52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

Award will be made to the responsive, responsible offeror whose quote conforms to this solicitation and represents the "Best Value" to the Government. Best Value means the expected outcome of the acquisition that, in the

Government's estimation, provides the greatest overall benefit in response to the requirement.

The following evaluation factors in descending order of importance will be used to evaluate offers: (1) Technical capabilities: Documented Experience,Course Program of Instruction (POI), and Certifications, (2) Past Performance and (3) Price. Technical capabilities and past performance, when combined, are more important than price.

However, award will not be made without consideration of fair and reasonable pricing. An offer will be considered unacceptable if evidence of technical capability and past performance are not met.

Technical Capability will be evaluated on an Outstanding, Good, Acceptable, Marginal and Unacceptable basis. In order to be considered technically acceptable, offers must be rated as Outstanding, Good or Acceptable. Past

Performance will be evaluated on a Low, Moderate and High rating basis. The following are the definition of each rating:

Outstanding: Offer meets requirements and indicates an exceptional approach and understanding of the requirements.

The proposal contains multiple strengths and no deficiencies.

Good: Offer meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains at least one strength and no deficiencies.

Acceptable: Offer meets requirements and indicates an adequate approach and understanding of the requirements.

Proposal has no strengths or deficiencies.

Marginal: Offer does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements.

Unacceptable: Offer does not meet requirements and contains one or more deficiencies and is unawardable.

Low risk: Has little potential to cause disruption of schedule, increased cost or degradation of performance. Normal contractor effort and normal Government monitoring will likely be able to overcome any difficulties.

Moderate risk: Can potentially cause disruption of schedule, increased cost or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome difficulties.

High risk: Is likely to cause significant disruption of schedule, increased cost or degradation of performance. Is unlikely to overcome any difficulties, even with special contractor emphasis and close Government monitoring.

(1) Technical Capabilities. The two sub-factors are Documented Experience and Course POI. The

Government shall evaluate the accuracy and extent to which the proposal demonstrates a complete understanding of the requirements of the SOW and conveys methodologies, techniques and a detailed technical approach that enhances the likelihood of satisfactory performance and performance quality. The contractor shall include as part of their documented experience the licenses and certifications to support their capabilities as stated in paragraph 4 of the statement of work.

(2) Past Performance. Past performance is a measure to which an offeror satisfied its customers in the past and complied with Federal, state, and local laws and regulations. The Government reserves the right to contact any or all references provided by the offeror to ask whether or not they believe: (1) that the offeror was capable, efficient, and effective; (2) that the offeror's performance conformed to the terms and conditions of its contract; (3) that the offeror was reasonable and cooperative during performance; and (4) that the offeror was committed to customer satisfaction.

Past performance information must be recent relevant. To be recent, the service must have been provided within the last three (3) years. The most relevant contracts will be those which most closely match the scope, magnitude and complexity of this requirement. The Government may not necessarily agree with the offers as to the relevancy.

(3) Price. Overall total price will be evaluated for fairness and reasonableness. Price shall include a firm fixed price for all labor support and cost for travel forecasted in accordance with the SOW for the performance period of a base period(date of award – 30 Sep 11) and four 12-month option periods.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (APR 2011)
