4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c)(i) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.
5. Rationale Justifying Use of Cited Statutory Authority
Parts requested must be Cisco brand name because the Combat System is accredited with specific requirements which Cisco brand products have already been determined to meet. These unique Cisco switches C9500-24X-E, C9300X-48P-A, C9300-24S- A), and IPS, FirePower 2120 are customized to work with specific existing software on a certified system aboard Coast Guard cutters. These authorized configuration items (switches and IPS) are approved for installation on Coast Guard Engineering Changes documents.
Any changes to current configurable items, to use alternate products will result in substantial redesign with major cost increases and schedule delay as well as programmatic and technical risks. It would cost the Government over $4.5 million to redesign of using alternate products, which is not expected to be recovered through competition. This estimated cost includes the following:
$2 million in redesign of mounting bracket/enclosures, environment testing, revision of drawing packages, logistic document, provisioning and training material, and Cisco devices already in procurement for labs;
$1 million in software changes due to redesign of network configurations and retest to ensure no loss of functionality.
$450K to revise and retest for cyber vulnerabilities due to the change, which would delay in Coast Guard installation to replace DMSMS non-supportable items with selected Cisco items and cause cutters to be out of Information Assurance compliance.
$1 million or more in New Construction Contract Production baseline, which could cause a Request for Equitable Adjustment (REA) from the ship builder for the increased cost.
Redesign using alternate product would also result in over 12 months of schedule impact, and it would put the Coast Guard National Security Cutter (NSC) fleet in jeopardy of revising existing Authority to Operation (ATO) package and non-Mission capable. Coast Guard Technical Contract Office Representative (COR) and Acquisition Office determined the severe setback of selecting other alternate product would have major impact to fleet readiness serving the mission to ensure nation’s maritime safety, security and stewardship.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
NSWC PHD logistic specialist conducted market research in May 2020 on part numbers provided, resulting in three authorized sellers that provided pricings of Cisco material per the requirements list. In addition, Mandatory sources, GSA Advantage and One Touch, were screened but did not offer the configuration required. Cisco Systems switches have configurable options with identified modules which these vendors and websites are unable to fulfill.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
NSWC PHD Contracts Office will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
