2. Contract Title. Armed Services Board of Contract Appeals (ASBCA) Case Management System
3. Background.
3.1 The ASBCA is an independent, quasi-judicial Department of Defense (DoD) agency.
Functioning at the level of a federal district court, the mission of the ASBCA is to provide impartial, informal, expeditious, and inexpensive resolution, under the Contract Disputes Act or the ASBCA’s Charter, of disputes arising out of or related to contracts entered into by DoD; the Departments of the Army, Navy, and Air Force; the National Aeronautics and Space Administration; and any other department or agency as permitted by law. The ASBCA has a current docket of approximately 1,000 active cases.
3.2 The ASBCA seeks to replace its existing Automated Case Tracking Software (ACTS) with a commercial court case management system that provides integrated case management and tracking, electronic filing (e-filing) of court filings by the parties who litigate before the ASBCA, and document management (hereinafter, “CMS”).
4. Objectives: The primary goals of obtaining a new CMS are as follows:
• Provide an application to support the proactive management of cases including alerts, milestones, status and reporting.
• Increase productivity of ASBCA staff by providing the most efficient means of entering data in real time.
• Improve the quality of case data by standardizing data entry.
• Improve performance and timeliness of information available to judges by providing standardized reporting, better database structure, and accurate data.
• Provide for retrieval and viewing of case documents and the internal ability to affix annotations to those documents within the CMS.
• Provide for the creation of templates of various ASBCA orders and other correspondence that pre-fill specified data fields with relevant case information, such as docket number, case name, parties’ representatives names and addresses.
• Provide for the internal circulation and tracking of draft decisions, orders, and other case-related documents.
• Allow litigants, with appropriate security privileges, to upload, view, and download their case filings, the opposing party’s case filings, and ASBCA decisions, orders, and other case-related documents.
• Provide a means for access, with appropriate security privileges, to case information by internal users, the public, and the ASBCA’s appellate courts.
• Provide various types of reporting capabilities consistent with the existing ACTS reports.
• Facilitate data migration from the existing ACTS system.
5. Scope. This contract includes any hardware, software, and services that may be necessary to deliver a turn-key CMS to meet the ASBC’s objectives. It also includes all planning, analysis, configuration design, configuration, installation, testing, documentation, training, and implementation of the CMS for all internal and external users within the ASBCA system.
The Government may require surge support during the base or any option period, and surge modifications will be within the scope of the order and provide increased support for the defined task areas of this PWS. Surge support over the life of the contract will not exceed 50% of the contractor’s total proposed labor cost for the base and all option periods.
6. Performance Requirements.
6.1 Task 1 - CMS Software/Application.
6.1.1 Subtask 1. Software Delivery. The Contractor shall deliver a CMS application that meets or exceeds all of the requirements set forth in PWS Appendix 1 - Requirements.
6.1.1.1. Software License. The Contractor shall provide the necessary software license for the operation and use of the CMS by the ASBCA and external users. External users are members of the general public; parties that have been granted permission to view, upload and download documents in cases to which they have been granted access by the ASBCA; and other parties that have been granted access to some features of the CMS by the ASBCA. The Contractor shall not require ASBCA users or external users to obtain individual, separate software licenses; rather, any necessary software shall be provided in an enterprise-type license that covers all ASBCA users and external users. The ASBCA currently has approximately 45 employees. The enterprise license shall be scalable to up to 70 employees at no additional cost. The Contractor shall not charge external users fees for viewing, uploading or downloading documents, or for any other access to the CMS. The ASBCA does not intend to charge external users fees for viewing, uploading or downloading documents, or for any other access to the CMS.
6.1.1.2. Compatibility. The CMS shall be able to run on either (a) Oracle Linux ver 6 or 7 operating system or (b) Windows 2012 R2 operating system and shall fully integrate with Windows Office 2016. Throughout the duration of the contract, the Contractor shall keep the CMS software patched and updated to meet ALTESS-directed upgrades to the operating system and to maintain compatibility and integration with all software patches, updates, service packs, and future versions of Microsoft Office.
6.1.2 Subtask 2. CMS Software Installation and Support. Throughout the duration of the contract, the CMS software will be hosted by ALTESS at the Radford Army Ammunition Plant, Radford, VA. Only ALTESS personnel will have access to the servers to perform software installation and support. The Contractor may have limited access to the CMS application through an administrator account, if such access is available with the Contractor’s software. This limited access will be through the URL established for public access to the CMS. The Contractor shall provide all necessary assistance to ALTESS personnel, either onsite or remotely, through verbal instructions and/or written documentation, to accomplish the tasks necessary for the CMS to be installed on ALTESS servers and for the CMS to be approved by the US Army Network
Enterprise Technology Command and to receive a Certificate of Networthiness to satisfy the NIST 800 Risk Management Framework process for Authority to Operate. The Contractor shall provide all necessary assistance to ALTESS personnel to obtain approved Security Technical Implementation Guides (STIGs). 6.2 Task 2. CMS Configuration to Support ASBCA Business Rules
6.2.1 Subtask 1. The Contractor shall provide all services necessary for the planning, analysis, configuration design, configuration, testing, documentation, training, and implementation of a configured CMS for all internal and external users within the ASBCA system. The configured CMS shall replace the functionality of the ASBCA’s current ACTS system, provided that the ACTS functionality is compatible with the Contractor’s CMS software. The configured CMS shall include all of the capabilities of the CMS. The configured CMS shall be compatible with any future versions of the Contractor’s commercial CMS.
6.2.2 Subtask 2. The Contractor shall develop a configuration plan that sets forth timeframes for the various steps necessary, from planning through full implementation, to implement a configured ASBCA CMS. In developing its configuration plan, the Contractor shall incorporate ALTESS-required milestones for the CMS to be hosted on ALTESS servers.
6.2.3 Subtask 3. To the extent the ASBCA’s standard document templates are compatible with the CMS, the Contractor shall re-create in the configured CMS the ASBCA’s standard document templates, which allow for pre-filling the documents using data from the CMS, such as case number, case name, parties’ representatives’ names and addresses, and signature block information. Currently, the ASBCA utilizes approximately 100 document templates.
6.2.4 Subtask 4. To the extent they are compatible with the CMS, the Contractor shall re-create in the configured CMS the ASBCA’s standard general reports and statistical reports currently generated by ACTS. The current ACTS reports are set forth in the table below. In this table, “Appeal” is equivalent to “Case” and “Judge” includes “ASBCA Staff Attorney.” The Explanatory Notes provide a short overview of most of the types of data contained in each report, but are not an exhaustive list.

