PERFORMANCE WORK STATEMENT

1.0. INTRODUCTION: To fulfill its mission, the Department of Defense (DoD) Domestic Dependent Elementary and Secondary Schools (DDESS) must provide safe, timely and efficient transportation support for students traveling to and from curricular and co-curricular activities, after-school activities and clubs, sports practices and events, and other special school events in support of the education of eligible DoD dependents residing on four military installations in the Beaufort, South Carolina area. These installations are the Marine Corps Air Station (MCAS), Laurel Bay Housing, Marine Corps Recruit Depot Parris Island, and the Naval Hospital-Beaufort in accordance with Department of Defense Regulation 4500.36-R.

2.0. DEFINITIONS. As used within this PWS, terms are defined below:

2.1. “Contract Managers (Primary and Alternate).” The individuals appointed by the contractor to act as his/her representative as responsible for all services performed under this contract.

2.2. “DoDEA Accommodation Plan.” A plan developed for students with special needs in accordance with Department of Defense Regulation (DoDR) 2500.14.

2.3. “Extended School Year (ESY).” A summer education program for students conducted during the months of June and July that is approximately twenty (20) days in length.

2.4. “Individual Education Program (IEP).” A program developed for special education students in accordance with Department of Defense Instruction (DoDI) 1342.12 designating which services a student shall receive.

2.5. “Extended Learning Opportunity (ELO).” A program designed to allow additional instruction and study to improve students’ skills and knowledge outside of the traditional classroom setting. A typical session last approximately one and half (1-1/2) hours, after normal school hours for approximately twenty

(20) days in length. Students are dismissed at 4:00 p.m.

2.6. “Other authorized individuals.” U.S. Military Police and those persons authorized in writing by the Contracting Officer (CO) or the Contracting Officer’s Representative (COR) or Alternate COR.

2.7. “Run.” A one-way course of travel taken by a bus to transport students between their assigned bus stop and their designated school or from their designated school to their designated bus stop.

2.8. “Double-Run.” Using the same bus/driver to complete two (2) runs in the same direction. Example, completing a short AM run for an elementary route and an additional AM short run for a secondary school and likewise for the PM runs.

2.9. “Route.” The course of travel taken by a bus to transport students both to and from their assigned bus stop and designated school. A route normally includes one AM run (from pickup point to school) and one PM run (from school and to drop off point).

2.10. “Double-Route.” Performing two routes using same bus and driver.

2.11. “Walking Distance for DoD Installations”. The walking distance for grades 6 and below shall not normally exceed 1mile from their primary residence to the school or designated bus stop. Students in grade 7 and above may walk up to 1 ½ miles from their primary residence to the school or designated bus stop unless a major thorofare presents a safety hazard.

2.12. “Curricular Transportation.” Authorized transportation services in direct support of the school curriculum and events within the normal school day. Normally the activity is scheduled for an entire class and participation is mandatory and considered in determining a student’s grade.

2.13. “Co-curricular Transportation.” Authorized transportation for students and school sponsors to participate in interscholastic sports, music, forensics, science, humanities, performing arts, and so on.

These school-sponsored activities are designed to provide opportunities for students to participate on an individual or group basis in events for enjoyment, motivation, and improvement of skills. Student participation is on a voluntary basis and credit is not given. Most activities occur outside regular school hours.

2.14. “Bus Aide”. Authorized to accompany students with disabilities if the student’s IEP specifies the need for one-on-one adult supervision or special needs assistance is required with the student being transported to/from school. Bus aides are adults with special training that equips them to supervise or assist students with disabilities/special needs identified in the IEP and special instructions provided by the transportation manager. Bus aides are also authorized in vehicles exclusively transporting students enrolled in a DDESS preschool or kindergarten program and whenever ridership consists only of students in second grade and below. Bus aides ensure that these children enter and exit the school bus safely and conduct themselves in a safe manner while on the bus.

