Exception to Fair Opportunity Template Update AUG 2017
JUSTIFICATION for an EXCEPTION to FAIR OPPORTUNITY for the placement of an order >$150K under a Multiple Award Contract (MAC)
Upon the basis of the following justification, I, Sharon Pritchard, as Competition Advocate at SPAWARSYSCEN, Pacific, hereby approve the Justification for an Exception to Fair Opportunity Pursuant to FAR 16.505(b)(2).
JUSTIFICATION
l. Agency and Contracting Activity. Department of the Navy, SPAWARSYSCEN, Pacific.
2. Nature/Description of Action. This is a fair opportunity exception to place an order with Geocent under multiple award contract number N66001-17-D-0157. The task/delivery order number is TBD.
3. Description of Supplies/Services.
This request is to issue a logical follow-on task order to Geocent to provide engineering, management, and technical expertise in support of Commander, Navy Installations Command (CNIC) Naval Facilities Engineering Command (NAVFAC) Anti-Terrorism/Force Protection (AT/FP) COHORT Program Support. The COHORT is an organization that is flexible in solving problems and issues while driving technical solutions. The COHORT consists of Subject Matter Experts (SMEs), technicians, engineers, developers, and administrators that allow the program to meet surging design, implementation, Tier 3 issues, accreditation, and enterprise needs. The COHORT has been instrumental in getting 30+ gates to Interim Operational Capability (IOC), engineered for regionalization, and positioned for Enterprise Physical Security Information Management (E-PSIM) implementation, and Full Operational Capability (FOC).
Services under the task order include engineering and technical support services which provide technical and operational expertise for the deployment and initial operational testing/burn-in of the Automated Vehicle Gates (AVG) system and to provide expanded support to the Counter Unmanned Aerial Systems (Counter-UAS). Tasks also include providing expertise on Programmable Logic Controllers (PLC), security systems integration, Operational Testing (OPTEST) and burn-in testing oversight, remote help-desk troubleshooting, gate automation training, computer aided engineering/design and sensor management and display systems. The AVG effort is meant to save manning costs by reducing the number of people required at a vehicle gate. Based on the added security benefits and reduced overall costs, CNIC has placed a higher importance on the AVG effort and has directed that the project achieves Full Operational Capability (FOC) in FY18 necessitating an accelerated schedule. To date, twenty installations have been completed and an additional ten more are planned to be completed in FY 18.
The work for this follow-on task order is similar in scope, in terms of the types of tasking to be completed when compared to the work currently being performed by Geocent under task order N66001-17-F-1084. The current task order was awarded on 29 September 2017 in the amount of with a 12-month period of performance (PoP).
(b) (8)
The value of the follow-on task order is estimated to be approximately with a PoP of 12 months. The increase for this follow-on is due to the increased need for engineering, management and technical support during the deployment and FOC of the AVG systems as well as for increased support for the Counter-CAS.
4. Identification of the Exception to Fair Opportunity. (FAR 16.505 (b)(2))
Identification/Justification for Exception:
a. The agency need for services is of such urgency that providing fair opportunity would result in unacceptable delays.
b. Only one such awardee is capable of providing such services required at the level of quality required because the services ordered are unique or highly specialized.
c. The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the MAC, provided that all the awardees were given fair opportunity to be considered for the original order.
1. The follow-on task order is almost the same in terms of the type of work being performed when compared to the previously awarded task order (N66001-17-F-1084).
All engineering and management tasks in the follow-on effort will be a continuation of those in the previous task order. The basic scope of both task orders is to provide engineering, management, and technical expertise in support of CNIC/NAVFAC Anti- Terrorism/Force Protection (AT/FP) projects. The follow-on task order is needed to support the AVG projects due to increased importance of the project by CNIC and due to the increase in the number of AVG installations scheduled for the remaining of
FY18.
2. The original task order, N66001-17-F-1084, was awarded under a multiple award contract that provided all awardees a fair opportunity to be considered. No-bid responses were received from BAH and Solute. BAH stated that they did not possess the qualified staff for the requirements and would not submit a proposal and Solute also stated they did not have personnel with the required skills needed in order to submit a proposal. Based on the competition history from the previous task order, it is unlikely that more than one bid would be received should this new task order competed.
