Amendment Six (6) Questions and Revised Answers
Question Number
Reference Question Revised Answer
1. Will vendors be responsible for the entire security clearance process?
To be clear, all contractor personnel must pass a National Agency Check with Inquiries (“NACI”).
The contractor shall be responsible for timely submitting the paperwork for NACIs. In turn, NIH shall conduct the NACIs. However, for actual security clearances (e.g., Secret, Top Secret, etc.), the contractor is responsible for ensuring that its personnel possess the requisite clearances, including being responsible for the costs of the clearances, if necessary. Note:
Currently there are only three (3) Top Security clearances required.
3. Attachment 23: Labor Rates and Unit Prices
How will overtime be treated?
Are Offerors requested to establish an overtime rate for labor categories that could be considered Non-Exempt, or, include a statement that previously approved overtime hours will be paid at 1 ½ times the established hourly rate?
Overtime should be handled in accordance with the Service Contract Act (SCA) and the Fair Labor Standards Act (FLSA). Those labor categories not covered by the SCA and FLSA should be proposed in accordance with the offeror’s company policies.
Please see the attached excel file which is an attachment to amendment five (5) and is entitled: RFP Attachment number 28 - Table of Labor Rates for Overtime, RFP No. HHS-NIH-
NIDA(MH)-RFP-14-004
Offerors shall provide overtime rates for each labor category on the subject spreadsheet attached to amendment five (5) and provide it as part of their business proposal.
Instructions for completing the overtime spreadsheet are included in the body of the overtime spreadsheet.
9. Article B.2, Para. C.
If Overtime is to be paid, will it be a straight-time or time and a half? What if it is required on a Federal Holiday?
Overtime has already been addressed above.
Holiday pay should be handled in accordance with the Service Contract Act (SCA) and the Fair Labor Standards Act (FLSA). Those labor categories not covered by the SCA should be proposed in accordance with the offeror’s company policies.
13. The RFP states “the offeror is clearly apprised that the labor rates and per unit prices which the offeror commits to in its proposal shall be the prices which the offeror shall have to propose in response to each task order”. Will rate adjustments be permitted at the Task Order level for positions covered by the Service Contract Act?
In accordance with the SCA, if there is something which could not be known at the time of proposal submission, or something that changes in the law after contract award, the Government will consider possible rate adjustments.
