Defense Threat Reduction Agency 8725 John J. Kingman Road, Stop 6201 Fort Belvoir, VA 22060-6201
JUSTIFICATION AND FOR OTHER THAN FULL AND OPEN COMPETITION
Amendment 0002
1. Nature and/or Description of Action
The Defense Threat Reduction Agency (DTRA) proposes to issue Amendment 0002 against the Justification for Other Than Full and Open Competition for the requirement entitled “Open Skies Calibration Target Array Design, Build, Maintenance, Deployment, Storage and Baseline Certification Reporting”. Woolpert, Inc. is the only contractor able to provide the required technical support. The purpose of Amendment 0002 is to revise the previously approved ceiling of $2.7 million to $4.72 million and address the contributing factors associated with this revision. The original and amended Justification for Other Than Full and Open Competition are attached.
2. Description of Supplies/Services Required
Amendment 0002 pertains to the revision of the ceiling for the amended justification due to mission criticality, which is driven by the United States Air Force (USAF) Digital Visual Information System (DVIS) Program Office (PO) requirements. DTRA was originally tasked to maintain calibration targets in accordance with the memo on “Implementation of and Compliance with, the Open Skies Treaty” dated May 8, 2015 from the Office of the Under Secretary of Defense for Acquisition Technology and Logistics (OUSD {AT&L}). The DVIS PO was similarly tasked by OUSD (AT&L) through the USAF to procure a digital camera system to replace the wet film system currently installed and certified for use on the US Open Skies Treaty Observation Aircraft. In order to certify the new digital sensor system for use, data collection flights must be conducted at various altitudes, speeds, time durations and at treaty specified sun angles. During these flights the aircraft must take photos of treaty approved/certified calibration targets maintained by DTRA. These targets are required for use during not only Data Collection, Pre-Certification, Certification, Annual Baseline, and Ground Truth reporting but Demonstration flights of Foreign Observation Aircraft conducting treaty approved overflights of the US and its territories. Prior to contract award and as specified in the Statement of Work (SOW), the Government estimated that 19 weeks would be needed to accomplish data collection requirements necessary for assembly of the “Certification Technical Document and Flight Test Data Package”. Since the approval of Amendment 0001 to J&A (July 2017) the DVIS PO provided DTRA with an estimated flight schedule. Upon further examination of contract (HDTRA1-17-C-0072) it was discovered that the quantities listed did not provide the flexibility to support exercising multiple quantities where necessary to support this treaty required, DoD mandated and compressed flight schedule. In order to ensure successful programmatic execution and meet mission accomplishment, the modification of Optional CLIN quantities is urgently needed for treaty certification of the newly installed digital sensor system.
3. Statutory Authority
The statutory authority for this non-competitive action is 10 United States Code (U.S.C.) 2304(c)
(1) or 41 U.S.C. 253(c) (1), as implemented by FAR 6.302-1, Only One Responsible Source and no other supplies or services will satisfy agency requirements. The statutory authority remains unchanged for Amendment 0002.
4. Applicability of Authority
The applicability of authority for Amendment 0002 remains unchanged from the original Justification for Other than Full and Open Competition. As noted in the original justification, DTRA conducted extensive market research during the acquisition strategy stage to ensure all competitive considerations were addressed prior to making a non-competitive procurement determination. During the acquisition strategy review, DTRA assessed the Dynamic Small Business Search database for any small businesses with experience in supporting the Open Skies Treaty. This search sought companies with experience in Open Skies Treaty policies and procedures to include aircraft certification, demonstration, data collection, data reduction and target contract baseline certification and reporting requirements. The small business search was unsuccessful in producing any small businesses with the capability to support the Open Skies Calibration Target Array Design, Build, Maintenance, Deployment, Storage and Baseline Certification Reporting effort. These results were substantiated by discussions with DTRA’s Director, Office of Small Business Programs.
In addition to the Dynamic Small Business Search, DTRA posted a source sought notification on the Federal Acquisition Regulations (FAR) Government Point of Entry (GPE), Federal Business Opportunities (FBO). Four (4) businesses provided a responses to the sources sought, see paragraph 5 for interested vendors. DTRA did an assessment of all four respondents and found three of the fours vendors did not possess the requisite skillset needed to meet this DTRA mission. This was due to the vendors either being Information Technology focused (software/hardware) or construction and facilities experts. Neither of these skillsets are a component of meeting the DTRA SOW requirements. The fourth respondent, Woolpert, Inc., was performing this effort under contract HDTRA1-12-F-0027 and does possess the skillset needed to meet mission requirements.
Finally, DTRA concluded the acquisition strategy review by making contact with two previous incumbents to inquire of interest and capability. Both incumbents indicated they did not have the full capability in-house or the desire to support DTRA’s mission as a prime contractor.
5. Effort to Solicit Potential Sources
As discussed in the original Justification for Other Than Full and Open Competition DTRA posted a Sources Sought Notice on the Federal Business Opportunities website as required by FAR Part 5 on March 2, 2017. The following four (4) vendors responded to the announcement:
1. Shivan Technologies Inc., 208 South King St, Suite 301A, Leesburg, VA 20175
2. Prime Solutions Group Inc., 1300 S. Litchfield Rd, Bldg. 4, Goodyear, AZ 85388
3. RV Global Solutions Inc., 4 Scarlet Oak Drive, Princeton, NJ 08540
4. Woolpert Inc., 4454 Idea Center Blvd, Dayton, OH 45430
The respondents were either Information Technology focused and or focused on building construction and facilities maintenance. The fourth response was received from the incumbent, Woolpert, Inc., who is capable of fulfilling the skillsets for this requirement.
6. Fair and Reasonable Costs
The anticipated cost/price of this contract action to the Government was determined to be fair and reasonable based on comparison with historical data from the current and previous contract efforts for the same or similar services, a cost analysis of the contactor's proposal and input/evaluation from the program office was utilized in making this determination. The fair and reasonable cost determination approach remains unchanged for Amendment 0002. The attached IGCE addendum further documents the optional quantity elements that necessitated this amendment.
7. Market Research
In accordance with FAR part 10, market research was conducted to find acceptable contractors capable of providing the services. The Project Officer reviewed government schedules, Department of Defense-wide strategic sourced indefinite delivery/indefinite quantity contracts, internet searches for possible performers, and assessed sources sought responses. In addition, contact was made with previous performers (2) to ensure all competitive considerations were assessed. The results of the market surveillance efforts substantiate the application of FAR 6.302-1, Only One Responsible Source and no other supplies or services will satisfy agency requirements. The results of DTRA’s market research remains unchanged for Amendment 0002.
8. Other Facts
It is estimated that it would cost the Government roughly $200,000 in duplicated efforts to compete this action. These costs will not be recovered through full and open competition. Based on historical experience, it will take 8-12 months to acquire the knowledge and experience about the program necessary to perform the job at the required level. This includes labor costs as well as those associated with training and travel required to acquire the skills for the specific mission related to the Treaty on Open Skies. Amendment 0002 makes no changes to this section of the original J&A.
9. Interested Sources
Interest sources that responded to DTRA source sought notice were assessed and found to either be information intelligence focused and or focused on building construction and facilities maintenance. The respondent's skillsets are not transferable to the skillsets required to support the
Open Skies Calibration Target Array Design, Build, Maintenance, Deployment, Storage and Baseline Certification Reporting mission. Amendment 0002 makes no changes to this section of the original J&A.
10. Subsequent Actions
DTRA will continue to conduct market surveillance through-out the performance of this follow-on effort to attempt to locate other potential sources and overcome barriers to competition during future acquisition efforts necessary to support this requirement.
