functioning properly and need to be replaced. CMB currently has a base + four option year preventative maintenance and service contract with Getinge.

Getinge services all the NIAID CMB autoclaves on the Bethesda campus, including Animal Biosafety Level 2 (ABSL2) and ABSL3 autoclaves. The control boards on these autoclaves are now obsolete, and the control boards are not an item that Getinge covers under the service contract. To restore these autoclaves to full functionality, the control boards and valves must be replaced as soon as possible.

b. Project background.

All aspects of infectious diseases, including pathogenesis in human and animal hosts is studied by the DIR scientists. The CMB has an ongoing maintenance agreement to maintain and repair its autoclaves. Two CMB autoclaves have obsolete control boards and valves that cannot be upgraded. The autoclaves are currently running at minimum operations since the control boards can no longer function at 100% efficiency. Staff must manually pull and push the doors and the door switch which is an extreme safety hazard. Control boards are not included in the service contract. Getting uses proprietary equipment.

Contact boards, etc., on their autoclaves. Therefore, this is the only known company that can provide an upgrade with Getinge parts. Getinge has stated they will no longer support the existing control boards and must be replaced.

They will continue to maintain the existing controls as long as possible, but when they fail, the autoclaves will cease to function.

This is a follow-on requirement to purchase two (2) control boards and pilot valves to ensure the autoclaves is functioning properly. Previous purchase for other replacement autoclave parts was a non-competitive award made to Getinge USA Sales LLC.

b. Nature of the acquisition and proposed unique qualifications of the contractor(s).

Getinge is the original manufacturer of the autoclaves and the direct provider of service specific to their instruments. Furthermore, using vendors other than Getinge could lead to the autoclaves becoming non-functioning and unrepairable, causing the Government to spend additional funds to repurchase needed equipment for the labs experimenting processes. Getinge uses proprietary equipment, control boards, etc., on their autoclaves. Therefore, this is the only company that can provide an upgrade with Getinge parts. This company sells directly to the public and is the sole source of the parts needed. There are no authorized third-party service providers. Thus, only Getinge USA Sales, LLC as the only source available to the Government for this requirement.

6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a SAM.gov notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.

As required by FAR Subpart 5.2, a Pre-Solicitation (Notice of Intent to Sole Source) was publicized via SAM.gov (formerly FedBizOpps) under the following Record ID: NOI-NIAID-23-2167756. The notice announced the Government’s intent to purchase two (2) control boards and pilot valves from Getinge USA Sales, LLC instruments on a non-competitive basis. Responsible sources who could provide comparable services were provided an opportunity to respond with a capability statement. If a reasonable capability statement from another source was provided, the intent was then to post a Request for Quotations on a full and open competition basis. NIAID received one response from the NOI. After review of the information submitted, it was determined that this company does not meet NIAID’s minimal technical requirements.

7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.

The techniques identified at FAR 13.106-3(a)(2) will be used to ensure award will be at a fair and reasonable price. NIAID will consider the Independent Government Estimate, market research, comparison with similar items in the marketplace, and quoted prices found reasonable on previous purchase as determining factors for price reasonableness. A final determination by the Contracting Officer will be conducted prior to award of a purchase order.

8. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.

The Program Office conducted the initial market research by reviewing CMB’s existing Getinge instruments and their maintenance agreements. After scanning the market for alternatives, their research concluded that Getinge USA Sales, LLC is the only source that can meet CMB’s requirements. The Contract Specialist viewed the required sources, Federal Supply Schedules, NIH strategic sources, and commercial websites and found that Getinge USA Sales, LLC is the only known source where NIAID can purchase the control boards and pilot valves.

Additional market research by the Contract Specialist included reviewing previous purchases for similar requirements, contacting knowledgeable Government and Industry professionals. Additionally, the NOI did not reveal alternative sources that could meet NIAID’s minimal technical requirements for purchasing the control boards and pilot valves.

9. Any other facts supporting the use of other than full and open competition.

None

10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition.

One vendor submitted a capability response to the NOI, they do not meet the minimal technical requirements.

11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the required supplies or services.

NIAID’s policy is to promote the use of competitive procedures whenever and wherever possible. In an effort to remove or overcome barriers to competition in
