2. Procurement Title: Worksoft Software Support Renewal
Funding Document/Purchase Request Number: N0003918MP00487 Contract Number: To Be Determined Estimated Value: XXXXXXX
3. Statutory Authority: In accordance with (IAW) FAR Part 13.106(b)(1), the contracting officer may solicit from only one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, licensing agreements, brand name or industrial mobilization).
4. Description of Action:
Brand name, software support renewal for Worksoft Suite to include Certify for SAP, Certify Live Learn and SAP Content, Certify - Quality Center Integration, Certify Impact Tier, Certify Data (Upgrade to tier2), Certify Business Process Procedures, and Certify Silverlight, VB and .NET interface Extensions is required for the Navy Enterprise Business Solutions (NEBS) and the Navy Enterprise Resource Planning (ERP). The Worksoft software satisfies the NEBS need for customized automated test scripts and the software product integrates with SAP Solution Manager to facilitate automation of test scripts. Fiscal Year 2018 Operations and Maintenance, Navy (OMN) funds will be for the firm fixed price (FFP) open market order. The period of performance (POP) is July 1, 2018 –June 30, 2019. This firm fixed price order will renew the existing Worksoft Certify software support provided under order HC102817P0135 that has a POP of July 1, 2017 –June 30, 2018. The North American Industrial Classification Code is 541519 with a size standard of $27.5 million. The firm fixed priced order will involve the item below.
Item Description Quantity
M&S-DAT
Annual Maintenance and Support for all licenses purchased in 2011 (9 Certify for SAP, Certify Live Learn and SAP Content, Certify-Quality Center Integration) and 2012 (7 Certify for SAP, Certify Impact Tier, Certify Data (Upgrade to tier2), Certify Business Process Procedures, Certify Silverlight, VB and .NET interface Extension).
The NEBS requires annual software support renewal of the Worksoft Certify test suite – an already acquired and implemented automated software test tool, in support of the NERP Program. NEBS acquired Worksoft software in 2011 (procuring 9 licenses) to satisfy a need for customized automated test scripts. Worksoft is a product that integrates with SAP Solution Manager to facilitate automation of test scripts. NEBS acquired 7 additional licenses for the Navy ERP Unit Test and Quality Assurance Landscapes in 2012. The annual renewal of the Worksoft Certify software support provides major product and technology releases and critical security patch updates required to keep the Navy ERP System accredited and operational. This is a brand name acquisition. As the software publisher, only Worksoft has access to the software source code that is being supported. Product upgrades, maintenance releases, patches, and troubleshooting support require access to the software source code.
Without access to the software source, no other firm can provide the required support.
Navy ERP is a very large-scale business application built on the SAP software platform. The current deployments include approximately twelve different business modules supporting both financial management and supply chain functionality. A significant portion of the Navy's financial and supply functionality is currently managed through Navy ERP. In addition, the solution also supports Fleet readiness. Even though SAP is a fully functional "off the shelf' solution, the Navy ERP program has made, and continues to make, many customizations in order to better support Navy processes and functionality. These require the renewal of support of the Worksoft software infrastructure.
If the Navy ERP were unable to obtain Worksoft Suite software support, significant schedule impacts and work stoppages could occur. Without the automated software scripts, labor-intensive alternatives would result. If the Worksoft Certify Automated Test Suite were no longer able to be used, several different test software packages would have to be purchased as replacements in order to match the capabilities Worksoft provides. Additional schedule delays and work stoppage would result as significant tests and approval reviews would be required. Replacement of the infrastructure is unacceptable to the Government at this time.
5. Proposed Brand-Name Product: The brand-name Worksoft support is required.
6. Market Research:
Based on current market research (March through mid-May 2018) it has been determined that only the aforementioned brand-name product and/or product support can fully support the Government's need. This requirement is for proprietary products and no competitor functional replacement products exist in the market at this time to meet the Government's need. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the OEM releases ownership rights of product, or it is economically feasible to procure a new system.

Market research was completed via internet searches and email and phone correspondence with vendor representatives and Government stakeholders. The brand-name software support was determined to be mission critical and no other products meet the Agency needs. The requirement is not available through DoD Enterprise Software Initiative Blanket Purchase Agreement, General Services Administration, or National Aeronautics and Space Administration Solutions for Enterprise-Wide Procurement contract vehicles. The requirement can be fulfilled through a small business order to the software owner, Worksoft, Inc. or their authorized small business reseller(s), which include K2 Telecom Inc., doing business as Wallace Consulting. The recommendation is to procure the software support through an open-market order with 100% small business set-aside.
7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this limited source brand name justification for the proposed contract action pursuant to the authority cited above as the particular product and service is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.
Based on the justification provided by the NEBS and Navy ERP, a determination has been made to issue a solicitation with 100% small business set-aside for the above described brand-name requirement.