2.15. “School Officials.” Principal, Assistant Principal, Administrative Officer (AO).

3.0. SCOPE OF WORK. The contractor shall provide to the school district the number of school buses required to accommodate all students identified as eligible for transportation, to include all personnel (drivers and bus aides), supervision, services, supplies and equipment (not otherwise provided by the Government) necessary to perform school transportation services to three (3) schools for the approximately 300 eligible dependents residing on four (4) military installations in the Beaufort, South Carolina area. Each school day the contractor shall provide one round-trip to and from school to authorized dependent students enrolled in DDESS schools who reside outside of the walking area and within the designated commuting area. Curb-to-curb transportation shall be provided for certain students with disabilities as determined in the student’s individual education plan (IEP). This service may require specialized equipment including, but not limited to, special or adapted buses, lifts and ramps to provide transportation for a student with a disability. Contracted services must be in compliance with South Carolina Department of Education requirements for pupil transportation.

3.1. Scheduled Services.

3.1.1. Transport students and other authorized individuals to and from their designated schools and assigned bus stops before the start of, and at the completion of, the students’ school day during the regular school year (SY) and the ESY (see paragraph 3.1.3.). The contractor may utilize double-runs as the schedule permits to minimize cost to the Government.

3.1.2. Scheduled services shall include students who qualify for special transportation based on their IEP or DoDEA Accommodation Plan. This service may require specialized equipment including, but not limited to, special or adapted buses, lifts and ramps to provide transportation for a student with a disability. School officials will provide contractor with special transportation requirements for students with a developmental delay or disability.

3.1.3. Operational days shall be in accordance with the school year (SY) calendars, TE 1. The COR will provide contractor with a current Laurel Bay School Calendar after contract award for the base year and prior to commencing services for each option year. The route schedule requirement is detailed in TE 3.

3.1.3.1. The contractor shall provide bus services to those students living outside the established walking area. Contractor shall prepare bus schedules; routes and stops based on enrollment information (housing area address, school assignment, grade, and handicap) furnished by the COR. The elapsed time between first pick up and school drop off shall not exceed 1 hour in commute time.

3.1.3.2. The contractor shall incorporate any variances in scheduling to include, but not be limited to, late morning runs for delayed openings, early releases for inclement weather, and midday runs for school “half days”.

3.1.3.3. The contractor shall schedule bus transportation to arrive at all schools no later than 5 minutes prior to scheduled school starting time. Buses shall be in place and ready to load students 5 minutes before scheduled school dismissal. School operating hours are detailed in TE 2.

3.1.3.4. The service day schedule is subject to SY calendar adjustment as detailed in TE 4. The contractor shall comply with an adjustment to the schedule as directed by the COR.

3.1.3.5. The contractor shall implement route schedule changes within 48 hours of receipt of a route change request from the COR.

3.2. Bus Aides. Provide assistance to students and oversight on buses for scheduled transportation services and extended school year runs when required by a student’s IEP or DoDEA Accommodation Plan. Provide a minimum of one (1) bus aide on each scheduled bus run.

3.3. Unscheduled Curricular and Co-Curricular Transportation Services. Transport students and other authorized individuals between schools and to and from their designated schools and off-base sites for authorized school activities during and after normal school hours. The COR shall request service a minimum of 48 hours in advance. The length of these trips may not allow a driver to return in time to drive a scheduled route. Based on historic data, the projected need for these services is provided in TE 5 and TE 6.

4.0. TRANSPORTATION REQUIREMENTS.

4.1. General.

4.1.1. Passenger Safety. Safety is of the highest priority entrusted to the contractor under this contract.

The contractor shall perform all services in a safe, prudent and professional manner accepting full and sole responsibility for the prompt and proper delivery of services. The contractor shall maintain good order of passengers at all times.

