JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)
LIMITED SOURCES JUSTIFICATION
Justification for OTFAOC Number: JA12-009
Upon the basis of the following justification, I, as Procurement Activity Competition Advocate, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of Title III of the Federal Property and Administrative, Services Act of 1949 and Title 40 U.S.C. §501, Services for Executive Agencies.
JUSTIFICATION
1. Requiring Agency and Contracting Office:
Requiring Agency:
Defense Information Systems Agency (DISA)/DWCF TSEAS Financial Operations Division, Chief Financial Executive (CFE8), 2300 East Drive, Scott AFB, IL 62225.
Contracting Activity: Defense Information Systems Agency (DISA)/Defense Information Technology Contracting Organization (DITCO), 2300 East Drive, Scott AFB, IL 62225.
2. Nature/Description of Action(s):
This is a logical follow-on contract to The DataTech Group, Inc, which is a small, woman-owned, U.S. business in the Asian-Indian American ethnic group category. The original requirement was competitively awarded under the GSA Multiple Award Schedule Program. The contract for the original requirement was GS-35F-0191M, delivery order HC1013-04-F-5304 with a period of performance 22 Jun 2004 – 31 Aug 2005 in the amount of $897,695.30. There were two follow-on, sole source delivery orders: HC1013-05-F-2843 with a period of performance 31 Aug 2005 – 31 Dec 2008 in the amount of $3,171,3939.76, and HC1028-09-F-2130 with a period of performance 30 Dec 2008 – 30 Apr 2012 in the amount of $4,826,982.40. These contracts supported the continued progress on the Telecommunications Services Enterprise Acquisition Services (TSEAS) Inventory and Billing Information (TIBI) application to enhance and maintain the TIBI application via operations and maintenance (O&M) funds. In addition, HC1028-09-F-2130 added capital funds to begin integration of non-telecom web views and data with the existing telecom web views and data with a goal of integrated TSEAS customer inventory and billing information. These contracts were firm fixed price. The two follow-on contracts were not re-competed per justification documents provided with those packages and approved by DITCO Legal Office and the Procuring Activity Competition Advocate.
This follow-on contract’s base year period of performance is 1 May 2012 through 30 Apr 2013. There will be two option periods, 1 May 2013 through 30 Apr 2014 and 1 May 2014 through 30 Apr 2015. CFE8 is requesting the contract be set up with a base and two option years to allow for the flexibility to adequately complete the capital portion of the project described above and to support known requirements to transition the TIBI application from legacy data sources to new data sources coming from the DISA Enterprise Procurement System (DEPS) currently being developed under the Enterprise Business Modernization (EBM) program, the new financial system being developed under the Defense Agency Initiative (DAI), and Network Services’ Order Entry/Order Management (OE/OM) program.
This contract is also a firm fixed price with a cost of $2,391,744.00 for the base year, $2,370,798.40 for option period one, and $2,004,825.60 for option period two.
3. Description of Supplies/Services:
The services to be provided under this contract are a continuation of services currently provided under contract HC1028-09-F-2130 in order to complete the capital project and sustain the entire application. The capital project, non-telecom portion, along with sustainment of the telecom portion, will take place during the base period and the majority of option period one. Full sustainment operations of both non-telecom and telecom shall take place during the last couple months of option period one and all of option period two. Contract cost details for the base and option periods are outlined above in paragraph 2.
The DataTech Group shall provide configuration management, analysis, design, development, database, testing, implementation, and documentation support dedicated to enhancing and maintaining the TIBI application web views, metrics reporting, and interface changes.
4. Identification of Statutory Authority and Demonstration of Contractor’s Unique Qualifications:
41 U.S.C. §251, Title III of the Federal Property and Administrative Services Act of 1949 and Title 40 U.S.C. § 501, Services for Executive Agencies.
5. Best Value Determination:
The DataTech Group, Inc., a small business, is uniquely qualified to provide the services outlined in section 3 to the Defense Information Systems Agency. They have developed the TIBI application from the initial pilot application into a fully functioning operational system under three predecessor delivery orders (HC1013-04-F-5304, PoP 6 Jul 2004 – 31 Aug 2005; HC1013-05-F-2843, PoP 1 Sep 2005 – 31 Dec 2008; and HC1028-09-F-2130, PoP 1 Jan 2009 – 30 Apr 2012), and they are the only contractor to have done so. Over the course of these past seven plus years, The DataTech Group has developed each functional area of the application and in so doing has gained intricate knowledge of the unique functional business processes supported by the application as well as the technical details of the application. The application supports the unique requirements associated with the TSEAS business area such as the automated billing of the Defense Information Systems Network (DISN) Subscription Services and Enhanced Mobile Satellite Services (EMSS) Short Burst Data, and maintenance of Program Designator Codes and associated customer billing addresses and lines of accounting; The DataTech Group worked closely with the government to gain an understanding of these business processes in order to automate them. The DataTech Group’s technical expertise in Data Mining and Transformation allowed them to successfully fulfill the Defense Information Systems Agency's requirements. This knowledge provides The DataTech Group the ability to quickly respond to system errors, maintenance issues and requests for enhancements ensuring the system is maintained with minimal impact to customers.
