About this file

This is Addendum No. 1 to Request for Proposal No. RFI# FDC-1254, issued by James Madison University's Procurement Office on behalf of the Virtual Library of Virginia (VIVA) consortia. The solicitation seeks eBook Collections for the entire VIVA consortium membership, with responses due by April 15, 2026, at 2:00 p.m. Eastern Time. The RFI process is anticipated to conclude by July 1, 2026. Offerors must provide all VIVA institutions with trial access to their eBook platform(s) with representative content via IP-authenticated access from the proposal submission date through the completion of the RFI process. Publishers are the primary intended respondents, though responses from aggregators and platform providers are welcome; vendors distributing content through multiple platforms must detail any variations in terms, including lending rights, DRM restrictions, AI restrictions, and pricing across those platforms.

Submission of responses via the eVA portal is acceptable as the sole submission method, with no requirement for additional hard copies if submitted electronically. Electronic signatures are permitted for submissions made through eVA. Email submissions are not allowed; the eVA portal is the only approved method for electronic response submission. Respondents should clearly indicate in their submissions whether they are submitting content and terms exclusively for their own publications or whether they are also extending coverage to related imprints or partner presses, with any differences in rights or pricing for subsidiary entities noted separately. All offerors must acknowledge receipt of this addendum by initialing "Addendum #1" on the signature page of their proposal.

ADDENDUM NO.: ONE

TO ALL OFFERORS:

REFERENCE: Request for Proposal No: RFI# FDC-1254 Dated: March 5, 2026 Commodity: eBook Collections

RFI Closing On: April 15, 20265 at 2:00 p.m. (Eastern)

Please note the clarifications and/or changes made to this proposal program:

1. Is this for the full Virtual Library of Virginia consortia, or specifically for James Madison University?

Yes, this is for the entire consortium. A list of VIVA members is included in the RFI and on the VIVA website. VIVA procurement for consortial contracts is done through the member institution JMU’s Procurement Office.

2. Page 6: F. Trial Access and Product Clarifications. “Offeror shall provide all VIVA institutions with the opportunity to test the eBook platform(s) with representative content via IP-authenticated access from date of proposal submission until the RFI process is complete.” Can you please clarify the duration of the RFI process?

The goal is to have the RFI process concluded by July 1st, 2026.

3. EUP sells via aggregator platforms, please can you confirm whether the RFI should be completed by publisher or platform provider?

This RFI is primarily intended to be completed by publishers, as aggregators and platform providers may be unable to confirm content rights with the same authority as the original publisher. That said, responses from aggregators and platform providers are welcome. If your content is distributed via multiple platforms, we ask that you detail any variation in terms across those platforms, including but not limited to lending rights, DRM restrictions, AI restrictions, and pricing.

4. Regarding the Statement of Needs, A. Description of eBook Collections, can you please specify what information VIVA is seeking for this part of question 2: “Explicitly note the disposition of partner or subsidiary presses, if applicable.

Respondents should clearly indicate whether their submission covers only their own content and terms, or whether it also extends to related imprints or partner presses. If it does, any differences in rights or pricing arrangements for those entities should be noted separately.

5. Page 3 of the RFI notes that sealed responses may be mailed, express mailed, submitted in eVA, or hand delivered directly to the issuing agency. Given this, is a singular submission via the eVA portal acceptable (meaning, if we opt to submit our response electronically, it is not required to also submit a hard copy response)? Further, are multiple copies of our response needed if we submit electronically, and will VIVA accept electronic signatures?

If a vendor chooses to submit their response via eVA, there is no need to submit additional electronic or hard copies. Additionally, if submitted through eVA, electronic signatures are acceptable.

6. Will you allow for submissions to be received via email? It appears that there may be an option to submit responses via the eVA portal.

Emailed responses are not allowed. The only way to submit a response electronically is through the eVA portal.

Signify receipt of this addendum by initialing “Addendum #_____” on the signature page of your proposal.

Sincerely, Doug Chester, VCO Buyer Senior Phone: (540-568-4272)
