B. FAR 52.212-2 Evaluation—Commercial Items applies to this solicitation.
ADDENDUM to FAR 52.212-2:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Technical: Technical Capability to meet the government requirements in accordance with attached performance work statement. Proposal will be rated on an “acceptable” or “unacceptable” basis.
2. Price: Completed ELIN price proposal (attached) for base and 4 option years.
3. Past Performance: Past performance will be rated on an “acceptable” or “unacceptable” basis.
Award will be made to the offeror who proposes the lowest priced technically acceptable (LPTA). Technical and past performance, when combined, are equal to price.
To be considered technically capable, offeror shall guarantee officials will be trained in NFHS rules in the sports specified within the RFP and PWS and the offeror shall guarantee they have required officials currently on staff or will recruit and be ready for performance starting 1 August 2015. Offerors found technically capable will then be evaluated for price.
To calculate the offeror’s total evaluated price, the Government will add the subtotals of all officials for base and option.
The Government may also base an offeror’s past performance record on government knowledge, government-wide Past Performance Information Retrieval System (PPIRS) or any other reasonable basis. If an offeror has no past performance record, the offeror shall receive a neutral rating. Past performance will be evaluated in accordance with FAR 13.106.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. To account for the option period(s) possible under FAR 52.217-8 -- Option to Extend Services, the Government will take the price for all CLINs of the final option period, prorate it to a six-month value, and add it to the sum of all CLINs (base plus all option periods). This amount will be the total evaluated price. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