Administrative Judges’ Activities
For a specified time period (usually one month), lists all of the judges and their # of active cases, # decisions issued, # cases that are > 1 year old.
Appeal Events For a selected case, lists the events for that case in reverse chronological order. An event is generally a filing made by a party or an order issued by the ASBCA.
Appeals Docketed Lists the cases docketed by case number, government agency involved, case name, assigned judge, date case arrived at ASBCA, date docketed.
Appeals Disposed Lists cases that have been disposed from the ASBCA’s docket by case number, government agency involved, case name, assigned judge, disposition type, disposition date.
Appeals Reinstated Lists cases that were disposed, but which are not reinstated to the ASBCA’s docket during the time period specified, by case number, government agency involved, case name, date reinstated, type of reinstatement.
Attorney Appeal Association For any attorney who has appeared before the ASBCA, lists the active and/or disposed cases for which the attorney is listed as a representative.
Cross-Reference List by Appellant’s Name
For any case name that is entered, lists other cases with that same case name and lists the case status, assigned judge, and disposition date, if appropriate.
Disposed Motions for Reconsideration
For a specified time period, lists disposed cases that were before the Board on reconsideration by case number, government agency involved, case name, assigned judge, date of disposition, and type of disposition.
Dollar Amount of Active Cases Lists active cases by dollar amounts in specified categories, such as $100M or more, $50M- $99,999,999, etc. Lists case number, government agency involved, case name, assigned judge, dispute amount.
Foreign/Non-Conus Appeals by Lists each active case by case number, listing case
Appeal Number name, government agency involved, location, assigned judge, case status.
Foreign/Non-Conus Appeals by Country
For active appeals, alphabetically lists locations and lists the cases assigned to that location by case number, government agency involved, case name, assigned judge, case status.
General Statistics Report is usually run at the end of each month, calendar quarter, and fiscal year. For the time period specified, lists Active Appeal Statistics, with the government agencies listed and the number of cases docketed for that agency during the time period and the number of active cases for that agency; Dollar Amount of Active Cases, with the number of cases in each specified dollar amount category; Reinstatements, with the various types of reinstatements listed with the number of reinstatements this period and the overall number of cases that are reinstatements;
Active Case Status Breakdown, with the number of cases in each specified case status; Motions, with the number of each type of specified motion filed; Rule 12, with the number of small claims expedited or accelerated processing elections made and the number of active expedited or accelerated cases; Hearing Statistics, with the number of hearings held and the number of hearing days; Disposed Case Statistics, with the numbers of each type of specified case dispositions, and the number of dispositions for each specified government agency, number of dispositions for each case type, and number of cases disposed in each specified dollar amount category.
Hearing Calendar by City From a specified date forward, alphabetically lists hearing locations and the cases scheduled to be heard in that city. Lists city, state, hearing date, hearing length, hearing type, case number, government agency involved, case name, assigned judge.
Hearing Calendar by Hearing Date
From a specified date forward, lists scheduled hearings by date, listing hearing date, type of hearing, city, state, case number, government agency involved, case name, assigned judge.
Hearing Calendar by Judge From a specified date forward, lists each judge with hearings scheduled and lists the hearing dates, hearing length, type of hearing, case number, government agency involved, case name.
Hearing and Prehearing Conference Calendar
Usually run for a specified month, lists by day each hearing scheduled for that day. Lists case number, government agency involved, case name, assigned judge, type of hearing, hearing length, hearing location.
Individual Monthly Docket Report
For any or all judges specified, for the time period specified (usually current month), list the judge’s active cases by case number, government agency involved, case name, whether the case is consolidated, whether the case has been reinstated, dispute dollar amount, case status and status date, expected disposition date if entered, whether case has an expedited or accelerated designation, hearing date, length, location, if hearing is scheduled, pending dispositive motions and date each motion was filed, docket comments entered by judge. After the active cases, list all cases disposed by that judge during the specified time period, by case number, government agency involved, case name, type of disposition.
Pending Motions For active cases, categorized by judge, lists all specified motions that are pending ASBCA action. Lists by case number, government agency involved, case name, motion title and filing party, date motion was filed.
Ready to Write Within specified date ranges, such as “cases over one year old,” lists cases that are in a “ready for decision” status. Lists case number, government agency involved, case name, whether a hearing was held, hearing date and number of hearing days, assigned judge, date the case became ready for decision.
Rule 12 Decision Due Date Lists active cases with a “Rule 12” designation.
Lists the decision due date, type of Rule 12 proceeding, assigned judge, case number, government agency involved, case name.
Rule 12 Election Lists the active cases in which a “Rule 12” expedited or accelerated processing election was made during the specified time period. Lists case number, government agency involved, case name, Rule 12 type designation, Rule 12 decision due date, date of Rule 12 election, assigned judge.
6.2.5 Subtask 5. The Contractor shall perform all tasks necessary to migrate data from the existing ACTS Progress OpenEdge database into the configured CMS.
6.2.6 Subtask 6. The Contractor shall provide ASBCA personnel with its standard training and training documentation necessary to operate the ASBCA configured CMS. All in-person training shall be provided at the ASBCA’s offices. All documentation and software/media used for training must be approved by the Government and shall become the property of the Government upon delivery.

