This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6 and 13.1 as supplemented with additional information in this notice. Quotes are being requested and this announcement constitutes the only solicitation. The Government contemplates issuing a firm fixed-price purchase order resulting from this solicitation. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2021-05 dated March 10, 2021.

The associated North American Industrial Classification System (NAICS) code for this procurement is 541714 - Research and Development in Biotechnology (except Nanobiotechnology), with an associated size standard of 1,000 employees. This requirement is being solicited as a total small business set-aside.

PART 3 – DESCRIPTION OF REQUIREMENT

The Hemostasis Branch (HB), within the Division of Plasma Protein Therapeutics (DPPT) at the Center for Biologics and Evaluation Research/ Office of Tissues and Advanced Therapies (CBER/OTAT) has been investigating the structural and functional effects of genetic variations of A Disintegrin and Metalloproteinase with Thormbospondin Type-1 Motifs 13 (ADAMTS13), which is directly involved in thrombotic thrombocytopenic purpura (TTP). Codon optimization of recombinant protein therapeutics is widely employed in both substitution therapy and gene therapy. CBER/OTAT/DPPT/HB has generated and characterized recombinant codon optimized ADAMTS13 proteins that have altered structural properties from wild type ADAMTS13. In order to determine the propensity of the codon optimized variant to generate an immune response and to compare it to that of the wild type ADAMTS13, it is important to not only analyze the structure of the proteins but also determine how they are recognized by the human immune system.

Currently we are employing a MHC-associated Peptide Proteomics (MAPPS) assay. This assay will give us candidates peptides to be used in the next step, a T-cell proliferation assay. If codon optimized ADAMTS13 are processed differently leading to a set of presented peptides distinct from the wild type ADAMts13-derived ones, then there is increased chance of codon optimized ADAMTS13 immunogenicity.

To better understand the potential for immunogenicity of codon optimized therapeutic proteins within a human context, HB need to determine if the presented peptides have the potential of eliciting an immune response by activating CD4+ T cells. For this to be done, the Contractor will need to synthesize the 20 peptides of 15 mer each, that HB has identified to be differentially presented, load then on antigen presenting cells and then expose the antigen presenting cells loaded with peptides to CD4+ T cells and monitor proliferation of the T cells.

Purpose CBER/OTAT/DDPT/HB requires a highly specialized biological analysis services that can streamline the complex series of steps needed for this project and has demonstrated outstanding experience on this type of study. The results of these analyses will be critical in determining whether codon optimization (a commonly used platform technology in the pharmaceutical industry) could adversely affect the immunogenicity of recombinant therapeutic proteins.

Requirements The contractor shall furnish necessary services and qualified personnel needed to perform the Statement of Work as stated herein. Specifically, the contractor shall provide the following:

• T cell assays shall be performed synthesizing a set of 20 synthetic peptides (of 15 mer each) at >95% purity, 1-4 mg. The amino acid sequence of the peptide has been determined by FDA, and will be provided once the contract is issued, while the contractor shall be responsible for providing the synthesized peptides.

• Peptides shall be tested at a concentration of 5μM in each T cell assay. Control antigens for the assays shall comprise two synthetic peptides for known major histocompatibility complex class II (MHC II) antigens and two whole protein antigens.

• A panel of 40 different healthy donor peripheral blood mononuclear cell (PBMC) samples shall be identified from a Tissue Bank, by the contractor, to reflect global HLA, representing a diverse group of HLAs. In all instances, PBMC preparations shall HLA high resolution typed and stored in liquid nitrogen before use.

• CD8+ T cells will be depleted from the PBMC cultures.

• PBMC cultures (CD8+ depleted) shall be set up in multi-well plates. Each assay plate shall include a set of un-treated control wells. Each PBMC sample shall be cultured with each test

FDA-21-RFQ-1241954 Page 3 of 19 peptide in six replicate wells. Cultures shall be incubated for 7 days before proliferation is measured.

• T cell proliferation shall be determined using a carboxyfluorescein succinimidyl ester (CFSE) staining assay.

• Percentage stimulation above background shall be measured for each peptide/donor combination and determined based on the proportion of CD4+ CFSE dim cells with antigen stimulation and the proportion of CD4+ CFSE dim cells without antigen stimulation.