4.1.2. Communication/Contractor Delays.

4.1.2.1. The contractor shall maintain two way communications with all bus drivers during transportation of students to include Scheduled Services, Unscheduled Services, and Extended School Year. Lines of communication with school officials shall be established 30 minutes prior and maintained 60 minutes after any scheduled run.

4.1.2.2. The contractor shall notify the COR and/or alternate COR immediately and provide replacement vehicles and/or personnel, as necessary to minimize the impact of a service delay. However, such notification does not preclude the Government from applying additional remedies (see paragraph 9.3.)

resulting from a service delay.

4.1.2.3. The contractor shall complete the run(s) within 60 minutes after notification of the service interruption such as an en-route vehicle failure, disabling accident, or contractor personnel illness, or other incident that causes a delay of thirty minutes or more.

4.1.3. The contract manager or designated alternate shall:

4.1.3.1. Be available telephonically a minimum of three hours before and after the normal school day regarding emergencies, severe weather notification, or other similar urgent non-routine matters.

4.1.3.2. Be immediately available to go to the scene of an accident or other emergency.

4.2. Vehicles. The contractor shall:

4.2.1. Have within its fleet a number of school buses which are capable of navigating all military installation housing areas and carrying both students who qualify for special transportation based on their IEP or DoDEA Accommodation Plan and students’ not requiring special transportation. Buses shall be inspected, serviced, and in place NLT 1 August of each school year.

4.2.1.1. Provide and maintain an adequate number of school buses, including spares, to safely transport any and all students assigned to the routes contained in this PWS and to assure uninterrupted service in the event of mechanical breakdown.

4.2.2. Vehicles transporting students shall meet the Federal Motor Vehicle Safety Standards for school buses and comply with school bus requirements for South Carolina Department of Education requirements for pupil transportation. Contractor shall have appropriate vehicles for wheelchair bound students requiring special transportation. Motor vehicles used to transport special education students shall be properly secured in the Child Safety Restraint System. Government will provide the necessary special seating for those students based on their IEP. Contractor shall be responsible for safe keeping of vehicles. Buses used to transport students who normally use wheelchairs shall be equipped with a lifting device or a ramp, which can be secured to the vehicle. Approved wheelchair restraining devices shall be installed and used.

4.2.3. Provide school buses equipped with a seat belt for each passenger, in accordance with Federal and State guidelines. Every student under the age of six (6) and weighing less than 80 pounds shall be transported in a Child Safety Restraint System (suitable for the child's weight and age) that meets applicable Federal Motor Vehicle Safety Standards. The Child Safety Restraint System shall be provided by the contractor.

4.2.4. Ensure all vehicle interiors are clean and the exterior presents a clean appearance at the start of the operational day.

4.2.5. Ensure all vehicles are equipped with functional climate control (air conditioning and heaters). The contractor shall maintain a comfortable temperature range in the passenger compartment no lower than 65 degrees (Fahrenheit) and no higher than 75 degrees (Fahrenheit) while transporting students and passengers. The bus(es) that the contractor designates for students requiring special transportation shall accommodate a minimum of one wheelchair.

4.2.6. The contractor shall be responsible for providing all supplies and amount of fuel required for the operation of contractor owned school buses and for maintaining them in efficient and safe mechanical condition.

4.2.7. All buses shall meet the South Carolina Department of Education Division of Pupil Transportation standards.

4.2.8. Perform vehicle safety inspections. The contractor shall have a procedure to conduct vehicle safety inspections prior to performing services under this contract. The contractor’s Quality Control Plan shall contain a daily vehicle inspection checklist. This checklist shall, as a minimum, ensure compliance with all applicable Federal and state laws and regulations. The contractor shall maintain a file of the results of all inspections during the entire life of the contract.

4.2.8.1. All school buses shall be inspected annually in compliance with either the State Department of Education's annual school bus inspection program or the Federal Department of Transportation annual inspection program if the standards of the federal inspection program meet or exceed the standards of the state's program.