6.3 Task 3. CMS Software License Support.
6.3.1 Subtask 1. The Contractor shall provide the Government with its standard commercial software support, patches, and updates that it provides its other customers. The Contractor shall not perform support or apply software patches that prevent the CMS from being fully available for use by internal and external users 7 days a week, between 6:00 a.m. and 11:59 p.m., US East Coast time. The Contractor shall provide helpdesk support to the ASBCA and ALTESS during, at minimum, business days. See section 15 for definition of “business days.”

6.4 Task 4. Option Year - Government-Directed Software Security Updates
6.4.1 Subtask 1. During the Government’s continuous monitoring efforts, findings may arise that indicate the CMS is out of compliance with Government cybersecurity requirements. The Contractor shall provide assistance as required to ALTESS to implement needed updates to the CMS to meet the cybersecurity requirement or, if the updates are not possible, to define the findings as permanent exceptions to the requirement. Further, the Government may determine that the CMS and/or its hosting environment is vulnerable to a particular attack and may require an update to the CMS to thwart a possible intrusion. The Contractor shall provide assistance as required to ALTESS to implement any required updates to the CMS.

6.5 Task 5. Option Year - Additional Configuration Changes Requested by ASBCA
6.5.1 Subtask 1. The Contractor shall implement any additional CMS configuration changes requested by the ASBCA, provided that these changes are compatible with the CMS. These configuration changes may include, but are not limited to, additions or changes to workflows, statistical reports, and document templates.
6.5.2 Subtask 2. The Contractor shall provide ASBCA personnel with training and training documentation necessary to operate any configuration changes.

