SECTION C

1. BACKGROUND

The Safety Law Division (Division) of the Federal Railroad Administration’s (FRA) Office of

Chief Counsel (RCC) annually assesses and collects several million dollars in civil penalties for violations of the railroad safety laws and regulations. Currently the Division uses the Railroad

Enforcement System (RES) to manage and carry out its civil penalty enforcement program. RES is an Internet Web interface that uses Oracle version 11gR2 as the database management system and window shell application. This Statement of Work (SOW) provides for RES system maintenance and database support on a fixed price (FP) basis.

RES includes the following Web-tool kit:

1. Redhat Linux Enterprise 7;

2. Oracle 11gR2 database;

3. Java;

4. JSP;

5. HTML;

6. Oracle Web server 10g;

7. Struts;

8. Oracle 10g Developer Suite for case generation reports;

9. AJAX; and

10. PL/SQL.

RES is used by the Division to do the following:

1) Enable the Office of Railroad Safety (RRS) to upload violation reports and supporting documentation (e.g., photos, hard copy text and graphical documents) into the system;

2) Generate, process and close out civil penalty enforcement cases promptly and accurately by preparing required computer generated documents in a manner readily permitting revisions by Division personnel and maintaining the integrity of documents uploaded by RRS;

3) Monitor and measure enforcement workload and end user performance;

4) Provide detailed enforcement information report capability to FRA users;

5) Provide access to the system via the internet for approximately 100 users from

FRA headquarters (HQ) and FRA regional offices; and

6) Electronically transmit cases to regulated entities for review on SQL database, making those cases available to each regulated entity on a nightly basis.

Technical support is needed to maintain RES and for system troubleshooting.

2. SCOPE OF WORK AND OBJECTIVES

This SOW provides for testing, maintenance, system and technical and analytical services for

RES including its subsystems – Individual Liability and Interface to the FRA Railroad Safety

Information System (RSIS).

The contractor is responsible for providing all personnel, labor, effort, transportation, materials, and equipment necessary to successfully perform RES data entry, validation, and editing services.

3. TASK REQUIREMENTS AND STANDARDS

Microsoft Word document no later than the 5th working day each month.

6. GOVERNMENT FURNISHED PROPERTY (GFP) AND GOVERNMENT

FURNISHED EQUIPMENT (GFE)

The contractor shall be issued hardware and software necessary to perform the duties required by this SOW. The contractor will be expected to provide their own Internet connection necessary for remote access to the RES servers.

7. SECURITY AND STORAGE

a. Requirements

All work performed under this SOW shall be performed per the Office of Management and Budget (OMB), the DOT, and FRA requirements as well as in accordance with

National Institute of Standards and Technology Guidelines. The contractor is required to support FRA’s efforts to ensure that RES meets the security criteria for Certification and

INSTRUCTIONS TO OFFERORS

Request for Quotes Instructions

The Government expects to award a Firm Fix Price contract resulting from this Request for

Quote (RFQ). In response to the RFQ, offerors shall submit a written technical proposal and separate price proposal. Proposals will be evaluated in accordance with the four evaluation factors listed below. The technical proposal should be submitted in a pdf format with no more than five (5) pages and should include technical factors 1, 2, and 3. Price proposals should be submitted in a separate pdf document and should be no more than one (1) page and should be for a fix priced six (6) month base period and four (4) separate, fixed priced one (1) month option periods. The contract will be awarded on a best value basis using tradeoffs.

Quote Instructions and Evaluation Criteria

The Offerors will be evaluated using the following criteria:

Technical Factors:

Factor 1: Demonstrated Understanding through Technical Approach

Factor 2: Corporate/Personnel Experience

Factor 3: Past Performance

Factor 4: Price

Technical Factors 1, 2 and 3 are of equal importance and are more important than Factor 4. As the non-price factors become more equal, the price will become substantially more important in the best value trade-off analysis. The Contracting Officer will determine what tradeoffs promise the greatest value to the Government, all evaluation factors and price considered.

The proposal must demonstrate to the Government’s satisfaction that the Offeror will successfully accomplish the solicitation requirements and overall program objectives. Proposal information provided for one factor may be used to assess other factors if the Government deems it appropriate.

The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, and deficiencies in determining technical ratings. Combined technical/risk evaluations shall utilize the combined technical/risk ratings listed below.

The following adjectives will be used in assessing each technical factor:

Rating Abbreviation Risk Level Definition

Excellent E Low Risk The proposal contains no deficiencies or weaknesses. Based on information provided, there is no doubt that the offeror demonstrates an exceptional understanding of the services required to meet or exceed most contract requirements. The highest quality of contract performance is anticipated.

Satisfactory S Moderate

Risk

The proposal contains no deficiencies and some weaknesses. Based on the information provided, the Offeror demonstrates an understanding of the services required to meet contract requirements.

Unacceptable U Unacceptable

Risk

Technical proposal has many deficiencies and/or gross omissions; failure to understand much of the scope of work necessary to perform the required tasks; failure to provide a reasonable, logical approach to fulfilling much of the government's requirements; failure to meet many personnel requirements in the solicitation. (When applying this adjective to a proposal as a whole, the technical proposal would have to be so unacceptable in one or more areas that it would have to be completely revised in order to attempt to make it other than unacceptable.)

SECTION M

EVALUATION FACTORS

The evaluation factors and sub-factors are as follows:

Demonstrated Understanding through Technical Approach

This factor will be evaluated based on the Offeror’s technical approach demonstrating an understanding of the RES maintenance and technical support requirements as well as its ability to achieve the objectives set forth in the RFQ.

The Government reserves the right to obtain information from other sources (e.g., additional

PPIRS/CPARS reports, etc.) to assess Offeror’s performance risk. The Government may consider positive and negative information not mentioned by the Offeror, but found during the course of assessing relevant Past Performance.
