General Services Administration National Capital Region GSA White House Center

Justification for Other than Full and Open Competition

1. Identification and description of action being approved

GSA’s White House Service Center requires the use of Upton Studios LLC to restore the Navy Dome. They are the only firm that can clean the glass using conservation guidelines, replace damaged glass, work with the removal of lead paint and do repairs on leaded glass all within one company.

2. Description of supplies or services required

The service required fits into a very small time frame. The named company is able to deliver all services within the allotted time frame. The glass repair is intricate and involves the restoration of very unique, historic material. There are no other firms that can remove lead, repair leaded glass of this high quality caliber strength.

3. Identification of statutory authority

41 USC 253( c ) (2): Unusual and Compelling Urgency

(2) When the agency’s need for supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
(b) Application. The authority applies in those situations where—
1. An unusual and compelling urgency precludes full and open competition; and
2. Delay in award of a contract would result in serious injury, financial or other to the Government.

4. Demonstration that the acquisition requires the use of the authority cited

GSA must restore this space while conforming to Section 106 of the Historic Preservation Guidelines. This Space is one of a kind and work must conform to the Secretary of Interior Standards.

5. Demonstration of efforts to solicit as many offers as practicable

Offers were not solicited for the repair aspect of the award, due to the nature of the requirements.

6. Demonstration that the anticipated cost will be fair and reasonable

An independent Government Estimate in the amount of $29,925 which includes complete adherence to the SOW has been prepared by the GSA White House Service Center. The proposed price shall be evaluated against the IGE in order to determine reasonableness.

7. Demonstration of Market Survey Conducted.

A search on the GSA Advantage website revealed 2 firms capable of performing network support services for the proper historic restoration. Upton Studios is the only firm to be able to accomplish each portion of restoration.

8. Other facts supporting the use of other than full and open competition

It would not be in the Governments best interest to award an order to any other vendor, as only Upton Studios will guarantee the work that is required for repairs. There are other firms that can do portions of individual work require; only Upton Studios meet the historic criteria and can handle all of the work required in the scope.

9. List of sources that expressed an interest in the acquisition

Upton Studios. LLC is the only firm that has ability to do all the work required.

10. Statement of action to overcome barriers to competition

There are no perceived barriers to future competition for similar projects
