52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a single Indefinite Delivery Indefinite Quantity (IDIQ) bilateral contract from this solicitation, using FAR Part 12 and 15 procedures and the Best Value-Tradeoff approach, to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will not award to any offeror who receives a technical rating less than “acceptable” for any factor or subfactor. Also, the Government will not award to any offeror who receives a past performance rating less than “relevant” for relevancy and less than “satisfactory” for competency. The Government will not pay a price it considers to be disproportionate to the benefits associated with the proposed products/services. The Government may select for award offer in which the total proposed price is not necessarily the lowest, but whose overall proposal are deemed sufficiently more advantageous to the Government so as to justify the payment of a higher price. Conversely, the Government may select for award the offeror whose total proposed price is the lowest, when other proposals are not sufficiently more advantageous so as to justify the payment of a higher price.
The following factors shall be used to evaluate offers:
Evaluation Factors:
(1) Technical
(A) STEM Kits.
(B) Teacher Support
(C) Professional Development
(2) Past Performance: The overall evaluation will also take into account past performance information, including past contract actions, information on problems identified on contracts and offeror’s corrective actions. The past performance evaluation will result in an assessment of the offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in meeting past requirements. In addition to the specific contracts provided by the offeror, evaluation of past performance may also involve an examination of any information pertaining to the offeror on the Past Performance Information Retrieval System
(PPIRS). One performance confidence assessment rating will be assigned for each offeror after evaluating the offeror’s recent past performance, focusing on performance that is relevant to the contract requirements. The relevancy rating will be based upon: similarity of service/support, complexity, and dollar value. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated favorably or unfavorably on past performance.
(3) Price. The Government will perform price analysis IAW FAR Part 15.404-1(b) and applicable supplements and guides to ensure a fair and reasonable price. The price factor will include an evaluation of:
(i) Offeror must include firm fixed unit prices on all lists referenced in 52.212-1 Addendum (b) (6).
Kit Prices must include FOB Destination shipping to all locations within CONUS and list any additional charges for shipment to Puerto Rico.
(ii) For evaluation purposes, the Government will create a sample order consisting of 1 STEM Kit per grade, 1 Teacher Support Materials Kit per grade and 2 Replacement Kits per grade to develop a baseline for price comparison between the offers. For offerors who propose more than 1 kit per grade, the Government will take an average of all like kit prices for the grade level.
(iii) Proposed prices that are found to be unbalanced, unreasonably high or unrealistically low in relation to the proposed work may be indicative of an inherent lack of understanding of the solicitation requirements and may result in the overall proposal being considered unacceptable.
The Evaluation Factors (Technical, Past Performance and Price) are listed in descending order of importance. Within the Technical Factor, the sub factors are listed in descending order of importance.
(b) NOT USED.
(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(i) Taxes are considered delinquent if both of the following criteria apply:
(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection.