The enforcement of the DITCO Policy Letter dated 8 Aug 2008, Submission of Telecommunication Service Requirements and Information Technology Product and Service Requirements for Procurement by DITCO Contracting Offices, caused DISA/CFE8 internal and external customers to voice a passionate interest in the development of a reporting tool for non-telecom requirements since the TIBI application previously only provided extensive reporting and search capabilities for the telecom business area only. Customers requested real-time Telecommunication Services Enterprise Acquisition Services (TSEAS) contractual and billing information/reports, via the TIBI web application. This included the ability to search, display, and extract financial and contracting data (i.e., contract number, sale number, sale adjustment number, project, invoice number, and SF1080); the ability to view amount of funds accepted on the funding document, amount available and amounts subject to availability if applicable; the ability to view amount of funds obligated, the amount of excess or un-obligated funds on a contract and to view contract modifications impacting the obligation of the funds; the ability to view accounts payables (AP) posted to each funding document; the ability to view all transactions that have impacted the customer's funds; and the ability to view all cost data. The accessibility of this information is invaluable to DISA and its customers to meet the demands by OSD and DoD for auditable financial statements. With DoD budget cuts, it is imperative that DISA/CFE8 provide accurate and complete data that customers can rely on via an application that they are already using and familiar with. Thus, the goal for TIBI is to include both the telecom and non-telecom activity, which affords DISA and its customers with an all inclusive TSEAS reporting vehicle.
The DataTech Group possesses unique, in-depth knowledge of the TIBI application. The DataTech Group has already started the non-telecom incorporation with Release 1 in February 2012. The incumbent contractor can continue to provide support without delay, ensuring schedules are met and costs remain within budget for critical ongoing tasks. Changing contractors would cause schedule delays in being able to meet full operating capability of the non-telecom incorporation. Based on the initial training provided to the contractor and the business knowledge gained, it is estimated that it would take another contractor at least six months to learn how the application functions as well as the intricate data interfaces in order to perform at the level of the incumbent in all functional areas. This ramp-up time that would be required by another contractor would produce an unacceptable delay and increased costs in fulfilling the Defense Information Systems Agency's requirements. Ongoing telecom efforts including the enhancement of telecommunications statistical sampling, automating mass funding update functionality, EMSS administrative functionality, and interface changes for modernization efforts are at a critical juncture which requires enhancements to TIBI by July 2012. In addition, Release 2 of the capital project (non-telecom effort) is planned for June 2012. It is important to note that milestone dates for the capital project are critical because cost, schedule, and performance are reviewed and approved by the CIO. And although TIBI’s interface changes are part of its O&M funds, TIBI must make interface changes from legacy systems to capital funded enterprise modernization systems and therefore, those system’s CIO milestones will be imposed upon TIBI as a collaborative enterprise modernization effort. Delays that could be prevented affect DISA’s integrity, customer support, and stewardship track record of authorized funds for all efforts.
Therefore, it is not possible to change or split contractors and meet these schedules. Delaying these automation efforts would result in increased manpower costs to the Agency. It is estimated that it would cost $1,408,000 to train a new team of individuals to be able to perform at the level necessary to accomplish this work in a sufficient manner. This cost is based on ten new individuals with no prior application or functional knowledge needed to be trained by two GS13 functional leads that possess knowledge from the initial telecom development effort, the maintenance tasks that have occurred since final operating capability of the telecom portion, and the functionality that has been incorporated during initial operating capability of the non-telecom portion. This effort alone would take at least 6 months of the new contractor’s time plus cause issues in meeting normal GS13 workloads if those individuals were dedicated to this training. In comparison, current contractor possesses all of the historical and functional knowledge as well as being familiar with the databases from which requirements are retrieved today, which eliminates 6 months of extra work and allows the government to meet program management release deadlines by mid-year 2012.
Accordingly, based on the above, even though the contractor does not have proprietary or development rights, the planned source is the only source that can perform this effort without both substantial duplication of cost and unacceptable delay.
Estimated costs are based on historical data from the previous contracts, and an Independent Government Cost Estimate (IGCE) will be submitted to the contracting officer for comparison in determining the proposed prices are fair and reasonable accomplished using GSA Schedule GS-35F-0191M.
6. Market Research:
Details are outlined in this document and the market research report that accompanies this acquisition package. Executive summary and outcome: The DataTech Group, Inc. is the best value to the government for the TIBI contract during a one year base period of 1 May 2012 – 30 Apr 2013 with two option years at CFE8 Scott AFB. This contractor satisfies the small, woman-owned business goal. Labor category and rate comparisons for skill sets needed on this project also support best value. The DataTech Group has the necessary experience in providing specialized TIBI application development support for this effort to meet critical milestones, and incumbent contractor has an outstanding past performance record.
