52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

1. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

2. The agency intends to award an FFP order using the LPTA methodology. The sum of all requirement items will be the evaluated price for determining the lowest priced offer. Evaluation will only continue to higher priced offerings until the lowest priced technically acceptable and otherwise properly awardable offering is identified. The standards for determining technical acceptability are below, as well as information concerning price evaluations. The government reserves the right not to consider for award any quotation that does not adhere to the administrative requirements of the solicitation.

a. Technical Approach Factor: The technical subfactors will be evaluated and rated either acceptable or unacceptable. The following must be rated acceptable to allow for award.

i. The brand-name software products quoted must be exactly as requested.

ii. The quote must be from a small business.

iii. Resellers* shall provide a letter or email from the manufacturer that is no older than a year and confirms the authorized reseller status. Alternately, resellers may provide the manufacturer point of contact information associated with their quote, including name, phone number, and email address of the manufacturer representative.

1) *An authorized reseller is defined as an entity authorized by the manufacturer to sell the required brand-name software product(s) to the federal government and to provide support for said software products, including new releases, version upgrades, revisions, corrections of reported errors, enhancements (to include instructions for implementation and operation for all software support levels and product versions), technical support, contractor resolutions to problems or failures, and the most current commercial release or version of the software.

b. Price Factor: Price quotations will be evaluated to determine if they are reasonable and complete.

i. The government reserves the right, but is not obligated, to perform price realism analysis.

ii. The total evaluated price will consist of the contractor’s quoted price for all items.

iii. The government is requesting discounts to commercial list pricing. The proposed reduced pricing will not be subject to audit.

c. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there.

3. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

4. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)