4.2.8.2. The contractor shall be solely responsible for the implementation and accountability of school bus inspections. A copy of the vehicle inspection report shall be kept on these vehicles at all times.

4.2.8.3. All school buses are subject to inspection at any time or place by federal, state or government officials. A school bus shall not continue in operation in the transportation of students when the annual inspection is more than twelve months old or the school bus is found to be unsafe after any inspection until the unsafe conditions disclosed by the inspection have been corrected.

4.2.9. Display vehicle route number signage in accordance with directions provided by the COR.

4.3. Special Transportation Needs. The contractor shall:

4.3.1. Have appropriate vehicles to transport wheelchair bound students requiring special transportation.

Special education students shall be properly secured in the Child Safety Restraint System. Government will provide the necessary special seating devices for those special needs students based on their IEP.

4.3.2. Provide curb-to-curb service on scheduled school days for special needs children whenever required by student’s Individual Education Program (IEP) or DoDEA Accommodation Plan.

4.3.3. Provide travel to and from school and between schools, including travel necessary to permit participation in educational and recreational activities and related services based on their IEP.

4.3.3.1. Regular Transportation. The student rides the regular school bus using designated school bus stops.

4.3.3.2. Regular Transportation with Modifications. Modifications may include the following:

- Bus aide ensures child enters and exits the bus safely, secures child with seating devices, and ensure child behaves safely while on the bus.

- Provides bus aide with specialized training to manage the child’s particular disability.

- Vehicle shall be equipped with wheelchair accessibility.

- Vehicle shall be equipped with special seating devices.

- Alternate bus stop (student may require curb-to-curb service depending on the student’s disability; however, the regular bus would be ridden).

4.3.3.3. Special Transportation. Special transportation is authorized for students with disabilities so severe that they cannot be transported in the least restrictive manner (i.e., regular school bus).

Modifications may include the following:

- Bus aide ensures child safely enters and exits the bus and behaves safely while on the bus.

- Provides bus aide with specialized training to manage the child’s particular disability.

- Vehicle shall be equipped with wheelchair accessibility.

- Vehicle shall be equipped with special seating devices.

Note. If the child requires special transportation arrangements, as determined by his or her identified needs, the school officials will begin coordinating these needs with the transportation contractor prior to the Case Study Committee (CSC) meeting. The transportation contractor shall be aware of the child’s needs and any other problems associated with transporting the student in order to supply the logistical information and support the IEP requirements.

4.4. Bus Routes and Runs. The contractor shall:

4.4.1. Ensure all routes are performed as described in the route sheet. Buses shall not depart any bus stop before the route sheet departure time and shall arrive at all schools no later than 5 minutes prior to scheduled school starting time.

4.4.2. Ensure passengers are picked-up and discharged at their designated stop locations. In NO EVENT shall a passenger be allowed to exit a vehicle except at their authorized bus stop unless otherwise authorized in writing by the COR or designated representative.

4.4.3. Maintain good order of passengers at all times. The contractor shall report serious discipline problems to school officials and COR.

4.4.4. Ensure all bus passenger compartments are thoroughly inspected at the last stop of each run or after each unscheduled service to ensure no passengers remain in the vehicles. If there is a passenger remaining on a bus, the driver shall immediately notify the Contract Manager who shall contact the COR and school officials. The passenger(s) shall be safely transported to the location specified by the COR as quickly as possible.

4.4.5. Provide immediate assistance in locating a lost/missing child (see TE 9).

4.4.6. Check for lost and found articles. Any articles left behind by passengers shall be tagged to identify the vehicle route; run and date found and be delivered to the school officials the next business day.

4.4.7. Make all stops on their runs, regardless of delays or reason for delays, unless replaced or another contractor-controlled vehicle has already completed the Run.

4.4.8. On runs to schools:

4.4.8.1. Use the passenger lists provided by the school officials to verify that students and authorized passengers are boarding their assigned buses.

