About this file

This is a Faithful Performance Bond template document issued by the County of Orange, California, designed to ensure contractor compliance with Job Order Contract obligations for plumbing services. The bond serves as a financial guarantee mechanism requiring the principal contractor and a surety company to guarantee faithful performance of all contractual obligations, including maintenance, repair, and related plumbing work across Orange County facilities. The bond is structured as a joint and several liability instrument whereby both the contractor and surety assume responsibility for the contract's proper execution. The specific bond amount, premium rate per thousand dollars of contract price, contract date, contractor name and address, surety company name and address, and other execution details are to be completed on the template at the time of contract award. The document requires approval signatures from the contractor (following California Corporations Code section 313 requirements for corporate signatories), the County's CEO/Risk Management office, and the surety representative with notarized authority, along with approval as to form by the Orange County County Counsel's office.

The Faithful Performance Bond obligates the surety to indemnify and defend the County against any breach of the contractor's contractual obligations and includes the County's reasonable costs, expenses, and attorney fees incurred in enforcing the bond. The surety waives notice of any contract modifications, time extensions, specification changes, or work alterations and remains liable regardless of such changes to the underlying contract terms. This bonding requirement applies to the County of Orange's Job Order Contract for plumbing services procurement, which is being conducted through the County's eProcurement Portal with proposals due June 2, 2026, and represents the County's standard financial protection mechanism for public works contracts.
