FOR OFFICIAL USE ONLY

FOR OFFICIAL USE ONLYUpdated: 15 Mar 16

Siemens, Inc is the sole source manufacturer of the TSECMS and, as such, is the only vendor who can provide preventive maintenance and service for the system. The software is proprietary to Siemens and no other company can be licensed to provide the services required. This software directly supports on-call emergency support/scheduled maintenance for the TSECMS which provides aircraft and turntable utilities (hydraulics, 400Hz power, PAO and cooling) for systems under test in the Benefield Anechoic Facility, Edwards AFB.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A Synopsis of Contract Action will be posted on FedBizOps IAW FAR 5.203(a) for a period of 10 days. Any and all responses will be taken into consideration to evaluate the competitive potential within the market. If no responses are received, a contract will be awarded to Siemens, Inc.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer has determined that the anticipated cost to the Government for this acquisition will be fair and reasonable, and the proposal will be evaluated using price analysis for commercial items in accordance with FAR Part 15.404.1(b) and FAR 13.106-3. The proposed price will be compared to similar maintenance and support previously sold by Siemens, Inc to the Government under Contract FA9302-14-M-L002, as well as to any other companies or agencies that may have previously purchased the same or similar items. These items have been determined to be commercial items; therefore, IAW FAR 15.403-4, certified cost and pricing data is not required. However, other than certified cost and pricing data will be requested to aide in the price analysis.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

A vendor search for preventive maintenance on the TSECMS was performed. Siemens was the only manufacturer with a current technical understanding of the HVAC control systems and the only company that is licensed to provide services for the contractor proprietary TSECMS software. The cost of rewriting new software would far exceed the cost of continuing with the preventive maintenance with Siemens Industry, Inc.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Siemens, Inc is the sole source manufacturer of the TSECMS and, as such, is the only vendor who can provide preventive maintenance and service for the system. The software is proprietary to Siemens and no other company can be licensed to provide the services required.

X. List of sources, if any, that expressed interest in the acquisition.

None.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Our market research indicates that Siemens is the only manufacturer that can provide the TSECMS maintenance services.

Market research using the Internet, GSA, technical publications and attendance at technical conferences will be conducted for similar type acquisitions in the future to determine compatibility with existing systems and or equipment, to avoid sole source situations.