4.4.8.2. Record the names of any students not included on the passenger list and allow them to board the bus going to a school. Provide the record of such students to the school officials upon completion of the run.

4.4.8.3. Upon arrival at the school, ensure drivers remain on the bus with passengers until a member of the school staff is available to take charge of the passengers. The driver shall immediately notify the Contract Manager if no staff member is present within five minutes of the vehicle's arrival.

4.4.9. On runs at dismissal:

4.4.9.1. Allow only those students on the passenger list or those with a written authorization from the COR to board the bus. Report any incident of a student without proper authorization that attempts to board the bus to the COR and school officials through the Contract Manager.

4.4.9.2. When curb-to-curb service is authorized, release these passengers only when a parent or designated person is present. In the event this person is not present within five minutes of the vehicle's arrival (or scheduled arrival, whichever is later) at the designated stop, the driver shall immediately notify the Contract Manager. The Contract Manager shall then contact the school officials and COR for instructions. The driver shall take the passenger(s) to the location specified by the COR or school officials.

4.5. Additional Requirements:

4.5.1. Contractor shall notify COR in the event there is a need to provide parents specific information concerning unseen changes to daily transportation via the “One-Call” Notification System.

4.5.2. As directed by the COR, the contractor shall participate in Force Protection/Anti-Terrorism/Crisis Management/Safety and Security requirements. These requirements are during the normal duty day.

4.5.3. Contractor personnel shall be properly attired and present a neat and clean appearance.

Transportation drivers shall wear a nametag or display any identification badge(s) in a visible location in the driver’s compartment of the vehicle.

4.5.4. The number of students assigned to a school bus must not be greater than the manufacturer certified seating capacity, and all passengers transported must have adequate seating area to comply with the occupant protection performance standards required in the Federal Motor Vehicle Safety Standards.

4.5.5. Ensure school buses are routed in the most efficient manner and shall require that they are operated only on adequately maintained and safe public and private accessible highways and streets.

4.5.6. Prior to the opening of school each year, contractor shall be responsible for inspecting the road conditions of all designated bus routes including school property and all conditions deemed to be hazardous shall be reported to the COR before the start of the school year.

5.0. PERSONNEL REQUIREMENTS.

5.1. All contractor drivers shall be free of communicable diseases and physical or mental impairment that would affect the ability of the individual to perform the duties of the position.

5.2. Standards of Conduct. All contractor personnel performing under this requirement shall comply with the Standards of Conduct detailed at TE 8. The contractor agrees that inappropriate conduct shall not be tolerated and may be grounds for suspension or dismissal of a contractor employee from performance under this contract in addition to any remedy taken IAW paragraph 9.3.

5.3. Training and Certifications

5.3.1. The contractor shall ensure that bus drivers and bus aides are properly trained to perform their assigned duties.

5.3.2. The contractor shall administer a safety education program for all permanent and substitute bus drivers and bus aides.

5.3.2.1. The contractor shall provide all bus drivers and bus aides with training on emergency evacuation procedures, safety of students, and student behavior management prior to starting any services under this contract. Proof of this training shall be provided to the COR upon request.

5.3.3. Contractor bus drivers and bus aides shall be certified in a basic course in First Aid, including Cardiopulmonary Resuscitation (CPR).

5.3.4. Contractor shall ensure all drivers and bus aides are knowledgeable of:

5.3.4.1. Emergency and evacuation procedures by conducting four emergency evacuation drills pursuant to state regulation. Drills are per quarter upon acceptance of the COR.

5.3.4.2. The requirements for students who qualify for special transportation based on their IEP or DoDEA Accommodation Plan.

5.3.4.3. School bus routes and the location of health care facilities on or near the route. Contractor shall have copies of their route schedules in their possession while performing contracted services.

.5.4. Contract Manager(s).

5.4.1. The contractor shall appoint a Primary and an Alternate Contract Manager who shall be responsible for the performance of work at each location. The contractor shall notify the COR in writing of the appointments within 5 business days of contract award or prior to any replacement personnel assuming these duties.

