About this file

This document is a Justification and Approval (J&A) for a sole source contract award. The Naval Sea Systems Command, Naval Surface Warfare Center Indian Head Division requires annual maintenance and repair services, system updates, and advanced training for twenty Griffin 460 Gas Chromatography-Mass Spectrometry instruments. This includes extended warranties, training, spare parts, and other consumables totaling an estimated $2,050,807 over a one-year base period and three one-year option periods. A pre-solicitation notice and sources sought notice yielded no alternative providers. The services must be performed by the original equipment manufacturer, FLIR Detection Inc., to maintain system warranties and technical expertise. The contracting officer will determine costs to be fair and reasonable based on pricing data from prior contracts. There are currently no plans to introduce future competition due to system compatibility and support requirements.

4. Statutory Authority Permitting Other Than Full and Open

Competition

This acquisition is being conducted under the authority of

10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1. Only One Responsible Source.

5. Rationale Justifying Use of Cited Statutory Authority

This is a follow-on acquisition from previously awarded sole source contract N00178-18-C-6034. The Griffin 460 GC/MS instruments are part of a critical life safety system. It is critical that Griffin 460 GC/MS instruments’ extended warranties, parts, and training are procured annually to ensure the operational capabilities of the systems. This procurement is required to satisfy specific mission requirements related to National Security, in direct support of currently fielded equipment. Inability to procure extended warranties, training, and parts could produce an unacceptable vulnerability in the Chemical, Bioloical, and Radioloical (CBR) Sensor System, which is a critical life safety system. It is also essential for R23 personnel to maintain excellent technical proficiency in operation and maintenance capability of Griffin 460 GC/MS instruments. Loss of this equipment support or redesign of the systems will present tremendous risk to the Griffin 460 GC/MS instruments capabilities, with a likely potential to degrade operational availability for extended periods of time. The parts required must be compatible (form, fit, and function) with the currently installed parts on the systems.

The services must be provided from an authorized service provider to ensure the warranties remain valid. If one (1) of the Griffin 460 GC/MS instruments is degraded to the point of needing a complete replacement, replacement costs for a single unit would cost approximately and the government would experience an unsustainable loss of detection capability for an estimated three (3) to six (6) months. In addition, the government’s investments of over $2,400,000 in this equipment would be lost if it becomes inoperable.

In addition, the risk of acquiring this support through full and open competition is the potential of selecting an unauthorized provider of warranty and maintenance support for these Griffin 460 GC/MS instruments. If problems arise in the future and an unauthorized provider has been used to maintain these instruments, there is a possibility that neither FLIR Detection, Inc. nor its authorized providers would be willing to provide warranty, parts, and maintenance support for these Griffin 460 GC/MS instruments.

6. Description of Efforts Made To Solicit Offers from as Many

Offerors as Practicable

To further broaden market research and to satisfy the requirements of DFARS PGI 206.302-1(d), a Sources Sought notice was posted on beta.SAM.gov on 14 December 2020. The posting yielded no results.

As required by FAR 5.203, a pre-solicitation notice was publicized on the beta.SAM.gov website on 17 March 2021. No responses were received.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the anticipated cost to the Government for the services covered by the J&A will be fair and reasonable. Significant (or similar) quantities of this requirement have been purchased from this offeror in the past and cost/pricing information was received on those past procurements. This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Actions To Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWC IHD Contracts Department has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC IHD Contracts Department will assess whether competition for future requirements is feasible.