Furthermore, the original task order proposal submitted by Geocent was evaluated by the Technical Evaluation Board and determined to be technically acceptable.
3. Although the current task order has a period of performance of 12 months, Geocent is consuming funds under the task order at a much quicker rate than originally anticipated.
After the Geocent team installed the AVGs at approximately twenty sites, the contractor was also required to make multiple unplanned visits to several sites in order to fix network issues created by changes to the Public Safety Network (PSNet). The PSNet networks are managed by CNIC N6 Information Technology Department and the contractor’s installation team has no ability to control these network changes.
Additionally, there was a major software change to the PLC controllers after a number of installs which required addition effort by Geocent. As a result, unplanned resources and additional hours were required to solve problems integrating the CNL IP Security Center software into the Development Unified Computing System (DUCS).
4. Due to unplanned events detailed above, project funding of the initial task order is expected to be completely exhausted on or around 15 May 2018 which is roughly five months sooner than originally anticipated. Based on this enhanced timeline and increased workload, the estimated value (magnitude) for the follow-on task order has increased in order to accommodate the accelerated development and installation schedule. Also, the additional projects are part of a new phase of the NAVFAC AT/FP work to counter the threat from unmanned aircraft. This effort is called Counter UAS (Unmanned Aircraft Systems) and the work will focus on development of the technology to detect, track, and target slow and small unmanned aircraft systems (drones).
5. Furthermore, under the current task order Geocent is responsible for providing services required to support the AVG project, specifically focused on technical and operational support for the deployment and initial operational testing / burn-in of the AVGs.
Support includes expertise on PLC SME, security systems integration, OPTEST and burn-in testing oversight, remote help-desk troubleshooting, gate automation training, and computer aided engineering / design expertise. The services under the follow-on task order will be the same. However, as explained above, CNIC changed some mandated software requirements and added an additional ten AVGs in FY18 which must be in Full Operational Capability (FOC).
6. It is imperative that the same contractor perform the continued services for the remaining ten AVGs. Geocent is currently the only MAC holder has the technical knowledge, experience and involvement with the AVGs projects to be able to successfully provide continued services for the remaining installations, while also being able to meet the expedited timeline, without causing significant delays in the schedule and without significantly increasing costs.
7. It is estimated that it would take approximately 3-4 months of training if a different MAC holder were to perform the design work in accordance with NAVFAC AVG requirements. This delay would not only cost an estimated additional see table below for details) but would also result in a direct impact to the increased installation schedule for the remaining AVGs planned for FY18. Currently, CNIC has a target date of 30 September 2018 for the project to achieve FOC. Any delays in the follow-on task order would result in interruptions to CNIC and NAVFAC’s overall AT/FP mission which would in turn result in potential security vulnerabilities.
Estimates above are based on the IGCE and the previous task orders under the Net-Centric MAC.
8. This exception to the fair opportunity process meets the interest of economy and efficiency by awarding to a vendor that is already familiar with the existing system and will not require additional time and expense to become familiar with the system under development.
d. It is necessary to place an order to satisfy a minimum guarantee.
e. For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.
5. Determination of Fair and Reasonable Cost. Based on the historic cost information currently available, the contracting officer has adequate information to ensure that the cost to the government for this acquisition will be fair and reasonable.
6. Any Other Facts Supporting the Justification. This task order requires subject matter experts, technicians, software and system engineers who have knowledge of the NAVFAC AT/FP COHORT program. Geocent has demonstrated this capability during the original award and the work performed to date. Geocent has gained both technical and project management experience of the AT/FP COHORT as a result of recent testing of the Development Unified Computing System (DUCS) Physical Security Information Management (PSIM) system installation & integration with the AVG subsystems. This knowledge would be difficult for a new awardee to gain until the next integration test.
7. Actions Taken to Remove or Overcome Barriers that Led to the Exception to Fair Opportunity. The Government will continue to monitor the competitive environment to ensure that all contractors under this MAC receive maximum opportunity to submit competitive proposals to future requirements.
