REDACTED JUSTIFICATION AND APPROVAL
TO PROCURE USING OTHER THAN FULL AND OPEN COMPETITION
Procurement Title: Dassian Software Maintenance
Upon the basis of the following justification, I, Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of 10 U.S.C. 2304(*)(*).
JUSTIFICATION
1. Agency and Contracting Activity. Agency:
Navy Enterprise Resource Planning (ERP) Program Office 47762 Ranch Road, Bldg 1490 Patuxent River, MD 20670
Contracting Activity:
Defense Information Systems Agency (DISA)/ Defense Information Technology Contraction Organization (DITCO) /PL8322 2300 East Drive Scott AFB, IL 62225-5406
2. Nature/Description of Action(s).
This Sole Source Justification is a follow on procurement for the annual maintenance renewal on Dassian Software Licenses. This is a firm fixed price contract funded with FY13 Operations & Maintenance, Navy (OMN) funds.
3. Description of Supplies/Services.
Dassian Earned Value Management (EVM) software provides reporting and budgetary functionality that is required by the Office of Management and Budget (OMB) and DoD financial systems. OMB and DoD mandate that Acquisition Category (ACAT) I Programs manage and track their financial processes utilizing earned value management processes. DASSIAN Software provides the functionality required to meet OMB and DoD mandates.
This justification and approval (J&A) authorizes and approves the issuance of a Sole Source order for the annual maintenance renewal of Dassian licenses which were originally procured under contract N00421-07-F-0236. Maintenance has been previously awarded on contracts HC1028-08-P-2136 and HC1028-09-P-2157. The period of performance is date of award through 14 Feb 2014, Navy ERP wishes to obtain 4 option years.
4. Identification of Statutory Authority.
Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C.2304(c)(1). (FAR 6.302-1/DFARS 206.302-1);
5. Demonstration of Contractor’s Unique Qualifications.
(a) Description of events:
Navy ERP fully implemented Dassian as the Earned Value Management (EVM) software tool which has a fully integrated code that is written and imbeded in the SAP Advanced Business Application Programming Language (APAB). Integrated code reduces the risk of data loss and software failures that may occur during maintanence, patches, and upgrades between software suites that do not have an integrated code. DASSIAN is the only product that meets this requirement because only DASSIAN is written in the same programming language and utilizes the common architectural software components as SAP.
(b) Justification:
SAP is the core enterprise resource planning software currently in use by Navy ERP and is a very large complex software package that requires substantial amount of maintenance on the part of the customer as well as SAP. SAP provides for frequent patches and upgrades to the entire suite of software and because the software is integrated, SAP provides for consolidated support of the suite which assures that all of the software will still function after patches and upgrades are implemented. This would not be the case for other EVM products. Other EVM products would require interfaces to Navy ERP’s core software solution and these interfaces would require maintenance or rewriting with structured testing for every patch and upgrade. There would be no assurance from either the core software vendor (SAP) or other EVM vendors that any upgrades or patches on those EVM products could actually be implemented. Without the DASSIAN software, mulitple Navy ACAT I programs would be unable to provide OMB and DoD with the required financial reports, thus putting their commands/programs at risk for non-compliance. Non-compliance with OMB and DoD mandates results in the withdraw of program funding.
6. FedBizOpps Announcement/Potential Sources.
a. The synopsis of this action will be published on FedBizOpps website as required by the Federal Acquisition Regulation (FAR) IAW Subpart 5.2. The synopsis will completely identify the Government’s minimum mandatory requirement.
b. The Government does not anticipate any other qualified sources; however, should any responses be received, they will be evaluated to determine if they are fully responsive to the Government's stated minimum requirements and will be considered by the Government prior to proceeding with an award. This proposed procurement is the only known approach to license and maintain the proprietary software.
Dassian is the manufacturer and maintains sole proprietary rights to the Dassian Tool. No other vendor, reseller or distributor is legally authorized to sell Dassian licenses or maintenance.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will make a determination that the anticipated cost to the Government is fair and reasonable based on comparison to the Independent Government Cost Estimate (IGCE), historical prices, and commercial price lists.
8. Description of Market Research.
Market research was conducted January 2013 by the Navy ERP to determine if there were authorized resellers of the required software maintenance. Through communications with Dassian the conclusion was Dassian is the manufacturer and sole distributor of Dassian support and maintenance.
9. Any Other Supporting Facts. Navy ERP has fully implemented and integrated Dassian as the Earned Value Management (EVM) tool for the Navy. The tool provides OMB and DoD financial reports required to support the programs yearly request for continued funding support. The cost to the Government to introduce and implement new software and re-train the current end-user base across multiple Navy commands for a fully functional product serving its purpose with no known deficiencies or short comings is not prudent or cost effective for the government.
10. Listing of Interested Sources.
Dassian is the manufacturer and maintains sole proprietary rights to the Dassian Tool. No other vendor, reseller or distributor is legally authorized to sell the Dassian software designed/developed for SAP. Dassian provided their sole source letter.
11. Actions Taken to Remove Barriers to Competition.
Navy ERP will continue to renew the maintenance on an annual basis and market research will be conducted as required to determine all authorized re-sellers of Dassian software maintenance in order to compete the award
(a) Procurement History:
(1) HC1028-09-P-2157 – from 15 Feb 2009 – 14 Feb 2013 (including all option years) (2) This was awarded as a sole source contract because there is only one seller and the manufacture does not allow resellers.
12. Reference to the Approved Acquisition Plan (AP)/Program Plan (PP).
An Acquisition Plan is not required for this procurement.