5.4.2. The contract manager or alternate(s) shall have full authority to act for the contractor on all matters relating to daily operations of this contract.

5.4.3. The COR must be able to contact either the Primary or Alternate Contract Manager at any time during the work week, 24 hours a day, regarding emergencies, severe weather notification, or other similar urgent non-routine matters.

5.5. Transportation Vehicle Drivers. Contractor shall ensure all vehicle drivers:

5.5.1. Possess current, valid professional certifications and Commercial Driver’s licenses, endorsements (passenger ("P") and a school bus ("S"), in accordance with Federal and state laws for the vehicle(s) driven.

5.5.2. Are responsible for maintaining good conduct upon his/her bus and report promptly any misconduct or any violation of the driver's instructions by any person riding in his/her bus to the contract manager and school officials.

5.5.3. Are reliable persons of good character who possess the qualifications and communication skills necessary to perform the duties of the position, and comply with the rules set forth for drivers in all federal, state and local regulations.

5.5.4. Are experienced with good moral habits, and neither he/she use alcoholic liquors or smoke any cigar, cigarette, pipe, tobacco or other substance in such vehicle during the time he is operating the same as a school bus.

5.5.5. Have a certified physical examination prior to operating any vehicles under this contract. This physical examination shall be updated every two years thereafter. A copy of this certification will be made available to the COR upon request.

5.6. Bus Aide. Contractor shall ensure bus aides:

5.6.1. Have the primary responsibility for the student with an IEP or DoDEA Accommodation Plan to whom they are assigned, with secondary responsibility for the remainder of the bus passengers.

5.6.2. Be positioned on the bus in a location that will provide them opportunity to provide effective oversight. This location may vary from trip-to-trip depending on the time of day and passenger needs.

5.6.3. Shall be Cardiopulmonary Resuscitation (CPR), Automated Extermal Defibrillator (AED) and First Aid Certified for the age group of the students they are transporting. Verification shall be submitted to

COR.

5.6.4. Assist passengers requiring assistance in boarding and disembarking of vehicles.

5.6.5. Adhere to the procedures for passenger boarding, use of safety belts, special passenger seating, and safe vehicle operation as set forth in TE 7. Install and/or secure the Child Safety Restraint System (CSRS) and wheelchairs in accordance with the manufacturer’s stipulated procedures on buses transporting Pre-K and/or students requiring special transportation. (Note: CSRS includes car/booster seats and harnesses). The school shall provide special CSRS for special needs students as required by their IEP. The contractor shall provide CSRS for all other students based on their age and weight in accordance with South Carolina safety rules.

6.0. CONTRACTOR REPORT REQUIREMENTS.

6.1. The contractor shall submit and maintain the following reports to the COR:

6.1.1. Transportation Personnel List: Within three business days of date of award or exercise of any option period, identify all personnel performing the transportation duties under this contract by name and position title/function and proof of required certifications. Updated lists shall be submitted upon change in staff or as requested by the COR.

6.1.2. Actual Ridership Counts: The contractor shall count the total number of riders on each route each day for a three day consecutive period consisting of a Tuesday, Wednesday and Thursday during the months of October, January and April. The contractor shall submit the ridership report to the COR not later than the 20th of the month after the ridership count is taken (e.g., October ridership count will be due not later than Nov 20th).

6.1.3. Incident Report and Traffic Collision Report: Report all incidents, injuries and accidents to the COR. Within one hour of any/all such events, drivers shall make an oral report to the COR, through the Contract Manager, which shall be followed by a written report. Written reports shall be submitted to the COR within two working days of the incident, injury and/or an accident as follows:

6.1.3.2. Serious Incident Report (SIR). The Contractor shall report any accident or serious incident involving or impacting upon Laurel Bay School students as detailed in TE 11.

