About this file

This document is a Justification for Other than Full and Open Competition (JOFOC) for Lease No. GS-05B-18651 for the Mine Safety and Health Administration (MSHA) at 100 Town Center Drive S, Mooresville, IN 46158.

The current 2,760 ABOA SF / 3,081 RSF office lease is set to expire on September 29, 2024. GSA is requesting approval to add a 5-year renewal option, with a 2-year firm term, to the existing lease with the incumbent lessor without full and open competition. This will provide MSHA sufficient time to complete a new lease action. The current annual rent is $ per RSF, fully serviced. The estimated aggregate rental for the 5-year renewal option is $ . GSA has determined this is the best option since the current space meets MSHA's needs and there is no available federal space to house this requirement.

GENERAL SERVICES ADMINISTRATION

GSA Region 5

Treasury / Specialized Leasing Branch, Leasing Division

Justification for Other than Full and Open Competition

PROJECT NUMBER: 2IN0198

AGENCY NAMES: Mine Safety and Health Administration (MSHA)

1. NATURE AND DESCRIPTION OF ACTION BEING APPROVED:

GSAM 570.401(a) provides the regulatory authority to add the unevaluated renewal option after the lease award. The General Services Administration (GSA) currently leases 2,760 ANSI/BOMA / 3,081 rentable square feet (RSF) of office space at 100 Town Center Drive S, Mooresville, IN 46158 under Lease No. GS-05B-18651 for MSHA. The current lease expires on September 29, 2024. Approval is being requested to add a renewal option for five (5) years, two (2) years firm term with the incumbent Lessor, without full and open competition, for continued occupancy at this leased location.

2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S

NEEDS (INCLUDING ESTIMATED VALUE):

This Justification seeks approval to add a renewal option for a term of five (5) years, two (2) years firm at the current location, which should provide sufficient time to complete the new/replacing lease action and in the meantime. GSA has determined that it would be in the best interest of the Government to add a renewal option so that MSHA has sufficient time to complete their new/replacing lease. The current office space is already built out and satisfies MSHA continuing mission requirements. There is no vacant Federal space available that could otherwise house this requirement. The annual rental under the current lease is per RSF, fully serviced.

Thus, this requirement is for a renewal option for 2,760 ABOA SF / 3,081 RSF of office space for a term of five (5) years, two (2) years firm, to commence on September 30, 2024 and continue through to September 29, 2029. The estimated annual rental for the renewal period is / per RSF, fully serviced. The estimated aggregate rental for the five (5) year lease renewal, if exercised, is

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND

OPEN COMPETITION:

GSAM 570.401(a) provides the regulatory authority to add the unevaluated renewal option after lease award. It reads: "(a) Exercise of options. Before exercising an option to renew, follow the procedures in 517.207. The contract must first provide the right to renew the lease. If a renewal option was not evaluated as part of the lease at award, then the addition of a renewal option during the lease term must satisfy the requirements of GSAM 506 [FAR Part 6] regarding full and open competition."
