BRAND NAME JUSTIFICATION AND APPROVAL

In accordance with FAR 13.501(a)(1)(ii) Special Documentation Requirements under the Test Program for Certain Commercial Items

Bates Brand Boots

1. Agency and Contracting Activity: Pentagon Force Protection Agency (PFPA) is the requiring activity for this action. Washington Headquarters Services (WHS), Acquisition Directorate (AD) is the procuring activity for this action.

2. Description of the Action: This action requests the approval for a Brand Name Justification for the purchase of the Bates Boots and the incidental mobile fitting services. These boots will be distributed to PFPA police officers as part of their uniform.

3. Description of Supplies: PFPA is requesting 800 pairs of various sizes of Bates Tactical Sport Side Zip 8” Boot and the Bates Lite High Gloss Padded Collar Chukka. It is requested that the contractor establish a mobile tactical boot store to offer employees an avenue to try on and acquire tactical boots at the convenience of their work location.

4. Authority Cited: under the authority of the test program for commercial items at 41 U.S.C.

1901 or the authority of 41 U.S.C. 1903; Brand Name feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, do not meet, or cannot be modified to meet, the agency’s need.

5. Demonstration of Contractor’s Unique Qualifications: The requested Bates boots meet the requirements set forth in Department of the Army Pamphlet (DA-Pam) 670-1, Guide to the Wear and Appearance of Army Uniforms and Insignia, Chapter 20 paragraph 3b to ensure boots are made to quality standard that ensures officers safety. These requirements are currently being incorporated into the PFPA Officers’ uniform regulations.

6. FedBizOpps Announcement/Potential Sources: The requirement will be solicited as full and open competition via a combined synopsis/solicitation on the Federal Business Opportunities (FBO) website.

7. Determination of Fair and Reasonable Cost: The Contracting Officer anticipates determination of cost to be fair and reasonable through adequate price competition and prices received in response to the solicitation. The Contracting Officer will utilize price reasonableness techniques as listed in FAR 13.106-3 (a) (2).

8. Market Research: Market Research was conducted by both the requiring and procuring activity. Market research included Contracting Officer consideration of mandatory and non-mandatory sources. The Government considered use of Federal Supply Schedules; however, only one (1) source was identified. Further, a Sources Sought Notice was posted to the FBO website for seven (7) days. As a result of the market research and the sources sought notice, the Government was unable to find an equivalent to both pairs of requested boots; however, market research indicates that several companies are able to provide both the brand name boots and the mobile fitting services on the open market.

9. Other Facts: While the preponderance of this work is supplies, the incidental mobile fitting services are integral to this requirement. All vendors must be able to travel to the Pentagon and the Raven Rock Mountain Complex and set up a mobile “shoe store” to allow PFPA Officers to try on and acquire the boots.

10. Interested Sources:

11. Actions Taken to Remove Barriers to Competition (FAR 6.303-2(b)(11): This requirement will be competed on the open market among authorized resellers of this product.