6.1.3.3. Reports or forms shall be provided to the COR and school officials as follows:

A. DoDEA Accident/Injury Report and Serious Incident Report (SIR) - Both reports should be completed NLT the next school morning. However, if the next day is a non-school day, both reports must be completed the same afternoon as the incident. These reports will be sent to the COR and/or the appropriate School Principal.

B.School Bus Conduct Referral Form, TE 10, shall be completed and handed into school officials NLT the morning of the next school day.

6.1.3.4. For injuries and/or incidents (which includes damage to the bus caused by a student), complete and submit the DoDEA Accident/Injury Report at TE 12.

6.1.3.5. For vehicular accidents, submit a copy of the South Carolina Traffic Collision Report.

6.2. The following additional reports/data shall be maintained by the contractor and available for inspection by the COR:

6.2.1. Vehicle Safety Inspection(s)

6.2.2. Accident/Incident Report(s)

6.2.3. Drivers License(s)

6.2.4. First Aid/CPR Training Certificate(s)

6.2.5. Certification of Physical Examinations

6.2.6 Quality Control Plan

7.0. GOVERNMENT FURNISHED FACILITIES. The government shall provide for official use only, bus storage space, parking, and office space with access to copier machine and local telephone service. All equipment, supplies, etc. for contractor personnel to perform their duties under this contract will be supplied by the Contractor.

8.0. CONTRACTOR QUALITY CONTROL. Prior to commencement of work each school year the contractor shall submit to the COR a complete and current Quality Control Plan for the transportation services under this contract. The plan may be in any format that is appropriate for the contractor’s operations. The plan will follow established quality control standards recognized by the transportation industry. The plan shall include a description of the inspection system to cover all services required under this contract.

9.0. GOVERNMENT QUALITY ASSURANCE.

9.1. Meetings. The contractor, the Contracting Officer and the COR shall meet as often as necessary to exchange quality control information or to discuss problems. Meetings shall include but are not limited to a post-award conference and any necessary transitional meetings.

9.2. Inspections/Surveillance. The Government reserves the right to perform inspections and surveillance to evaluate the contractor’s compliance to the contract terms and performance of the requirements in the PWS. The Government will make every effort to conduct the surveillance methods described below in an objective, fair, and consistent manner.

9.2.1. Incidental Observation. This action occurs when the COR or other Government official observes a deficiency. Examples include evidence from accidents, incidents, or delays. Regardless of where in the line-of-duty the COR observes contractual procedures not being followed, he/she has an obligation to document and report the deficiency to the Contracting Officer.

9.2.2. Customer Complaint. This action is instituted when the COR receives a complaint from a stakeholder (which includes parents, school staff, passengers or other concerned community members) regarding the bus service. The COR will obtain the complaint in writing and then conduct an investigation to determine its validity. If the complaint is deemed valid, the COR will immediately notify the contractor for action. The COR will notify the complainant of the Government’s response to their complaint.

9.3. Government Remedies.

9.3.1. Emergency Substitution. In the event the contractor is unable to furnish transportation as scheduled, the Government reserves the right to hire emergency substitute bus services for such time as deemed necessary. The Government shall deduct from the contractor’s invoices, or at its discretion, may bill the contractor for any differences in costs for the emergency service, including any cost incurred in obtaining said services, and any other damages incurred by the Government as a result of the contractor’s failure to provide services.

9.3.2. Notification of Service Deficiency (NSD). The Contractor is subject to deductions for unsatisfactory or incomplete services. A NSD shall be issued within two working days of knowledge of deficiency. The NSD shall explain the circumstances and findings concerning the incomplete or unsatisfactory service, and shall state the amount of any applicable deduction. A sample NSD form is attached as TE 13.

9.3.2.1. The contractor shall respond to, and return the NSD within two working days after receipt of the report. Failure by the contractor to timely respond shall result in a final determination by the Contracting Officer without contractor input.