• Percentage antigenicity, the proportion of responding donors, shall be reported.

• Response Index, percentage antigenicity scaled by the magnitude of response, shall be reported,

• Statistical analysis (one-way analysis of variance) across the data set shall be applied and additionally reported.

Deliverables The Contractor shall allocate laboratory time within its workflow to carry out the service and acknowledge the order and shall provide all required deliverables in accordance with the following schedule. All reports shall be delivered electronically via a secure webserver:

PART 4 – INSPECTION AND ACCEPTANCE

Deliverable products shall be reviewed, validated, and tested as appropriate to ensure that they meet applicable/specified standards and quality measures. In the event of the rejection of any deliverable, the Contractor shall be notified in writing by the Contracting Officer’s Representative (COR), giving the specific reason(s) for rejection. The Contractor shall have ten (10) business days to respond to the rejected deliverable and return it to the COR.

PART 5 – DELIVERIES OR PERFORMANCE

Delivery Satisfactory performance of this contract shall be deemed to occur upon delivery of services described above and/or upon acceptance by the Contracting Officer or the Technical Representative of these products/services. Deliveries required by the contractor shall be made electronically within sixteen (16) weeks of order receipt unless otherwise agreed upon with the Technical POC.

The electronic delivery instructions will be identified at the time of award.

The period of performance shall be twelve (12) months from date of award, anticipated to be August 1, 2021 – July 31, 2022.

PART 6 – CONTRACT ADMINISTRATION DATA

The following personnel shall represent the Government for the purpose of this contract:

The Technical Representative is responsible for: (1) monitoring the Contractor’s technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements; (2) interpreting the Statement of Work and any other technical performance requirements; (3) performing technical evaluation as required; (4) performing technical inspections and acceptances required by this contract; and (5) assisting in the resolution of technical problems encountered during performance.

The Contracting Officer is the only person with authority to act as agent of the Government under this contract. Only the Contracting Officer has authority to (1) Direct or negotiate any changes in the RFQ; (2) Modify or extend the period of performance; (3) Change the delivery schedule; (4) Authorize reimbursement to the Contractor any costs incurred during the performance of this contract; or (5) Otherwise change any terms and conditions of this contract.

Unless otherwise agreed to by the Technical POC, the Contractor shall submit invoices subsequent to the delivery of the required services.

B. Invoices submitted under this contract must comply with the requirements set forth in FAR Clauses 52.232-25 (Prompt Payment) and 52.232-33 (Payment by Electronic Funds Transfer - System for Award Management) and/or other applicable FAR clauses specified herein. To constitute a proper invoice, the invoice must be submitted on company letterhead and include each of the following:

(i) Name and address of the contractor;

(ii) Invoice date and invoice number;

(iii) Contract/Order number (including a reference to any base award for Indefinite-Delivery/Indefinite- Quantity Contracts or Blanket Purchase Agreements);

(iv) Description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed, including:

(a) period of performance for which costs are claimed;

(b) itemized travel costs, including origin and destination;

(c) any other supporting information necessary to clarify questionable expenditures;

(d) the contractor shall include the award item number for each description, quantity, unit of measure, unit price, and extended price supplies delivered or services performed;

(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on government bill of lading;

(vi) Terms of any discount for prompt payment offered (Prompt Payment terms other than NET 30);

(vii) Name and address of official to whom payment is to be sent (must be the same as that in the purchase order/award, or in a proper notice of assignment);

(a) list of all invoices submitted to date under the subject award, including the following:

(1) invoice number, amount, & date submitted

(2) corresponding payment amount & date received

(b) total amount of all payments received to date under the subject contract or order

(c) and, for definitized contracts or orders only, total estimated amounts yet to be invoiced for the current, active period of performance;

(xiii) Any other information or documentation required by the award.

FAR 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Oct 2020) The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. (c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".

(d) Representation. The Offeror represents that—

FAR 52.204-26 Covered Telecommunications Equipment or Services-Representation (Oct 2020)

(a) Definitions. As used in this provision, "covered telecommunications equipment or services" and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".

(c)

(1) Representation. The Offeror represents that it □ does, □ does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.

FAR 52.209-11 Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law (Feb 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that–

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner https://www.acquisition.gov/far/52.204-25#FAR_52_204_25 https://www.sam.gov/

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that–

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
