0009- 0127. The OEBGD update is a finite effort focused on revising the document to reflect the changes in the U.S. environmental law and regulation since the previous version published in 2007 with responsibility transitioning from the Army to ODASD (ESOH) in August 2016. The effort will conclude with the projected August 2017 publication of the updated OEBGD as a formal DoD manual, but may take up to 6-months longer depending on the extent of comments received in the publication coordination process.

The Army-led effort for the 16 different major environmental media areas in the OEBGD has been through Technical Working Groups (TWGs) consisting of DoD subject matter experts in both the United States and overseas under an overarching OEBGD Working Group (WG) consisting of DoD Component and Joint Staff senior environmental experts.

Each of the 16 media areas cover a unique and complex set of technical and regulatory issues with the OEBGD WG ensuring cross-media consistency in technical requirements and conformance with overall DoD environmental policy for the revised standards being established in the updated OEBGD. In supporting the Army-led effort LMI has developed technical expertise in all 16 media areas through facilitating the review and assessment of changes in U.S. environmental requirements and applicability to DoD enduring overseas locations as well familiarity with the multifaceted administrative and logistics tasks associated with orchestrating the work of the TWGs and the OEBGD that cannot be duplicated by another contractor without extensive additional cost and time.

The services sought this ODASD (ESOH) effort are same as those LMI is successfully performing for the Army and switching to another source will entail a severe disruption in the effort and lengthen the schedule as the new different source attempts to re-create the expertise and knowledge that LMI already possesses. As a result, there is only one source reasonably available to continue the work in progress.

V. Single Source Determination

The Contracting Officer has determined that that only one source is reasonably available to complete the work currently being performed by LMI, namely, LMI. The Contracting Officer will ensure that the final negotiated price under this task order is fair and reasonable.

VI. Certification

I certify that this justification is accurate and complete to the best of my knowledge and belief.
