5. Reason for Authority Cited:
a. As described at FAR 6.302-1(a)(2), an agency may award a contract without providing for full and open competition when the required supplies or services are
c. Other Factors.
The verified minimum requirement to the Government is FFS in 16 DFACs. The current bridge contract (W911SF-20-D-0002) expires on 31 December 2020. This requirement is for a new indefinite delivery indefinite quantity bridge contract with a twelve (12) month ordering period plus a six (6) month option period. Task orders will be issued against the new bridge contract for the necessary time required based upon the outcomes of the ongoing court proceedings. Operation of the sixteen (16) DFACs will need to continue at full performance by the current contractor while the new contractor is phasing in prior to their full performance. The additional six (6) months will be exercised only as needed.
The FFS effort at Fort Benning encompasses 16 DFACS that include 4 separate categories: small with a seating capacity of 900 per meal; medium with a seating capacity of up to 1500 per meal; large with a seating capacity of up to 2100 per meal;
and extra-large with a seating capacity of over 2400 per meal. These 16 DFACs combine to serve over ten (10) million meals per year. Given the time constraints for phase-in and transition of the new contractor, the SLA and its subcontractor are the only entity in position to ensure continuation of these FFS operations for this temporary extension of full food service.
The Contracting Officer has verified that GVRA/BEP will accept this bridge contract at the current costs provided on their current contract, W911SF-20-D-0002.
d. Impact if not approved. If this justification is not approved, there will be no FFS contract in place to feed the Soldiers at the DFACs from 1 January 2021 until the new contract is awarded. As a result, units and other activities will be forced to deal with delays or disruptions in the daily dining facilities operations that provide daily subsistence. In addition, nutritional health of the Soldiers will be placed in danger.
6. Efforts to Obtain Competition: Competition for this bridge is not possible given the conditions imposed in the Court's injunction. There is an approved subcontracting plan for the existing contract. An approved subcontracting plan will be required for the bridge contract. Effective competition for the follow-on contract was achieved because multiple proposals were received.
7. Actions to Increase Competition: Competition for this bridge is not possible given the conditions imposed in the Court's injunction. Effective competition for the follow-on contract was achieved because multiple proposals were received.
8. Market Research: Under guidance in the MICC Desk Book, 6.303(201)a.2, the requirement to post a sources sought synopsis is waived when a contract is extended as a result of a protest.