9.3.2.2. The Contracting Officer shall make a final determination based upon the contractor’s timely response and, as needed, apply the appropriate deduction (see Schedule of Deductions) and provide a copy to the contractor within seven working days of the contractor’s response submission or nine working days after NSD report date if no timely response is provided by the contractor.

9.3.2.3. The Government shall use any completed NSD as part of an overall evaluation of contractor performance when determining present or future contractual actions.

9.3.3. Deductions. The contractor is subject to deductions for incomplete or unsatisfactory bus transportation services in addition to any other remedies the Government may be authorized under the terms and conditions of this contract.

9.3.3.1. Deduction Calculation.

9.3.3.1.1. Deductions shall be made on a per run basis. Should multiple deficiencies be recorded against all runs in a single day, the total deduction incurred shall not exceed 100% of the value of the affected day.

9.3.3.1.2. Example: Assume a deficiency occurs on a regular SY scheduled run on one day in the Base Year (CLIN 0001) and with a cost per day of $3000.

$3000/20 runs per day = $150 per run/day.

Under this assumption, a Service Deficiency (SD) with a 20% rate of deduction would be $30.00. A SD with a 100% rate of deduction would be $150.00.

9.3.3.2. Performance Requirements Summary. Failure by the contractor to perform critical performance elements in accordance with the PWS requirements are subject to deductions outlined in the Performance Requirements Summary, TE 14.

BUS ROUTE SCHEDULES

The contractor shall provide actual route sheets with Bus stops to the COR within 10 days of the start of the contract. All routes and bus stops are subject to review and revision based on change in student enrollment and/or ridership.

• For Regularly Scheduled AM Routes. Buses shall arrive at their designated school no earlier than 10 minutes, and no later than 5 minutes, prior to the Morning Bell Time.

• For Regularly Scheduled PM Routes. Buses shall arrive at their designated schools no earlier than 10 minutes and no later than 5 minutes prior to the Dismissal Bell Time.

• Extended Learning Opportunity (ELO). Bus(es) shall be provided for twenty days during the school year as requested by COR. Dates to be determined each school year by mid-October.

• Extended School Year: Buses shall be provided for twenty days during the summer as requested by COR. Dates to be determined each school year by mid-May.

• The Government reserves the right to revise the listed Bell Times to allow for staggered school start/dismissal times.

SERVICE DAYS AND SCHEDULE ADJUSTMENTS REQUIREMENTS

Contractor transportation services shall incorporate the below listed service days and schedule adjustment requirements.

In the event that the Contractor is unable to furnish transportation as scheduled, the government reserves the right to hire emergency substitute buses for such time as deemed necessary. The Government shall deduct from the Contractor’s invoices, or at its discretion, may bill the Contractor for any differences in costs for the emergency substitute service, including any cost incurred in obtaining said services, and any other damages incurred by the government as a result of the Contractor’s failure to provide services (see paragraph 9.3 of the Performance Work Statement).

Scheduled Early Release Days. Early Release Day transportation shall be charged at the same run rate as regular daily bus services.

Severe Weather and other Emergencies. In the event of severe weather or hazardous driving conditions, the COR shall notify the Contract Manager if school will be canceled or delayed. The standard per day rate shall apply for all delayed openings and emergencies. If school is cancelled, transportation services and cost shall be postponed in the event of snow makeup days.

Other Early Dismissals. When schools are dismissed earlier than normally scheduled due to an Emergency Dismissal, the Contractor shall have vehicles at the school(s) and ready for services within 1 hour of the call by the COR or designated representative.

Delays. The Contract Manager shall notify the COR and school officials anytime that completion of a Run is expected to be delayed by 30 minutes or longer.

Emergency Bus Evacuation Drills. Once each school year, as directed by the COR, all students shall participate in emergency bus evacuation drills. During Bus Evacuation Drills, it will be requested by the COR or School Official to have two (2) buses remain on the school site during school hours for 5 school days.
