Brand Name/Sole Source Justification under $250K

PMD Number: FY22-29911

Department: Air Dominance Department

Company Name/Brand: BRAND NAME: Leica Geosystems Inc.

Description of Product, Supplies or Services required to meet the agency’s needs:

Total stations are optical instruments (similar to an optical theodolite used in surveying roads), which make precision measurements. Specifically, they measure horizontal angles, vertical angles, and distance. The Combat Systems Alignment (CSA) team, in Air Dominance Department, code A83 utilizes total stations to perform optical survey work on US Navy ships, other ships, and on land-based facilities in support of the US Navy/DoD mission.

Identification of Justification Rational:

☒ The Material or service must be compatible will aspects (Form, Fit, and Function) with existing systems presently installed.

☐ A patent, copyright, proprietary data, or licensing agreement limits competition.

☐ These are “direct replacement(s)” parts/components for existing equipment.

☐ Urgency.

Identification of the Justification Rationale Explained: **If using form, fit, and function, describe the current equipment and how the new item/service must coordinate or interface.

**If using patent, copyright, proprietary data, describe the proprietary data. **If using direct replacement, describe this below.

The total stations are needed now for two main reasons: 1) the CSA team is currently short on total stations so, in addition to the current inventory of total stations, the team is currently using some older Leica total stations to supplement the need and help fill the gap. Those older Leica total stations are failing at a rate which will jeopardize the team’s ability to perform CSAs for the fleet and there is too much risk if the team doesn’t increase total station inventory now; and 2) work load. The number of CSAs is increasing and the CSA team must prepare now to address the ensuing greater demand.

The CSA team can only use Leica branded total stations to meet requirements since, measurement equipment, in order to perform Combat Systems Alignments (CSA), must be US Navy certified/compatible and listed within the Navy METrology and CALibration database (METCAL system, also known as “METRL”). This process of certification is costly and time consuming both in terms of “touch time” and “calendar” time. Leica total stations have been certified as compatible and are listed within the Navy METCAL/MTRL database. No other brand of total stations have been certified.

Specific Characteristics of the Item or Service required that Limit the Availability to a Sole Source or Brand Name: **This is the most important section. Explain in detail why this company or brand are the only ones that can meet the requirement.

We must procure the Leica brand of total stations as there are no other brand name total stations in the US Navy’s METCAL/MTRL data base. The Combat Systems Alignment Branch has previously invested approximately $217,000 and spent more than three years (2017-2021) to certify a Leica total station for the Navy METCAL system. Based on this, procuring another brand of these total stations would result in a substantial duplication of cost of approximately $217,000 and an unreasonable delay of at least 2 years. The substantial duplication of cost is not expected to be recovered through competition and, the delay is unreasonable since the Combat System Alignment team has an immediate need to increase its inventory of total stations. A 2 year delay in procuring the required total stations would result in the CSA team’s inability to keep up with current, and future increased demand to perform CSAs. This would have a direct and immediate impact on ship and ground-based combat system readiness.

Market Research Conducted:

All mandatory sources were checked. In addition, inquiries were made of four other companies.

None of the following were able to supply the equipment kits we need: Selby’s in Billings, Montana and Geomatic Resources in Irving, Texas. However, Leica Geosystems of Costa Mesa, CA and Kuker-Ranken in Seattle provided estimates which are part of the PR package – both stated they can provide everything we need.

Statement of Actions, if any to Remove Barriers to Competition in the Future:

NSWC PHD Contracts Office will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
