4. Statutory Authority. 10 USC 2304(c)(1) Only one responsible source and no other supplies or services will satisfy the agency requirement.

5. Justification or Authority for Action. To the best the government’s current knowledge, the ASM-2002B8 is the device with highest diffraction efficiency (>80%) on the market, for the targeted wavelength (369 nm). Likewise, to the best the government’s current knowledge, the device is the only one working at the required target center frequency (200 MHz), and with the required tuning range (+-40MHz). This model has performed successfully in frontier experiments at different institutions for a number of years.

6. Efforts Made to Ensure Offers are Solicited from as many Sources as Practicable:

A Pre-solicitation Notice originally outlining the Government’s intent to make a sole-source award to IntraAction Corporation was posted to FedBizOpps between 05-21 April 2016. Zero responses were received giving any indication that any other vendor other than IntraAction could fulfill this requirement.

7. The Contracting Officer determines that the anticipated cost to the Government will be fair and reasonable. Cost will be determined fair and reasonable by comparison of proposed price with those prices found fair and reasonable on previous purchases of the same or similar items in the same industry.

8. Market Research/Other facts: Market Research yielded results of vendors that make comparable devices to that of IntraAction’s modulator, however these devices do not meet the specifications required. Literature search in papers and dissertations did not suggest there are viable alternatives.

A Pre-solicitation Notice outlining the Government’s intent to make a sole-source award to IntraAction Corp. was posted to FedBizOpps between 05-21 April 2016. Zero responses were received.

9. Any other facts supporting Other than Full and Open Competition. None.

10. List of Sources that have Expressed in Writing an Interest in the Procurement:

IntraAction Corporation

11. Statement of Actions to Remove/Overcome Barriers to Competition: Continuous market research will be performed. If responses to this need are received that meet the required specifications, they will be considered for future procurement requirements.

12. Contracting Officer’s Certification. The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.

13. Technical / Requirements Personnel Certification. As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