8. Place of Performance and Hours of Operation.
8.1 Place of Performance. CMS configuration work that requires coordination with ASBCA personnel shall be performed at the ASBCA’s offices at 5109 Leesburg Pike, Falls Church, VA 22041. The Contractor may perform work that requires coordination with ASBCA employees at a location of the Contractor’s choice, but only with prior approval by the COR. CMS installation or support that requires coordination with ALTESS personnel shall be performed at ALTESS’s facility on the Radford Army Ammunition Plant, Radford, VA 24143. The Contractor may perform work that requires coordination with ALTESS employees at a location of the Contractor’s choice, but only with prior approval by the COR.
8.1.1 Alternate Place of Performance - Contingency Only. As determined by the COR, contractor employees may be required to work at an alternate place of performance (e.g., home, the contractor's facility, or another approved activity within the local travel area) in cases of unforeseen conditions or contingencies (e.g., pandemic conditions, exercises, government closure due to inclement weather, etc.). Non-emergency/non-essential contractors should not report to a closed government facility. Contractor shall prepare all deliverables and other contract documentation utilizing contractor resources. To the extent possible, the contractor shall use best efforts to provide the same level of support as stated in the PWS.
8.2 Hours of Operation. For CMS configuration tasks, the Contractor is responsible for conducting business during such times as it sees fit. However, when the Contractor requires coordination with Government personnel to carry out its tasks, that work shall be performed during business days, unless the COR has provided prior approval to perform the work outside of business days. The Contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks within the PWS.
8.3 Travel: The Contractor may be required to travel to the ASBCA and/or to ALTESS during the performance of this contract to perform work, attend meetings, conferences, and training.
The Contractor will not be separately reimbursed for travel costs incurred during the base year of the contract. Base year travel costs shall be included as part of the Contractor’s proposed pricing for CLIN 0001. All option year travel shall be approved by the COR prior to the trip, and all travel shall support the task areas described above. All option year travel requirements (including plans, agenda, itinerary, or dates) shall be pre- approved by the Government (subject to local policy procedures) and is on a strictly cost reimbursable basis. Option year travel is cost-reimbursable and shall be billed in accordance with the regulatory implementation of Public Law 99-234 and FAR 31.205- 46 Travel Costs (subject to local policy and procedures; may reference FAR). Local travel reimbursement within a 50-mile radius of either the ASBCA or ALTESS is not authorized in support of this contract.
9. Period of Performance. The period of performance shall be for one base period of twelve months, beginning at contract award, with four 12-month option periods as follows:

11. Security Requirements. The work to be performed under this contract is Unclassified.
11.1 The Contractor shall not divulge any information about DoD files, data processing activities or functions, user identifications, passwords, or any other knowledge that may be gained, to anyone who is not authorized to have access to such information. Contractor personnel who visit the ALTESS facility shall be United States citizens. The Contractor shall observe and comply with the security provisions in effect at any DoD facility visited.
Identification shall be worn and displayed as required.
11.2 The Government retains the right to request removal of contractor personnel regardless of prior clearance or adjudication status, whose actions, while assigned to this contract, clearly conflict with the interest of the Government.
12. Government Furnished Property (GFP)/Government-Furnished Equipment (GFE)/ Government-Furnished Information (GFI).
12.1 Services. The Government will provide the following:
• ASBCA subject matter and technical experts to provide ASBCA-controlled information necessary for the Contractor’s configuration of the CMS.
• ALTESS-provided servers and infrastructure sufficient to host the software and support the implementation of the project.
12.2 Facilities and Utilities. The Government will provide workspace for the Contractor’s employees when they are working in government offices. All utilities in the facility will be available for the Contractor’s use in performance of duties set forth in this PWS. The Contractor shall instruct its employees in utilities conservation practices. The Contractor shall be responsible for operating under conditions that preclude waste of utilities.
13. Other Pertinent Information or Special Considerations.
13.1 Identification of Possible Follow-on Work. N/A.
13.2 Identification of Potential Organizational Conflicts of Interest (OCI). Contractor and subcontractor personnel performing work under this contract may receive, have access to, or participate in the development of proprietary source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflicts of Interest (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may effect other remedies as he or she deems necessary, including prohibiting the Contractor from participating in subsequent contracted requirements which may be affected by the OCI.

13.3 Identification of Non-Disclosure Requirements. All contractor and subcontractor personnel working on this contract must execute the non-disclosure agreement (NDA) located at Attachment 1 to this PWS within one week of contract award. The Contractor is responsible for obtaining and maintaining NDAs for each employee assigned to the contract. In each monthly report submittal, the Contractor shall affirm that all personnel, to include any new personnel on the contract, have executed the NDA.

13.4 Key Personnel. The Contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer.
The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available during business days.

13.5 Data Rights. The Government’s rights in all deliverables and information, including but not limited to, software applications, source code, databases, software documentation, training materials, forms, modules, user guides, reports, meeting minutes and other materials developed under this Contract shall be in accordance with the rights described in DFARS 252.227-7013, 252.227-7014 and 252.227-7020.
