About this file

This document is a justification and approval for using other than full and open competition to award a sole source contract. The Military Sealift Command requires an original equipment manufacturer field service representative from Siemens to upgrade the fire detection system onboard the USS Frank Cable from January 30 to March 1, 2021 at Alpha Pier in Polaris Point Naval Base Guam. The justification cites that only Siemens, as the OEM of the existing system, can perform the necessary maintenance and upgrade to ensure mission readiness, crew safety, and regulatory compliance. The contracting officer will determine if the price is fair and reasonable before award. No future competitive opportunities are planned at this time due to the need for the original equipment manufacturer's support.

J&A No. N104E21Q0001

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity. Department of the Navy, Military Sealift Command (MSC), Ship Support Unit Guam (SSU Guam).

2. Description of the Action Being Approved. Award of a contract on a sole source basis for the USS FRANK CABLE (AS-40) FCB21-004 Fire Detection System Upgrade.

3. Description of Supplies/Services. MSC requires the services of an Original Equipment Manufacturer (OEM) Field Service Representative to accomplish Fire Detection System upgrade onboard the USS FRANK CABLE (AS-40) (CASREP 2008). The performance period is 01-30 March 2021 and work is to be performed at Alpha Pier, Polaris Point Naval Base Guam.

4. Statutory Authority Permitting Other Than Full and Open Competition. 10 U.S.C.

2304(c) (1). Only one responsible source and no other suppliers or services will satisfy the agency’s requirements as implemented by FAR 6.302-1(a).

5. Rationale Justifying Use of Cited Statutory Authority. The use of a required OEM Field Technical Service Representative is necessary for mission essential purposes. SIEMENS is the OEM of the existing fire detection system and is required for the maintenance and upgrade of this mission critical ship equipment and system, the failure of which could jeopardize mission readiness and result in injury to the crew and/or damage of the ship. Further, the required OEM authorized Field Technical Service Representative and OEM parts are necessary to achieve the highest possible reliability, readiness and effectiveness required by MSC for the AS class of vessels. Use of required OEM Field Technical Representatives and OEM parts maintains all OEM warranties and ensures equipment reliability, crew safety, and applicable American Bureau of Shipping (ABS) and United States Coast Guard (USCG) certifications.

6. Description of Efforts Made to Solicit Offers from as Many Potential Sources as Practicable. The Government intends to post a synopsis and a notice of intent to sole source at the Government Point of Entry, beta.SAM website. Any prospective contractor will be encouraged to respond to the notice by providing documentation of product compatibility, company information, and point of contact information to the Contract Specialist.

7. Determination of Fair and Reasonable Cost. Before proceeding with this proposed contract action, the Contracting Officer will determine the price of the services covered by this J&A is fair and reasonable pursuant to FAR Part 13.106-3 or 15.404-1, as appropriate.

8. Actions to Remove Barriers to Future Competition. For reasons set forth in Paragraph 5, MSC has no plans at this time to solicit this requirement competitively. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
